Infiniti of Oxnard was trying to sell me a vehicle, when I realized the vehicle did not have a warranty I told them I did not want the vehicle. In order to have me buy the vehicle they charged me more so I would have the warranty I wanted. Then when I started having problems with the vehicle the warranty company would not honor the warranty because they said the vehicle had been modified. I purchased the vehicle as is with the warranty. On top of this I did a car fax of my own and the car fax shows that this vehicle had been sold two months prior and returned so the dealership had knowledge of the vehicle’s problems. The final issue with this dealership is when I purchased the vehicle I found out months later that the tires were unsafe due to age. Expired tires. I feel like this dealership will lie cheat and steal to get customers to buy cars from them. I am now 17 thousand dollars out of pocket on this vehicle. They say it’s not there problem and it’s the warranty company’s problem. And the warranty company blames the dealership. I believe it is the dealership’s responsibility to sell a warranty for the vehicle that pertains to the vehicle. $30000-cost of vehicle -$10000 down $4000-cost of warranty $17000- out of pocket warranty did not cover $51000 total for $30000 vehicle not including financing

We have attempted to assist the customer in trading the vehicle as now it has 125,000 miles, we have offered to pay over value on a trade in however customer declined. We have also contacted warranty company and they agreed to refund the warranty in full $3700.00 even though they had paid claims already on the vehicle. Customer declined this assistance as well.

I am rejecting this response because:
I did not want to purchase a vehicle without a warranty. Therefore if the warranty company reimburses for the warranty I still have no warranty and would never had purchased the vehicle. The whole reasoning for purchasing a vehicle with that many is because I knew I had a 70000 mile warranty. If you would like to pay off the loan and take the truck back I would agree to that. And then I can have the warranty company reimburse me for the warranty. But I do not want to purchase another used vehicle. I don’t want to get stuck  with this same problem again.

On Saturday, 10/14 I signed the contract with a salesperson who didn’t break down or explain the contract but rushed me to sign it. On 10/15 i went back to pick up the car they said there was nothing wrong with it. In addition, they told me Capital One would only finance the deal if you put $800 down and I had to buy an over $2000 service contract. I felt obligated to take the car b/c I unknowingly signed the paperwork the day before. I drove the vehicle home and less than 50 miles. On 10/19 while i was driving it completely turned off while i was in traffic coming from Doctors appointment, I put the car in park and started the engine and proceeded to put the car in drive and it shut off . I attempted this several times.I had it towed home and told the dealership they had to pick it up to repair it as it clearly had an issue. They picked it up and didn’t call me until late Friday afternoon after they realized they couldn’t open the hood. On Saturday 10/21 they sent someone to pick up the key. Additionally I spoke to Capital One investigations as it was clear they sold me a lemon, lied about the service contract and down payment. More importantly, the miles on the contract do not match the miles on the vehicle. So they lied about the miles on the vehicle. It is now being investigated with Capital One. For over a week they refused to call me back, tell me what is wrong with the vehicle and i have discovered they committed fraud. I need help dealing with this situation as the General Manager of the dealership refuses to discuss this matter with me

They ran my credit report without asking me. They collected information from me by saying they needed to ensure I wasn't committing fraud. I told them I would pay in cash, and I didn't understand why they required such information. They told me they could only sell to me by running a background check. I wanted the car I was looking at, so I gave them my info. The paper they filled out had very little information on it. It simply reads the person's first and last name, where they lived, how long they lived there, previous place of address, how long they lived there social security number, and a signature saying this info is correct. Nowhere on the paper did it say your credit report will be pulled. I was also told this was for their use later if necessary, such as if I wasn't who I said I was or I wrote a check that bounced. They then wanted me to pay over $4000.00 more than was advertised on the website. I didn't think that was fair, so I didn't buy the car and left. They then called and texted me after leaving, which bothered me and made me feel like they were invading my privacy. More than an hour after I had left the dealership, credit karma notified me that Infiniti of Oxnard had just now run my credit. They never told me they collected my info to run a credit check, and I never agreed to any loan. I even explicitly told them I would not finance the car and that you were not to run my credit. I would be paying cash in full. I firmly believe they were malicious towards me and only did it to hurt me because they didn't get a sale from me. I had never agreed to a credit check in the first place. I would like them to inform all three credit bureaus that they ran my credit without my permission and remove the credit inquiries from all three credit bureaus. I would also like to ask BBB if running a credit report without their consent was a crime; if so, I would like to press charges. The event took place on Aug 10, 2023.
