I was referred to BBB by a stay housed LA workshop I attended 05/24/2024. In November 2023 Sunrise Apartments in ******** which is managed by Excel Residential **** (ERI) sent me to collections. They claim I owe 7 1/2 months worth of rent for breaking my lease. I received a 3-day notice in May and turned over possession on May 29,2023 . On June 5, 2023 a new tenant, ******************************* moved in. I found out ***** lived there because I went to my old apartment February 21, 2024 and knocked on the door. ***** let me know the manager, ************************* told him not to worry about paying rent and apply for the rent relief program. ***** told me he was a former tenant living with his mother in one of the units managed by *** and needed his own place. ***** is in a wheelchair and needed a downstairs apartment. ****** called him and told him they have a downstairs unit available at the *******************That unit was my old unit at ****************** ****************************************. ***** moved into my unit that means the landlord mitigated damages and Im not responsible to pay rent for a property that is occupied. They are trying to collect double rent. I contacted the collection agency that they sent me to NATIONAL CREDIT SYSTEMS (NCS) . I filed a dispute with NCS as well as Transunion and both are claiming that the charges against me are accurate.I spoke with the collections department at ERI and they are saying that they dont have information that ***** is living at my old apartment. I have been in contact with ***** and he gave me the first page of his lease agreement which states his move in date. Im only responsible for **** rent as well as any repairs minus the security deposit. In total I owe $510 not $12,271.50. I believe the management did not report to the owner that there is a new tenant occupying my old apartment.Also, *** is based out of ***** and it is difficult to contact the actual owner of the company.
