This company completed the work and failed to use product as agreed in contact in addition the work was done without a valid permit and not completed to code. The owner, Edgar then agreed to return funds for the cost of the job however, only under the condition that i sing a document that I not post any negative reviews or discuss my terrible experience on social media. He then refused to pay funds adding that he needed to speak to the inspectors; once this was completed, he then informed me he would not be returning any of my funds and that I could go through his insurance to file a claim. I am in serious distress over this matter and simply want the issue resolved so that I can get a new roof completed legally and to code.Business response

To whom it may concern,
I Edgar Pesantez owner of Pesantez Roofing LLC as company full of values and integrity were trying to get the issue resolve as soon as we got the call from the customer. *** was placed instead of *** as Stated in the contract Project Manager failed to follow procedure, I personally offered the customer a discount for a disclosed amount which Customer and I agreed. As we all know mistakes happens unfortunately The Company Project Manager failed to follow procedures to apply the SEAM TAPE in the seams of plywood, now we do offer an apologize again. I personally offer to get the issue resolve by replacing the entire roof at no cost to the customer or second option of accepting a refund as well for the total cost of the Roof under one condition that she do not jeopardize our Company reputation in any bad way or any social media which she then went and add in written form that she will sign agreement under one condition of her own regarding the permits to another property which had nothing to do with this job. Permits were not approved at first because the property wasnt under the customers name at the time of the project. Customer resolve the issue and permits were approved after. Customer acted way to fast and didn't gave the company the time to gets this issue resolved as quick as possible. We are a growing company and due to high volume of work we couldn't resolve it as fast as customer wanted to. Which then customer again went on to our insurance and also filed a claim against the company even with the company being responsible and working on getting the issue resolve but the customer again didnt give us the necessarily time to resolve the issue. I personally look forward for this issue to gets resolve in a fair agreement with both parties.Sincerely

I am rejecting this response because:
I am writing this in response to the message received by Edgar of Pesantez Roofing.
I would like to note that the contract issued stated new plywood would be installed for the entire roof. *** was placed at Edgar and his project managers discretion. This was not an error or mistake as he called it on the part of Edgar or his staff.
They knowingly used *** without my consent or informing me that such a product was going to be used. *** is a cheaper and less quality product. The ONLY reason I was made aware that plywood as stated in the contract was not used is because my 75yr old father went to the house and observed the work being done and contacted me immediately. In addition when my elderly father approached workers about the *** they attempted to say my father did not know what he was talking about.
At no point did Edgar or his staff inform me of any changes to my contract to use *** instead.
If I had not brought the use of *** to Edgar attention he would have charged me the original amount due in the contract with me believing that plywood had been used as I requested.
This is not what I would consider to be the practice of what he calls a company full of values and integrity. It was a decision made by him to blatantly deceive me in hopes that I would not know the difference or be aware of his corner cutting methods.
Needless to say he was paid in full upon completion in April. It was not until I received violations from the city that I was made aware that Edgar had not pulled permits as required and his workers were stopped by the inspectors and he still failed to do his due diligence to address the matter.
As for not being provided with sufficient time to resolve the matter I have text records as well as phone records showing the countless calls and text that were sent to Edgar asking him to address a variety of issues that were improperly done with the roof and gutters.
I was left with no other option than to file a formal complaint with the ****** ******** ******* ** **, to assist me with this matter. Once the complaint was filed Edgar finally reached out to make required repairs. When I requested images to verify the work was done to code he continually agreed to send and failed to follow through. He eventually came out to the property on July 11,2023 4 MONTHS after he has been paid only to go on the roof to see that none of the work was done to code in addition to the *** and lack of taped seams.
I will acknowledge that Edgar was apologetic however after such deceitful practices and having to chase him and file a formal complaint to get him to just come out to the property was reason enough as to why I would not want him to make any repairs or replacement to the damage and stress he has already caused me this far. As for the promise to pay with his request that I not discuss my terrible experience online. I did in fact add the note that I wanted the other property inspection closed as well before I would consider signing or accepting anything from Edgar bc just as he had done with this location he also failed to pull the permit for the other location again despite being stopped by the city when he was on site. So this is a clear demonstration of sneaky underhanded tactics in hopes that helpless homeowners are none the wiser to his outright poor, unethical work practices.
I have all documents verifying his violations from the city, the contracts, images and timelines of all the efforts made to reach him prior to this or any other complaint.
I contacted his Insruance because during our last phone communication Edgar told me “ He was no longer willing to refund my payment and that anything that happens moving forward would be under his terms.” I simply want my new roof cost covered in full by a truly reputable and well known company that has an outstanding record with the city and have been kind enough to rush the proposal through. If Edgar wants to pay the new cost of the roof for approx 21thousand. I will withdraw the complaint with his Insruance.

Good evening, I agreed to meet with Edgar today after he agreed to have another company replace the faulty work he completed. However today he again returned to his deceitful behaviors and said he did not have anyone to perform the work however he wanted me to allow him to again perform the work however I would need to pay him for the proper installation of the proper material.
This was absolutely astonishing to me that he would think I would have any confidence in his work and in addition I would need to pay him more.
I am suffering from extreme anxiety as a result of this matter and simply want the funds I paid him returned so I can close out this matter and move on. The quote I have for the roof is almost 2x as much but if that’s what I have to pay for a reputable company to do the work so be it.
I do not want him contacting me or coming to my property moving forward.
I simply want my money back for the what he failed to do legally and to code.I implore you to instructed Edgar to pay for his faulty work and put an end to this now.
I have video footage of Edgar during this discussion where he make elusive threats of people “ being bigger and badder” than us and asking if I believe in God.
please let me know if I should contact local law enforcement.
I am now fearful and concerned for my safety.
