      Hired *********************** (KJH) to replace roof in 2021; roof started leaking soon after.Ceiling under roof was damaged by leak and removed; discovered ***** didn't change out rotten/damaged wood like we agreed.They nailed new **************** into rotten wood. Discovered b/c they also messed up sealing roof, which caused leak, which caused ceiling drywall to come down.***** claims he couldn't see the damaged wood. Pictures show they replaced ******* on top of damaged/rotten joists & sistered new wood into some of the damaged joists; how did they not see them?I saw puddles of water on new roof, which were a result of the sagging ceiling joists that were damaged. If ***** had repaired/replaced the damaged wood, roof would not have been sagging like that.I told ***** part of the roof needed to be re-done but he refused. ***** later agreed to fix by adding a layer on flat roof to elevate part of it and by replacing/sistering joists by taking down ceiling drywall.I now had to get another contractor and pay for new drywall & paint.***** sent me invoice to fix his own mistakes for $3,499. I told ************ would not pay for his mistakes but paid him for the additional wood/labor for the joists after waiting WEEKS for them to return; $1,260 (168 linear ft. at $7.50, original agreed rate).I NEVER signed contract for the $3,499 invoice.I waited weeks for him to fix it because he includes a workmanship warranty which I expected him to honor.When refinancing, ***** lied to title *** and told them I owed money and sent the $3,499 invoice to close out the permit - didn't even subtract the $1,260 I paid and he agreed to.Too late to stop closing due to other factors, ***** was notified in advance that he was getting paid by title *** in protest per my text msgs to him.**** ***** deadline of 10/31/22 to refund the $3,499 he stole and he told me to *** him and denied even removing the ceiling; I have pictures and other contractors as witnesses.I want ***** to refund me the $3,499

      There will be no refund. If you look at the the final invoice **** doc, you'll see that he paid extra because of lumber replaced in October. This is all the lumber that we could see from on top of the roof. When he removed his ceiling, he found lumber that needed to be replaced from termite damage that you couldn't see earlier. When he wanted to other lumber replaced we billed him for that as well as the cricket that was never in the initial contract. You can clearly see that we billed him for the extras in December, almost 2 months from the other bills. That is EXACTLY where the $3,499.00 came from.

      I am rejecting this response because: Contractor is clearly lying, the pictures clearly show they placed NEW plywood over damaged wood which means they could see the damaged wood since the ceiling joists and header were revealed when they removed the old plywood. The ceiling joists that they added were also nailed directly to the damaged/rotten wood seen in the pictures and videos - how could they not have seen the damaged/rotten wood? The pictures and videos are dated after they finished the roof job initially, but before they came back to make repairs.

      The reason he billed 2 months later for the cricket is because it took them weeks to finally come back and repair their own mistakes and then weeks to do the work. ***** includes a 10-year warranty you can see on the original contract. Otherwise, why would I wait weeks for the same contractor? I would've hired someone more competent if I was going to pay for the repairs. Why would I pay extra for ***** to repair his own mistakes?The only reason the cricket was necessary is because they didn't replace the damaged wood they were supposed to in the first place, which they could clearly see since they nailed new wood to the damaged wood seen in the pictures and videos. The new roof they installed was sagging in areas, water puddling, and ***** refused to do the right thing and fix it from the top. The roof would not have been sagging like that if they had changed out the rotten/damaged wood like they were supposed to. Instead, they just nailed new wood to rotten/damaged wood - dangerous and ridiculous.

      Some of the ceiling had to be taken down already due to being damaged by water due to *****'s poor craftsmanship that caused a roof leak days after the new roof was put on so I agreed to let ***** repair from the bottom (ceiling side) and add a layer (cricket) on top to help the puddling. I never signed a contract for this or for any cricket. I later wrote ***** a check for $1,260, which he accepted (see attachment for proof from bank). This check was for the lumber + labor when they had to come back to fix their own mistakes as that's lumber + labor I would've paid for had they done the job correctly in the first place.

      In the invoice for the $3,499 he stole from me, you'll see that he charges me again for the lumber/labor that I paid him an extra $1,260 for. This is just another example of how dishonest ***** is. He accepted this check and then didn't even acknowledge this in his response to the BBB and didn't even subtract it from the $3,499 invoice he sent to my title company to close out the permit as it was for the same subject repair. You will see there is no invoice for $1,260. This check was just me honoring the original agreement, which is what I expected ***** to do when he and his crew messed up my roof, which caused the water leak, which caused the ceiling to HAVE to come down, which resulted in the discovery that he and his crew didn't change out the rotten/damaged wood like they were supposed to, which resulted in the sagging roof and another layer/cricket being necessary so water doesn't puddle and pool.


      I expect this contractor to do the right thing and refund me the $3,499 he stole from me. I didnt even ask ***** to pay for the ceiling drywall and paint expenses I incurred plus weeks of delays he caused me due to the damage his poor craftmanship caused, but he should be paying for that too. If BBB would like, I can provide the names and contact info for licensed contractors who were on the job site during this time period and witnessed the poor craftsmanship of ***** and his crew and how they nailed new wood to rotten/damaged wood, the roof sagging as a result, and water leak and subsequent ceiling damage caused.

      We are not arguing back and forth. These payments were for extra supplies and work done on his roof. This is the last respond regarding this issue. Thank you.
