      I entered into a contract with Spartan home services Roofing in January 2023 for a roof replacement for $18,000. However, after they started working and removed the roof, they asked for an additional $26,000. I was stunned, as they had already taken the roof off in rainy season and I had no other choice but to accept their price.I eventually paid them $19,000, and sent a check for remainder they refused to address the damage they caused to my gutters, attic clean up, and yard. They also refused to remove their tools and lumber from my property.they sent a settlement offer, asking me to waive my rights against them. I refused to sign the settlement offer and yet asking for legal fees. Spartan has been delaying my complaint so keep adding interest to my balance. I even posted a review on ****** about my experience, and they called me within an hour of posting the review to threaten me again.I am tired of being bullied by Spartan Roofing. I just want them to finish the job they started and stop harassing me. I have already paid them more than $45,000, full amount of the contract. I made a mistake thinking that Spartan home services is reputable company and responsbile. I regret that I have paid in full more than $45000 for one roof. even I feel it was outrageous and rip off but I want Spartan stop making threats and take care of the job. they overcharged $15000 but still they want to delay this process and get additional money for interest.*************************** stated they filed a lien on my property. they wrongfully put a lien on my property.I want Spartan to take their stuff out.Pay for damages to the gutters Pay $350 for the tenant, because they damage the ceiling and they had to be out of building.clean up the attic and take their tools out.

      We are saddened to hear about the customer's dissatisfaction but feel it's important to clarify several key points to provide a complete picture of the situation.

      Scope of Work and Additional Charges:
      The original contract for roofing services was set at $19,000. After the work commenced, we uncovered severe structural issues that required immediate attention, along with the need for custom scaffolding (the home is 3 stories, steep, and needed major framing). These unforeseen problems led to additional costs, fully discussed and agreed upon with the homeowner.

      Payment and Timelines:
      We acknowledge that the original sum of $19,000 was paid, but it is crucial to note that this payment came 45 days after the completion of the project. Furthermore, the balance of the second contract for the structural work, was sent 110 days late, significantly affecting the progress and resolution of any subsequent issues.

      Lien and Legal Fees:
      Due to the 110 day delay in payments, and after multiple attempts to communicate, we had no option but to place a lien on the property to protect our financial interests. This was not an action we took lightly, but it was necessary given the circumstances. No home that has paid before the lien deadlines with spartan has ever or will ever receive a lien.


      Additional Concerns
      We have not been made aware of any damages to the gutters. We are more than willing to inspect these alleged issues if they are communicated to us formally, while simultaneously resolving any other clerical issues.


      Online Review and Communication
      We regret that the customer felt harassed by the voicemail and subsequent call with him; our intent in responding to the online review was to facilitate communication and seek resolution. Usually the intent of one is to make an issue known so we can reach out, which we did.


      In summary, we have fulfilled our current contractual obligations and have been patient and flexible regarding the delayed payments. We remain open to resolving any other concerns the homeowner may have, in line with our long-standing commitment to customer satisfaction. We have successfully completed over ***** projects and aim to resolve this as we have the otherswith professionalism and fairness. Spartan does take a stance of expecting others to honor their word, this does occasionally result in people lashing back but we believe the public can view this for what it is.

       

      Spartan has offered a Settlement to *************** that is currently rejected, so we assume he will reject the response here as unsatisfactory as well. If he changes his mind and decides to come to the table so we can get the outstanding concerns resolved, we will work with him.

      I am rejecting this response because:

      1. after going through so many requests, they removed their belongings on 09/15/2023. that is the day they can report they finished job.

      the company did not have the rigth to put a lien on my property but Spartan bullies customers and they do anything to harm customers. their intention is not good at all. 

      2. they still left attic with a lot of debri. the business dispute the cleanup but they dont have my signature on the change of order. removing shingles, not needing cleanup but when the deck and plywood changed , yes it is needed to clean up the attic.

      3. their response shows how business trap customers in complex contracting so to to justify their wrongdoing.

      4. they had received final payment on Aug 11th, but still claiming they didnt receive it so they can ask for huge interest. 

      The contract initially was $18300.00, then adding another $25,000.00 it was a trap. when they removed the whole roof in rainy season and forced me to accept their abusive contract and high price.

      the company says a lot but in reality they are not a good company. . I lost $45000 for a roof size of less than **** sf surface building.

      Spartan is not a reliable company .

      We do acknowledge a payment was sent to us August 11th, 80 days after the payment schedule called for the next payment. We wish this project had transpired differently, and hope we can come to a resolution with the client.

      I am rejecting this response because:

      the contractor did not complete the job, yet initiated bullying and taking legal actions.

      His emails and texts were nothing but intimidation and bullying to grab money.

      the contractor left the attic essentially harmful and potentially dangerous to residents, yet declined to clean it.

      I also disagree that the contract allows them to leave the attic that way. that contract is an unfair complex

      I will pursue further if a contractor can rip off the roof and leave building at potential major disaster in rainy season and ask for $25000 additional cost. while others would have charged a lot less. it is unfair to consumer.

      they didnt spend 2 hours of time on cleaning the attic but they spend hours to quiet down a customer. they want me to remove the ****** review. In fact they wanted to shut me up and prevent me to express myself. 

      They removed their stuff in September when they had got the whole payment of $45000 before aug 12th. 

      they keep repeating the same things and never pay attention. they got $45000 yet they didnt want to clean up the attic which may cost a couple of hundred dollars. 

      They should have given estimate for the deck repair in case needed so I would have expected and possibly get quote from other roofers. it was unfair to force me to pay additional $25000 after ripping off the whole roof. and leave me with no choice other than accepting their price.

      I'd like to look into other remedies,  the bond and CSLB as I feel this contractor, Spartan Home Services, has been very unfair in their proposal and framed me to grab $45000 of a roof and yet bullying to get additional interest and legal fees when the job was not even completed. 

      Winter is coming, I am not confident that even though they got $45000 the roof is in good shape or not. they give warranty but when we have problem how would they react. I dont have any confidence on Spartan Home Services. They are not reliable. 

      They owe me $14000 for excessive charges and cleaning the attic.

      We understand the concerns raised. However, it's crucial to clarify:
      1. Attic Cleaning: The attached signed contract agrees attic cleaning was not part of the work. We will honor a written agreement if one exists stating otherwise.
      2. Payment Schedule: Work halted due to an 80-day payment delay by ****************, as admitted by him. Below is attached proof of final inspection date and the (missed) payment schedule.
      3. Lien: Taken as a last resort after two months without any response from ****************. This was also at ******************* own written instructions, on May 26th, the last day he responded to us, which we have attached. 
      4. Settlement: We use a nationwide standard template to formally resolve disputes. We have no problem getting an amended version without it, but *************** won't respond anywhere but here.
      5. Warranty: Eager to finalize this so the warranty can be registered as per manufacturer requirements. We are on a time limit to do so, so we hope this can be resolved fast

      We remain open to resolving this issue fairly and promptly.

      I am rejecting this response because:

      I dont see any resolution in this case here. as I have paid in full they keep repeating the same things to distract from the main issues. 

      1. Spartan Home services have received the payments in full despite they have not finished the job.

      2.  despite overcharging and unfair addon cost of $25000, I have made the payment. 

      3. unfortunately it shows how unreliable Spartan is. Despite taking $45000, they are not fulfilling their responsibilities. 

      4. I disagree the attic cleaning is part of their responsibility.

      5. This is a company has framed so that can impose  a massive change of order of $25000,  on the top of $18300.  when there was no possibility of getting a 2nd quote because they had ripped off the roof in rainy season. ( other roofing companies do the same job around $28000- $32000) .  But at the time, because they had ripped off the roof so I could not have any other company involved at the time. there should be some law to prevent this kind of scam.  

      This matter can not be resolved unless the company change their abusive approach. 

      I stop responding to this, because I don't believe Spartan Home services is a good nor reliable company to do the roof for me or anyone else. their intention is to grab the highest amount and walk away. I have lost $45000 to a scam.

      I used Spartan home services for new roof back in Oct 2022, paid them ****** for a complete new roof. Due to excessive rain this season we started having a leak. Reached out to Spartan with my issue, I never heard back from them. On March 20, 2023 I reached out to them again to follow up as I never heard from company. At that time I was told by **** he came out on Friday ***** and discovered what the problem was and his guys were on the way out to my home then to "fix" the issue. I never was aware **** had come to my home on ***** as we were not even home on that day, I was outside of Ca on vacation.He indicated issue was now fixed. We started getting heavy rain and on ***** I contacted **** to let him know water was poring in more than before, he sent a guy out to look at it. *** did a "Quick fix" because it was raining and would need to come back for additional repair work. He did come back on ***** and did more "fixing". Water still leaked in, I contacted ***************** who at that time told me it was leaking because of Stucco work we had done after the new roof was installed. I did reach out to the ************** and are working with him on repair work due to extensive damage done by Spartan during their "quick fix". Spartan is now telling me they will not cover repairs for leaking rook and bad work done by there guys and I will need to pay them to fix. I am very frustrated with Spartan and this whole issue and would like to discuss and open a formal complaint.

      We are working with the homeowner directly on a solution to solve the siding flashing that the siding issue caused to rot out, and providing advice on how the stucco contractor can rectify the other incorrectly done stucco work, to ensure the siding to roof metal does not rot out across the entire home causing problems in the future. We are hopeful the stucco contractor does not keep trying to shift the blame to us, and rather work with us toward a solution to solving the homes' issue.

      I am rejecting this response because: I am currently waiting for the Stucco guy to return from vacation. He is away thru 04-11-23. At that time I plan to discuss the conversation I had with Spartan.

      I still feel very strongly that my issue is due to work done by Spartan to “correct “ the problem, also that work was done substandard and not authorized or approved by me- the homeowner.

      I also still feel it was very shady for Spartan to acknowledge the “problem “ then attempt to “fix “ the problem multiple times. It wasn’t until the 5th time out and patch attempts that they then stated it was Stucco issue. 
      I will work on a solution with both parties but again still feel very strongly about errors/issues that have been caused by Spartan and their “guys” trying to fix the problem.

      The customer is rejecting the response because she is waiting on a 3rd party. Our statement remains the same, and if she is rejecting our statement she is rejecting us fixing the problem (which wasn’t caused by us), which is confusing.

      We are not entirely sure how to proceed but have emailed the customer multiple times to push this forward, and are awaiting her response on when we can meet the stucco guy. ALL of the siding metal on this home will be rusted through prematurely if the stucco contractor does not fix the shoddy work he did.

      I am rejecting this response because: They have not contacted me multiple times- just received 1 email asking me to sign legal documents- now I’m being forced to sign something legal because I would not close case with BBB. I am waiting for the Stucco guy to come and do their part of plans we discussed- I’m told by them this should this happen next week. Again now I’m being forced to sign a legal document because I wouldn’t close BBB case- in order for Spartin to do the work we discussed. I was not asked to sign this document when we discussed work flow plans- it was presented to me via email when Spartin learned that I was not closing my case with BBB. I feel like I’m being retaliated against because I opened this claim and will not close it until after work is done.I’m not comfortable signing anything legal and I’m not closing any cases until my work is completed. I have supporting emails if needed.
