On March 2, 2022 I purchased a sapphire and diamond necklace from this business through their website. They shipped the item March 4, 2022 with tracking. Their website clearly indicates they provide "insured shipping" for items over $100. This item was just shy of $500. The item was marked by **** as signed and delivered afe few days later, however, myself nor my partner (to whom it was addressed) were even home nor did we sign or receive anything. I checked with neighbors and ****. They advised to file a claim since the item was supposedly insured. I attempted to file a claim and it turns out D&D Jewlery did not actually insure the item, as they advertised they would in plain and public view on their website. My partner and I have sought resolution for 2 days through email and telephone and D&D does not respond to emails, and on the phone today indicated since it was signed by someone it "doesn't matter if it was insured or not. It is out of our hands." Therefore this complaint against D&D is for false advertising and unethical business practices as well as to recoup our lost costs. We spent roughly $490 on the necklace and have no item with D&D washing their hands of the situation. This situation would have an easy resolution through the **** had D&D not lied and failed to uphold their advertised promises of insured shipping.Business response

Thanks for the opportunity to further explain.
**** tracking website for the customer's package (with tracking# *************************** - see the attached shipping label) provides the following information (see the attached screenshot file):
"Delivered, left with individual"
"March 10, 2022 at 11:41am"
"*******, ** 66043"
The **** "proof of delivery" document (see the attached pdf document) clearly shows the "recipient's name: *********************", along with the recipient's signature indicating that the package was delivered and received by the individual. According to the **** there is no indication that the package was lost, or received by anyone else except the intended recipient, which is *********************. We trust that the **** postman (delivery carrier) would not risk his/her carrier to commit fraud and forge the recipient's signature. Customer was not charge for standard shipping from the beginning, i.e., shipping was free to the customer), and as far as **** is concerned, the package was indeed delivered as intended and signed for.

I am rejecting this response because:
This response does not address the xomplaint against D&D's false advertising, unethical business practices, and failure to respond to my or my partner ************************* messages and calls. He did not sign for or receive the package and nor did I. For D&D to ignore that they failed to insure the package as advertised and simply say we "trust" **** did not sign for it is absurd and agains ignores the complaint against them. I am not asking them to answer for ****. They are failing to address this complaint.

We appreciate customer's response. In contrast to what was mentioned, we did actually respond to the customer's inquiry via phone explaining the exact same thing already mentioned in our earlier message in this platform. Once again, shipping was free to the customer and thus at our discretion. Even though **** indicates the package as delivered and signed for by the recipient, the customer can take this up with **** if the argument can somehow be validated; and the case has nothing to do with insurance and everything to do with the postman committing the fraudulent act of signing for the recipient or stealing the package. If the package was lost, we would certainly be able to help you, however **** records indicate otherwise, so regretfully there is nothing more we can do for you in this case.

I am rejecting this response because:
Insured shipping is advertised by the business in plain and public view on their website for purchases over $100. My purchase of almost $500 value clearly falls within the category of free insured shipping. Therefore, whether or not to insure the package is not at their "discretion" as they say because they advertise it as included. Had the business upheld their advertised insured shipping promise I would be able to file a claim with the *********** as they suggest I do. However, since the business did not do so and therefore their false advertising contributed to this situation, I am left with no options to remedy this situation with the ***********. Whether or not D&D Jewelry wants to acknowledge it, this case is indeed very much about their failure to send the necklace we purchased via insured shipping as they advertise on their website. Lastly, what they wrote about the phone call is not accurate. I spoke with someone at the jewelry store over the phone who indicated he could not really speak about the matter and that he would have a manager or the owner contact me. This was days ago and I have never gotten that call back.
