      This is about hiring a pond contractor Oasis Ponds to build my front pond feature, and the entire project has been manhandled, while the contractor has been using drugs, losing balance, and passing out on the property and having an extremely angry disposition and fighting with others that work on the property and sending text messages of threatening nature and totally out of line. We have already paid ****** and have spent over $50,000 so far that includes paying for every material that is on the job site and have a complaint with the sheriff for items that he stole on Jul 11 th, had a loud dispute because his feelings were hurt , I cannot allow them back on the property although the people that work for him were begging and pleading and trying to apologize for his bad actions because we did a background search on ********************* and understand that he has a history and does not even have a drivers license and is on the recovery program. I made the error of judgment with how he spoke to me in the beginning and got into doing business with this company. His dad would drive him every day to work and he had two people working for him namely **** and ********, who are a couple who gave us to understand that they were not his employees in business terms because he did not pay them for this job and lied to them the whole time and they did not have any form of insurance and **** was operating all the equipment without a license and if anybody got hurt on my property, the entire liability would have been on me . I have proof of all the payments made and the way he writes messages and audio recordings and any proof that you might need to understand further about this case because I have a limitation on how much I can write about this complaint here. You can email me anytime or call me on ************. I can provide you detailed description of anything you might need with proof. I really hope you can help me out with this ordeal that Im going through. Thank you so much.

      Business response

      Please see attached response:

      Thank you kindly for the notification ofthis complaint made by a former client of mine.

      Due to the unfortunate circumstances surrounding this business agreement, I retained the services of my attorney. Please see the letter below that outlines our response and pertinent details of the events.

      Oasis Pond LLC (Oasis) and ************************* (****************) in connection with the aforementioned complaint (the Complaint) made by ************************* (the Client) regarding pond construction service provided at ********************************************************************************* (Project Location). We appreciate your diligence in addressing customer concerns and fostering fair business practices.

      It is first worth noting that Oasis team maintains a strong commitment to ensuring a safe, respectful, and collaborative work environment. Oasis also takes pride in its commitment to customer satisfaction and transparency in all its dealings. However, this project was not without challenges stemming from the Clients own behavior and actions.

      On or around April 26, 2023, the Client engaged Oasis to repair damages on an existing pond at the Project Location in preparation for an event occurring on the premises. On or around April 28, 2023, while visiting the Project Location to analyze and discuss the work that was required, the Client engaged Oasis for a second phase ofthe project which involved removing the pond that was in place and for Oasis to build a larger pond. On that same day, during a conversation with ****************, the Client verbally agreed to the following tenns that were subsequently memorialized in the invoices and multiple text communications:

      1. Oasis would purchase supplies for the project for which the Client would reimburse Oasis;

      2. For some supplies the Client would pay upfront and Oasis would source said supplies;

      3. The Client would also purchase some supplies using her business credit card; and

      4. The Client would cover all expenses Oasis incurred for the Project, including but not limited to fuel for heavy machinery used for the Project, food/water for work team at the Project Location and travel expenses such as tolls and fuel for work vehicle as the Oasis team lived at least 92 miles round trip from the Project Location.

      The construction work was commenced and executed in accordance with the agreed-upon terms and schedule. At no point before or after the completion of the first phase of the Project did the Client object to the terms. Oasis completed the first phase of the Project under those same terms and commenced the second phase under the same. Furthermore, during the entirety of the time on site, **************** has been in communication with the Client and her representative regarding the progress of the project, materials needed and requested several times for payment of expenses already incurred.

      From the beginning of the first phase of the project in April 2023 until June 2023, the Client made several payments under the agreed terms with no objection. However, after being provided with an invoice in July 2023, the Client refused to honor the agreement, creating further complications in Oasis attempts to reach a resolution. On or about July 11, 2023, while at the Project Location, Oasis again attempted to collect what was rightfully owed to it. However, the Client escalated the situation and threatened to contact law enforcement for the Oasis staff. Furthermore, throughout the course of the project, the Client repeatedly utilized tools without permission, which posed safety risks to herself, the outside employees she hired and Oasis workers. Moreover, the Client engaged in inappropriate and offensive sexual comments directed towards Oasis workers, creating an uncomfortable and unprofessional environment on the worksite. Despite Oasis continued efforts to communicate, address and resolve these issues, the Client ultimately refused to make the agreed-upon payment for the services rendered. Even more troubling, it was brought to Oasis attention that the Client have been contacting and intend to contact Oasis current contractors, other business partners, and clients to interfere with their existing business relationships. The Client has elected to cause substantial harm to Oasis reputation, eroding trust with their contractors, business partners, clients and disrupting Oasis ability to conduct business efficiently. Instead of paying what is owed, the Client has chosen to make these baseless claims to harm Oasis business operations and relationships.

      Oasis aim is to resolve this situation amicably and in a manner that is fair to all parties involved. Oasis remains open to providing any necessary documentation, records, or communication logs to support its stance on this matter. Oasis believes that open communication, compromise, and mediation are key to resolving this unfortunate situation.

      Please let us know ifthere are any specific steps, we should take to address this complaint further. We value your role in promoting a fair and just business environment and appreciate your assistance in this matter.
