      Shemsho construction misled us regarding repairs required under the *****************************. We purchased our home in May 2021. At that time, there were some minor defects which we agreed with the builder that they would be taken care of at the one year ***** In March 2022 we met with the builder and went through the list of defects that would be covered under warranty (we had a warranty home inspection completed on Feb 2022). We agreed to a timeline of the work to be completed prior to May 2022 and he offered to throw in some extras (paint touch **** fixing minor cracks/caulking) if we didnt go through warranty and worked with him directly based on our existing relationship. Over the next few months, some of the work was partially completed but he mostly kept delaying agreed timing and pushing us off. When we filed a claim with warranty in September 2022 the majority of our claims were denied. The claims rep noted in the determination A lot of your items would have typically fallen in the 1st year of coverage and at the time your claim had been submitted you were within your 2nd year. I believe the builder intentionally pushed us past the one year **** so the items would not be covered.

      The home owner would like items covered that were never included in the warranty to begin with, the coverage limitations are all explained to the home owner in the determination sheet that they received as well as me and no where on there does it say that the coverage is not included due to being past the 1 year ***** The home just wants items fixed that are not included under the warranty. ******** is the determination letter from home warranty and no where on there does it say jt is not included because its been too long. The items that were covered by warranty were all fixed from the warranty provider.

      I am rejecting this response because: 9 of the 18 items under Not Covered Under Warranty in the Warrantable Determination document ******** by the builder in their response (same document we received) state that they would have been covered under "Warranty Coverage: 1 year for defects in materials and labour." I am also ********* the email from the claims representative that explicitly states "A lot of your items would have typically fallen in the 1st year of coverage and at the time your claim had been submitted you were within your 2nd year." The Warranty Provider only covered two items covered under "2 years for defects in materials and labour related to delivery and distribution systems" as our claim was filed past the 1 year **** based on promises from builder to correct the items without going through the home warranty provider.

      Home owner was provide a package from home warranty after they moved in they should have reviewed the package and known when the warranty expires and how long it is for. It is not a builders responsibility to explain these to the home owner. Under the ******* warranty act it is the home owners responsibility to review coverages and request coverage if there is damage not the builders.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********. I hope this correspondence is available publicly so other homeowners do not make the same error we did when this builder specifically asks them to not go through home warranty for repairs. It is misleading and dishonest. In the last response, the builder specifically acknowledges that the process should be for home owners to go through home warranty prior to the warranty expiring. Shemsho Construction, as a builder, should not be trusted to do the work based on their word or existing "relationship" as they just continue to delay things until it is past warranty expiration.

      Shemsho construction is misleading. We purchased a new build house in ********* **** with a warranty. Every time we tried to go through the warranty, they asked us not to and said they would fix the issues. We have unresolved issues from the initial walk-through. At the one-year warranty mark they did not come and said they would come after they got back from vacation. Covid was also used as a reason they could not come. They finally came to start some of the finishing work and now have left the job partially completed and are saying they do not agree with the list of work to complete but will not answer calls or explain what they do not agree with. It seems they delayed until the warranty period was over and are using bad business practices. Shemso is in breach of contract and are avoiding the obligations and commitments they made.

      I am rejecting this response because: This has been going on since ********* ****. I had put a complaint in before the Shemsho said they would contact me and finish the work on the house from before we bought it. I have continued to reach out with little to no reply. Shemsho has made time commitments and has not followed any of them. Calls are repetitively sent to voicemail, and text messages go unanswered. I want the repairs that they agreed to finish and to have a conversation about when and get a commitment that it will get finished.
