Your items went out on the floor on November 11 of 2023. It is for a 60 day consignment. As your contract states and the paper states the same information that you were given when you drop off items. It is your responsibility to check back for your actual pick up date if you were saving your items. And Saturdays are always pick **** Your items expired January 10 of 2024. We held your items until February 1, 24. Making sure everyone had a full 60 days of their items on the floor. You and your daughter came in in March demanding your stuff. Your daughter has been harassing me for days on and on ******** as well as ****** and yelp! We have had to report with ******** to get her taken off of there because of the slander and harassment on my personal pages let alone my business pages.

I entered into a consignment agreement with Ditto Consignment on October 4, 2022. I had 60 days for the items to sell and had to pick up items up on a Saturday (my sixty days expired on 12/3). Since I was going to be out of state the weekend of December 2, 2022, I went in earlier in the week to see how I had fared. I had initially brought in 6 designer handbags (Coach, *********************, *********************** (2), ****** ***** and ***** ****** brands. I had been paid for one of the bags. The employee working that day, informed no other bags had sold but informed that the owner had been behind and the items didn't get out on the floor right away so she would extend the date of pick up. I explained that I could not return on Jan 2 as I was again going to be traveling out of town so she told me to return on Jan 18, 2023. She took a piece of white paper and handwrote a note she said she was going to leave for the owner. Since two of the handbags were out of season, we decided I would take two of the bags and leave the remaining bags. When I returned to the store on Jan 18th, the owner was working, I explained my conversation with her employee and she told me I was out of luck as she goes strictly by the contract. I asked if we could get her employee on the phone as I was sure she could clear things up she said she was on vacation so she was unable. She also said that her employee had no business telling me that and that she was "not responsible for her employee and what her employee represented to me." I explained that I left the handbags because of what her employee represented to me and she said it did not matter and asked me to leave the store which I did. She did allow me to take one of the handbags that I found in the store with me. I did not get compensated for two handbags nor was I able to retrieve them. A woman who sells jewelry in the store was a witness to the entire interaction.

Hello. As I explained to the customer when they were in the store. Ive used the exact same contract for 12 years. Now we have ****+ consigners. The rules are the same for everyone. I have everything written down step-by-step a stranger could come in and completely run the entire store. As to what to say to the customers. We have a 60 day consignment. Your consignment ended 12/18/23. You came in 1/18/24. You said my employee told me we would keep them for another month. Because you didnt want to take all of them. Because they were out of season? We dont even do anything like that. We take all seasons all year round because we have so many travelers from all over. And even the case may be its still 60 day consignment we go by tag color. It doesnt even make sense to have you come in 30 days later when that wouldnt even be the correct tag color. All the complaints through here always because the consigner is mad because they didnt follow their contract. On the paper it states its an estimated date and its their responsibility to stop in to get the actual pick up date. And its always 60 days from the time it gets in the system and priced and tagged and put on the floor. As when the 60 days begins. And then Ill pick *** are always on Saturdays no matter what because that gives us that whole week to pull that tie color and put it in the back for consigners to fine. She stated she came in in December and picked up purses. Why wouldnt she have taken all of them the purses that were in there were so easy to find. We go through and pull by tag color when its expired, I can send you a copy of her signed contract, as well as the paper that everyone gets when they drop something off that states all of this. If consigners would only read the instructions and follow the instructions, everything would be dandy.

I am rejecting this response because:  I am not disputing the original contract.  But I was informed by her employee to leave the items for another month.  Why would I have left two items and have to make another trip to pick them up if I did not believe what her employee represented to me. I had a verbal agreement  with her employer (which I trusted) that  extended to January 18, **** which on that date I returned to the store

Per my initial complaint I arrived at the store prior to my 60 days as I was going to be out of town.   The proper response from her employee at that time should have  been take all items now as we abide strictly to the contract!    That is not what was communicated to me (as outlined in my original complaint) and I trusted her employee and what she communicated to me.

      Sincerely,

      *****************************

Our consignment is for 60 days as the contract states that you signed. We do not do an extra bonus 30 days for anyone, with ****+ consignors. There is not time where weve extended it for 30 days in 12 years. Its a 60 day consignment for everyone not just one person because they decided they were going on vacation. You came in the store and picked up two of your items which you shouldve picked up all of them if you wanted them back. To reconsign it would have to be put back through the system for another 60 days because we do a 60 day consignment. Not a 30 day consignment. The contract that you signed as well as the paper you received when you drop your items off specifically says this so there is no confusion. We follow our contract that we have used for 12 years.

I am rejecting this response because: your employee suggested to me to extend the consignment date to January 18, **** and I trusted your employees word.  I have no knowledge of your stores history or business practices as I moved to ******* in September 2023.  I had no reason to not trust the word of your employee and I believed I had an agreement.  I have always acted in good faith.

      Sincerely,

      Complaint: 21188396

I am rejecting this response because:
I did want to clarify the time frame as it came to my attention that I erroneously stated the dates (specifically the year) when filing my initial complaint.   Our agreement began on 10/4/2023 so all dates referenced should be in the year 2023 except for the January 18, **** date

In addition I would just like to state that i acted in good faith and believe that I had a reasonable expectation to believe what the employee from Ditto consignment communicated to me thus my return to the business on January 18, ****

      Sincerely,

I am attaching the contract that was signed. The Agreement was signed Oct 4, 2023. Items started the 60 day process on Oct 19th. All items expire on Saturdays. Some items will go the next week depending on the end dates, as we go by tag color. We would NEVER had extended it an extra 30 days. That would make it 90 days and completely throw the entire tagging system off. We only have 8 different tag colors for the 60 days.

      Complaint: 21188396

I am rejecting this response because:  as I stated in my initial complaint, an employee of Ditto consignment extended the contract to January 18, ****.   The contract was modified when an employee, who represents Ditto, made a verbal agreement with me to extend the date to January 18, ****.  I also outlined in my initial complaint that you stated to me I am not responsible for my employees.   I contend that as the owner of a business you absolutely are responsible for what they represent to your customers.

      Sincerely,
