      On Feb 2021 I hired MCH Builders to build a custom home in the amount of $287,000.-- . So far I have paid $349,861 .-- and have still not be able to move in the home. Also, there are a number of tasks that the contractor has not completed, or, is billing me for, as they are part of the contract. There was a second contract, on which the contractor cashed the deposit, and committed complete breach of contract, leaving me stranded, and scrambling to find another contractor so that I could move into my home. I made crystal clear to the contractor that if he was not going to proceed with the job, he was to refund me the deposit in full.

      MCH Builders LLC completed the home per the contract. The extra costs involved were due to other work contracted with the home owner outside of the scope of the original contract. Other charges charges were valid through the original contract which were discussed with the home owner and paid for by the home owner. Again the home was completed back in April

      The home owner has not been able to move into her home because she went back and forth with APS for several months trying to come up with her own plan of how she wanted to *** to do there job. Again I only know what she was telling me since she was the one handing that. I don’t know how I can be blamed for something that she was handling

      Once she received her 3rd and final plan from *** I have her yet another cost for that work. She agreed to the cost for the work and paid the required deposit. She then started badgering me about the cost and said she felt like I was holding her hostage. I had enough and told her I thought it would be best if she found another contractor to perform the work. She requested that I send her deposit back which I did. She claims that she never received it. She still owes for the contracted work and completion of the home but refuses to pay what is owed per the contract

      Good morning, for records, I do want to make sure that you did receive 6 files I submitted with the complaint, it appears that you only show 3 files, please let me know if you are missing some.

      Clearly, we are in disagreement of what is included in the contract. As per the contractor email, which I submitted in the complaint, the contractor states that part of the original home building contract, he would cover the cost of the power to the corner of the property. Then he commingled invoices from the separate APS contract, with the home contract billing $7,710.-- for a separate job.

      As the contractor accounting practices are very loose and confusing, this has taken some work to go back, and figure out the numbers, separate both contracts. I have been gauged for a long time by this contractors, while there are a number of invoices incurred to change orders, there was numerous invoices, "overrun costs" for which NO details were ever provided, as they should have been per the contractor's contract. I kept on receiving additional bills for "hard dig", cost over run, with NO details whatsoever.

      Also, the contractor wanted to charge me again to redo the baseboards, as he knew that flooring had not been installed, back fill was NOT completed for the water line, as of today I still do not have remote controls, the place was left out as a dump. I have numerous pictures of trench left unfilled, trash left around the house, rocks left around the home after building the pad...

      This contractor did NOT care to complete this home.

      When the house was completed in April there was no trash onsite.  I'm not responsible for trash from people that home owner has had back forth to the property.

      There where rocks around her home because that is the terrain that she lives in.  Our contract did not include a final grade. Our contract included only the necessary work for the house pad.  Her house pad became a hard dig situation so I let her know the condition and the cost to proceed.  She approved

      The home was completed and now she does not want to pay her balance.

      At the time of the extra cost were presented they were discussed as to why and the amount.  She accepted and paid those cost.  She did not just write me a check because I asked her to...she asked why the extra charges and I explained to her.  That is why she paid the extra charges.

       

      I really don't know what to do for her. She will be required to pay the balance owing

      COST SUMMARY:

      Home Contract
      Final Draw:$14,350.—
      Additional invoice mailed after completion of the project: I was not informed, about this additional cost, and hereby decline to pay it. I certainly would have canceled the job if I had been presented with this additional cost. The walk way is the only job that was done under the final draw, and I was already questioning the cost of it before proceeding, the contractor moved forward, AND, then issued an additional invoice.
      Estimate of pro-rated *** job, since the contractor breached contract and did not complete any of the project: cost from the home to the corner of property ($11,274.).Based on Invoice#11, plus cost shading, pro-rated based on linear feet.
      Baseboard Redo ($1,600.--)
      Open water trench, ($3,150)
      Remove rock around the home pad ($2,500.)

      Paid $7,710.—billed as “conduits”, is that really part of ***, or, the home contract. Nevertheless, the contractor cashed the check, breached contract, and left me scrambling finding a solution to complete the home. The contractor claimed to have sent a refund, but I never received ANYTHING from him in form of refund, he walked away, cashed the check, and now refuses to recognize that he had committed to complete the work from the home to the corner of the property. I made crystal clear via text, please view attached document, that this had to be refunded. Due back ($ 7,710.--)

      IN SUMMARY
      All the amounts in red are due to be credited back myself.
      Open trench on the water line, shows complete lack of customer care
      Rocks left on the pad site, shows complete lack customer care
      Walk away from *** contract, major breach of contract, this left me stranded, leaving me out living out of boxes for now almost 3 months.
      Failed final inspection at least 3 times, lack of customer care

      Again, I have NOT received any refund from the contractor, as he claims he did.
