I was unfairly evicted from **** ** **** **** ******* ******** ****** due to an uncommunicated deficiency balance of $167 from May 2024. This uncommunicated balance created a chain reaction, which I was never informed of by Landon Management. Had I been made aware of this small amount owed, I would have promptly made the payment. I vacated the property on July 15, 2024. According to the Arizona Mobile Home Parks Residential Landlord and Tenant Act, section *********** a landlord must return a tenant’s security deposit within 14 days of move-out, after deducting any unpaid rent. However, on August 2, 2024—18 days after I moved out—I received an email responce from Jeff Landon stating, "You owe us money. Feel free to drop it off at the office when you have a chance." This communication was not provided within the required 14-day period, nor did I receive my $500 security deposit including interest on the deposit or an explanation as to why it was being withheld. This lack of communication is a violation of section 33-1431(D), which mandates that landlords must provide a written notice within 14 days, explaining any deductions from the deposit. In summary, the landlord failed to return my deposit within the legally required timeframe and did not provide the necessary written explanation for withholding it. According to subsection D, the penalty for this failure could include the return of the deposit, along with double the amount wrongfully withheld. Additionally, the landlord is required to pay interest on the deposit, which was not provided or accounted for by Landon Management, as stipulated in section 33-1431(B). As a result, Landon Management is required to remit a total of $1,025 to me. This amount encompasses the security deposit, includes $25 in interest pursuant to Section 33-1431(B), and an additional $500 in accordance with Section 33-1431(B) of the Arizona Mobile Home Parks Residential Landlord and Tenant Act, which obligates the landlord.
