The business is advertising a product in a misleading manner that violates the ************************ Act. The business is making specific and comparative performance claims for a product without providing any substantiation to support the claim. The company is advertising that the product performance has been verified by testing and that the verification test has been made by an independent entity. No substantiation of these claims is provided to consumers. I contacted the business to learn about the basis for the claims and did not receive a reply. Several weeks later I inquired again and was informed the company dismissed my questions because they believed I was not qualified to ask them how they substantiated the claims for the product performance. Lacking substantiation for the product claims when the product is being sold to consumers is a violation of the ************************ Act and is deceptive advertising.Initial Complaint

On October 20th I ordered an item from equilibrium tuning that was stated on their website as ready to ship. Upon ordering the item I waited for 9 days and I noticed the item had not shipped still. Upon looking at the item on their site once more, they had moved the item to a backordered status and there was no indication on how long it would be for the item to ship. Instead of waiting for the item and having my money held up, I decided that I could use the money elsewhere and cancelled the item. Even though the item was backordered, the refund I could get per their policy was only 90% of the total price (including shipping costs and tax). I feel that it's unfair that a cancellation of a backordered item wouldn't qualify for a 100% refund. I could understand if the item was pulled out of stock and ready to ship or about to ship, but the fact that none of that had occurred it feels like this is an unfair practice. It seems like putting their customers in a position where they could hold their money indefinitely, where the customer would have a fear of not getting a 100% refund for cancelling, is concerning.
