      START/END DATE: 6/12 - 6/15/23, one defect repair service call 8/18/23 COST: $6000 PROJECT: Demolish existing composite deck and pour a stamped concrete patio.DISPUTE: 1) They left very light but visible shoe prints and other blemishes on the concrete surface and laid down the sealant over them. 2) They didn't make the patio slab surface level with the house foundation, which means water will run toward the stairs, and likely gather there near the house foundation, instead of toward the side of the patio where it should drain. 3) They didn't wrap one of the stairs from left to right, all the way around, to join the house trim, despite the fact I gave them a drawing; instead there's a cavity on both sides and they used brown wood boards to cover. 4) They cut some joints outside of the slab's surface grooves. 5) They left pieces of the composite deck they demo'd attached to the house. 6) The turf they pulled up during the work wasn't properly reinstalled. 7) They didn't cover my house near the bottom so when they poured concrete and sprayed the surface, there's concrete and overspray on my house. 8) They gouged my screen door.BUSINESS' RESPONSE: Corrected defects 5 and 6 but refused to correct the other defects.

      We have done everything that is in our hands to make you happy, for the price point that we gave you, this is all we can do, including the discount that you ask us to gave you.

      we also ask you at the beginning of project if deck was attached to house, you said it wasn't attached, and it was attached to house and it took us more labor hours to detached deck from house with out any payment.

      the contract says, removal of old deck, ( The deck demolition ($1500) includes hauling all deck material away.)  we did demo deck, and also some concrete steps on bottom of deck that wasn't included in the contract, that took us more labor hours with out payment. 

      the payment schedule clearly says that last payments is until we finish project. that means that customer was able to see project when finish. 

      also, customer have more complaints every time we message about this. 

      the only thing that we can take care is replacing the old screen from his sliding door or give money for repairs.

      I don't see any clear instruction from the BBB on how to request this issue be reopened so I am using this to communicate that the matter has not been resolved. Did the business respond to your inquiry about this issue?

        1. No, you haven't. Your crew put shoe prints and other scuff marks on the cement before it was dry or right after the sealant was applied. They are very visible. This is not acceptable in any case. You cannot expect any customer to accept this kind of poor workmanship and defect. This is an obvious contractual obligation and defect that needs to be fixed.

        1. I did not install the deck; it came with the house when I purchased it. When you and I looked at the deck together, neither of us suspected the deck was attached. You also went underneath the deck to perform your estimate investigation. You are the professional, not me. You could have easily brought a flashlight and equipment and performed a better investigation for your estimate. Also, you did not stipulate in the contract that if the deck is attached that it would cost extra to detach it. A copy of the contract is attached here.

        1. Whatever work you did that you did not include in the estimate and contract, and that you did not stipulate extra payment for, is your responsibility, not mine. You are the professional and I gave you every opportunity during your initial visit to inspect and investigate the job before you created an estimate. You should have taken more time to investigate and you should have created a better estimate with line items. The fact that your estimate was sloppy, lacked detail, and low is your responsibility, not mine.

        1. I told you when I paid you that I was not satisfied and that I expected you to come back to fix the turf, remove the small deck pieces from the house, and fix the shoe prints and scuffs. You did come back to do the first two fixes, but not the third or any of the others that I complained about in this complaint. The fact that the customer made the last payment does not preclude the customer from taking subsequent action on the failure of the contractor to meet the contract obligations and standard acceptable workmanship expectations. I could have played hardball and withheld final payment to force you to make all fixes, but I did not.

        1. Yes, you need to repair/replace the screen. I specifically wrote a provision in the contract for repairing/replacing damage caused by your crew. When can that be done?

      I am rejecting this response because: replacing the screen is not the only defect that requires correction. The shoe prints and the incomplete pour of the stairs, which left a large space on both sides of the stairs leading into the cavity behind the stairs and between the stairs and the house, needs to be corrected (properly covered **) in some way.
