      On January 2, 2024 we entered into a financial agreement with Cash French with ******** Waterscapes for a 2-3 day waterfall feature repair and upgrade project in our yard. We agreed to pay a $500 cash deposit and an additional $4,000 cash payment on the start date of the job (on January 2.) We then agreed that THE REST TO BE PAID WHEN THE *** WAS COMPLETED (balance remainder of $4,000).On Thursday, January 4, 2024, the waterfall was running and a crew was here at the house working on the project. **** told me that he had to leave for an out-of-town trip for a pickle ball event that weekend. He requested that the final cash payment be made to him before he left for his trip, with the understanding that the crew would finish the project that day. Against my better judgement and because I felt I could trust his word, I paid him the final payment of $4,000 in cash and he left at about noon that day. Shortly after his departure, his crew packed up and left, and the project has remained unfinished since that date. At this point, the project is incomplete with significant leaks and structural issues. We raised our concerns to Cash immediately in a number of phone calls and texts between January 6-25th. On January 25, 2024 Cash finally came to our house in person and together we discussed the items that remained unfinished. With his concurrence, we formulated a TO-DO list. Here is the list of items we agreed remained to be completed:1.Locate and repair all leaks 2.Shave back all exposed foam 3.Tuck all exposed black tarp 4.Tuck all exposed chicken wire 5.Cover all foam/black tarp/chicken wire with rock for natural look 6.Upper right fall spillway is slipping down, readjust and stabilize 7.Upper right fall is not as full as it was prior to first leak adjustment-adjust water flow on that side (install ball valve?)8.Adjust rocks on outer bottom/front lip (where waterfall meets grass) as it is blocking the view of the lower waterfall 9.Cover cinder blocks and plastic parts of waterfall for more natural look 10.Replace succulent/greenery/vegetation for more balanced look on right side of waterfall 11.Clarify annual service and warranty that you offered in writing 12.Fill in hole behind waterfall and fill with mulch (dirt was used in the waterfall)13.**************** lighting back under rocks (in front of waterfall)14.Stabilize ***** area on the right side, rocks have started slipping Since that meeting on January 25th, only one of the above items has been completed. We tried to work with **** in good faith, with patience and understanding, and have communicated multiple times via text, by phone, and also in person. We have allowed ample time for this two-three day project and To-Do list to be completed. It has been 67 days since the start of this job. It is clear to us that it is not a priority for Cash and that he is, for whatever reason, unable and/or unwilling to complete our project. We sent multiple emails, texts, and a registered letter requesting that he complete the project and/or give us our money back and he has ignored our request and has kept stringing us along with a multitude of excuses and reasons for his lack of follow through. He has not completed the project, offered a reasonable timeline, or schedule for completion, nor has he refunded our money as we requested.RING Camera Video footage and iPhone camera footage can be provide to corroborate my timeline, verbal agreement, damage done to the yard, and state of the completed waterfall feature.
