      As a land owner who paid a hefty deposit to add our parcel to the Walden Meadows Community Co-Op, I am entered into a contract with Walden Meadows Community Co-Op (****) for water delivery. Nowhere in that contract does it say service may be disconnected for any reason except nonpayment of bill. It also says nothing in this contract about there being a limit to how much water you can have delivered per month. **** reached out to Yavapai County rather than myself, the person with whom they are in a contract, to inquire about our parcels water usage and if we had the necessary permits for our parcel of land. When the county informed them that we did not have every permit but we were in the process of getting them reviewed, **** then told me they would not be delivering water to us until we have all the necessary permits for the parcel. The contract we are entered into does not say anything about needing to have all required permits in order to receive water delivery service, nor did the **** employees who came to our parcel when we first set up service almost 2 years ago. **** has also refused to deliver us water due to the condition of the dirt road coming up to our parcel. We do not have a tractor and Yavapai County does not maintain the road all the way to our land. I know for a fact that **** delivers water to other parcels in our little town of ******* that also do not have all necessary permits through Yavapai County. This latest discontinuation of service happened on December 9th, 2022. Since then I have been speaking to Yavapai County and the Co-Op to try and get this resolved with no luck. I have animals and currently no water in my tanks. I need to get this resolved quickly and need **** to honor their contract with us and deliver water like they said they would. Thank you so much for your help in this.

      Walden Meadows Community Co-op (WMCC) and Yavapai County have been in communication with this customer, *********************, for many months. ****** became a WMCC customer in April 2021. We understood she was either building a house or moving a manufactured home onto the property. Her parcel is not easily seen from the road. Several months ago, we were informed that no permanent dwellings were on the property. After investigating further, we discovered there was no septic system either. Yavapai County has cited the property owner regarding several issues and states that no one should be living on the property in its current state. At that time, we informed ****** by letter that water service would be discontinued until she met Yavapai County guidelines.

      There is no contract between WMCC and its customers. As we are a co-op, every piece of property has to join the co-op before water service can be considered. ****** did join the co-op in April 2021. Also, she paid the standard $75 deposit that all new customers pay. We have never limited the amount of water that ****** or any customer can use. On Feb. 22, 2023, I spoke with ******************* in the ******************* of Yavapai County. They issued a Septic permit to ****** on Jan. 18, 2023. However, ****** has not applied for any other permits. Per Yavapai County, land owners must have a Temporary Dwelling permit to reside on their property while building a permanent dwelling. WMCC has repeatedly told ****** that we will resume water service once Yavapai County requirements are met. We have cited ******* Administrative Code, Title 14, Chapter 2, Article 4, R14-2-410 in regards to "The existence of an obvious hazard to the safety or health of the consumer or the general population."
