We paid Donor Nexus approximately $20K 6 months ago for 5 donor embryos. We made our purchase decision based on a profile they provided purportedly containing information about the donor parents/embryos as well as representations made via email by Donor Nexus employee Miranda ****** We recently learned after our first embryo transfer (performed by HRC Fertility/included as part of the contract cost) that several key pieces of information we based our purchase decision on were incorrect. We were subsequently advised we could receive a complete refund or we could go forward with our second transfer cycle (which we had already begun) and receive a $10,800 refund. However, we were suddenly asked to sign an overbroad release. We submitted revisions which were not accepted. Donor Nexus is at this point denying us a reasonable remedy. We want the promised refund without being coerced into signing an overbroad release.Business response

The patient was informed about the information in detail prior to the procedure by the IVF physician. The patient could have chosen at that time to receive a refund or select a different profile. The patient elected to move forward with the transfer. She only made complaints after the transfer was unsuccessful. The allegations against employee Miranda ***** are false. We refute all claims made by the patient. The settlement agreement sent was a standard general release. The patient made modifications that made it a non-release. We attempted to edit the release to satisfy both parties but the patient was not interested in signing any release other than the release that she edited. We are happy to proceed with the $10,800 refund with the standard release that was originally sent to the patient.
