      On May 24 2023 *************************** and ******************************* purchased a manufactured home from the seller's ****** and *************************. Prestige Manufactured Homes, ***************** (dealer) and ******************* (realtor) did up the purchase agreement. Buyers have gone to the emergency room due to being sick. We just found out that the home has preexisting stachybotrys mold in it. Buyer(s) are having to sleep and live out side. Buyers have mold results, will show upon request in person. Picture of mold is in the wall behind the stove. Seller's, realtor and dealer failed to disclose faults of home per purchase agreement and law. This is a binding agreement and contract.

      **************** & ****************: we are in receipt of all your emails, voicemails and in person concerns that you have been voicing, in regard to your Park Model ** in ************************* MHP. This is our final attempt to rectify and address your concerns.

                   We have been in contact with the following agencies that we rereferred you out to,that have reviewed the information and had decided to closed the file/case that you opened with ********** of **************** HCD ************************* , we have also reached out to ********** of ***** Vehicles aka DMV  and pending Better Business Bureau aka BBB outcome.

                   *************** & **************** so Im clear on the message to the both of you, you purchased a used **** Park model **. That was originally marketed at $55,000.00 and you offered $40,000 as is where is with all current faults on a home that was set up in a community that you were able to watch through the home and do a complete visual, and you waived all inspections. I have also attached a signed mold disclosure for your review. Per the purchase agreement it was clear that the home was sold as is where is with all current faults.  Sold as seen on site with no other negotiations or capital improvements to the property.

                   **************** & ****************, the items you have outlined are the following:

      Washer & Dryer: box was checked by mistake and was never park of the transaction, upon walk through before contract was written you both confirmed no washer & dryer were present, and there were no hook *** to provide a washer & dryer. After Checking with DMV and RIVA we cannot modify your home to place a washer and dryer in it.  (No further actions will be taken).
      Electric Hot Water Heater: is working and supplies warm water and my need to be addressed soon, as this home was sold as is where is with all faults. All extended warranties were declined by you both at closing.  (No further actions will be taken).
      Sliding Glass Door: SGD is not required to have a keyed entrance, the back door has a key system that will secure home, homes was sold as seen on site as is where is with all current faults. (No further actions will be taken).
      Smoke: The home purchased was a **** remodeled ** approx. 31 years old  So as seen on site  as a used home, sold as is where is with all current faults. (No further actions will be taken).
      Mold: to the best of everyone involved no mold was seen over covered up, see attached mold disclosure that you declined, home was sold as is where is with all current faults. (No further actions will be taken).
      Appliances & Appraisal: The appraisal was not ordered by **************** or **************** and is not part of the contract, as for the appliances were sold as seen on site. (No further actions will be taken).
      Homeowner Insurance & fees:  Buyers are fully responsible to obtain their own homeowners insurance. The fees collected in the amount of $815.00 were fees disclosed on the addendum. (No further actions will be taken).
      Cabinets, Flooring & Vents:  You purchased a completely remodeled ** from the park at the end of May.  The floors, cabinets and appliances are all brand new.  The sales contract states that you agreed to purchase the ** in its present physical condition.  Almost immediately upon taking possession, you had many complaints.  These issues should have all been addressed before the closing, if you had responsibly done your due diligence before purchasing the home.  To our knowledge the ** was never flooded, and no one has ever reported mold. (No further actions will be taken).
      * **************** & **************** while we are within our rights to enforce this contract, the sellers are willing to refund your monies,minus fees and rent if there is no damage done to the **, the title is relinquished and retured, and you vacate the park by Thursday July 20, 2023 by 5:00 pm, This offer to accept will expired Saturday, July 15, 2023 by 4:00 pm.

      **************** & ***************, here are the terms to review and must be executed before funds can be released.

      Title must be returned to park office on or before Thursday July 20, 2023 by 12:00 noon.
      Home must be in the same condition as upon move in.
      All person items must be removed from inside and exterior of home.
      Space rent must be current.
      **************** & **************** please review the attached letter so we are clear, that no other terms will be offered, if no reply is received will accepted no reply as a agreement that you will remain in the community as a resident without any other future repairs being completed, and you are aware that the home was sold as is where is with all currents faults and that both Seller & Dealer are not responsible to complete no more work nor repairs, we will consider this file to be closed.

      I am rejecting this response because: the purchase agreement states there are no repairs yet there are repairs. Pay ** for a washer and dryer per purchase agreement.  Seller was to disclose ALL faults within 3 days, also in the purchase agreement.  So , we could think about buying the dwelling based on the listed faults. And your secretary who called *********, a guy was very offensive and rude to her. ********* is a female by birth.

      The original seller has offered to purchase the home back from the buyers, ans return the fee of $815.00+ $40,000 to a grand total of  $40,815.00 base on move of July 20, 2023 or sooner. All space rent and Utilities must be paid current upon move out. 

      Buyers can also stay in the property and home is sold as is where is with all current faults with no other repairs to be completed and this matter is considered closed. 

      this is a preowned home not brand new and is considered a RV registered with DMV. Sold as seen in side, buyer waved all inspections to save money on a home that was listed for $55,000.00 sold to them for $$40,000.00 as is where is with all current faults

      I am rejecting this response because: Prestige Manufactured Homes was given copies of the Positive test of Stachybotrys mold in the unit and diagnosis of mold exposure for both buyers. We gave an offer of $250,000 for personal items and loss etc from this mold. After this rejection all demands, offers and requests are off the table.

      In September, 2021 met with ***************** of Prestige Manufactured Home re placing pre manufactured home at back of property at ********************************** in *******. 12/8/21 $15,000 check given to office staff for permits and deposit. No contract was ever signed. Lots of excuses made by *****************. No progress was ever made. Letter requesting refund sent 4/5/22. No response ever made.

      Attached you will find the initial contract that was signed by the Buyer.  Please note that to date we have not received a cancellation from the buyer herself.   the client has a right to cancel and we can refunds  based on the terms of our contract, we have not received any form of cancellation from client, upon receipt of cancellation we can send a refund.

      I am rejecting this response because: I have been defrauded of $15,000! I am no closer to having a pre manufactured home on my property than I was before I met *****************. He has taken advantage of an 81-year-old woman. He took $15,000 from me and there is nothing to show for it! And for the record, I did ask for a refund on April 5, 2022 via email.

      Attached you will find the cancellation document.  PMHI has only heard from someone by the name of *********************, who did not seem to have the correct email address to communicate with.  Hermelinda's agent has not heard from her either in regards to wanting to cancel.  Please note ***** has no involvement with the transaction and therefore the document as well as any communication must come from *************************************.
