I passed the DJI Agricultural online exam. I called HSE enquiring if they ran the practical part towards certification. Ron H***** informed me they have contract work with ** ***** ***** in Belle Glade and would love to have me with my drone experience onboard with them to fly under their FAA part 137. Ron H***** and the Owner Bryan S****** on a conference call said they would put on a ‘special circumstance’ training class to attend the following Wednesday. I was told I would earn their course fee back with contract work for them. I went to have an interview and practical drone flight training / test. Upon arrival I found out the owner and a new hire product demonstrator were in attendance to go over the over 55pound drones and 2 farmers from Iowa were there to pur***** a drone undecided what product to buy. There was no meeting between me and the owner until I initiated it after listening to the local demonstrator simply talk about nomenclature of drones which was really a product overview to sell a very expensive drone to the farmers. I called Ron and informed the owner my time and money had been wasted and requested a refund. The President eventually refunded me half the fee but the bank I paid the fee through requested the balance. HSE never provided a reason to the bank why they wouldn’t reimburse me so my credit card company credited me with a refund. Bryan, the President of this sham company filed with a debt collection agency rather than dispute the banks ruling. This is a disgrace to business owners in industry. The company have used their FAA part 137 to falsely gain monies from me. They not only stated falsehoods to gain money but have attempted to destroy my name, company (**** ****** ********** and credit with instructing nexumgroupinc to destroy me and my company for a determination made by the bank. Brian S****** the President of HSE responsible for this is a former bank manager who has malicious intent in doing this to me

This customer purchased our 2 days training class on our website. When he purchased, he accepted the Terms & Conditions along with the Class Cancellation Policy. We were and still are partnering with independent contractors to provide services to our clients, but this was never guaranteed or even implied- especially for someone who has never operated a large agriculture drone. Any person who wants to become a professional drone pilot needs to gain practical, hands-on training and that is the point of this class. What happened is that this person received an unrelated job offer and left half-way through class and then wanted his money back. Contractually, he purchased a service from us, we provided it and he left half-way through. Specifically, at about 9am on the 2nd day of class, ***** informed us that he had a job opportunity come up for that day and he was going to skip the 2nd day and go do the job. As a courtesy, I offered for him the chance to come back and take the 2nd day of training during another class. On Mar 28, ***** emailed us saying he was upset about the class content. As a COURTESY, we processed a partial refund of $531.97 (half of his tuition + tax), he got an email confirmation of the refund from Shopify (our e-commerce platform) on March 29. This refund goes beyond our listed terms & conditions and policies, but we had heart for him needing money and work. But him choosing to quit half way through a class to go take a job is in no way our fault nor did we fail to deliver what we promised or what he paid for.
After having processed a partial courtesy refund, he disputed the full amount through his bank. On April 9th, his bank debited $1078.94 from our account (so we were then out an additional $531.97 than he ever paid in the first place). We responded to the chargeback claim within the allowed time and it was submitted to his bank - we provided screenshots of the terms & conditions and his registration form along with an explanation. On May 23rd his bank resolved it in his favor (as they generally do), and Shopify informed us that there isn't a way to appeal his bank's decision and I should consult an attorney. That same day, I informed ***** that his invoice was now past-due (because of the chargeback) and I offered 15 days for him to submit an alternative form of payment and informed him that if he didn't, we would send the account to collections. His reply was that it was between us and *his* bank and I would need to cancel the chargeback with them... that's not how it works. He is the purchaser and it is his responsibility to pay for the services he buys - not our job to go track down his money. We actually gave him extra time to submit the payment turning it over to a collections agency (per the legal solution provided to us by the state of FL), on June 15th.

I have attached screenshots of the terms and conditions, both email threads and the Chargeback case.
Although not lawfully relevant, we had great concerns within the first hour of his attending the class -which is why I didn't make an attempt to "meet privately with him"... he acted erratic, continually interrupting the class and on-going mysterious trips to his car returning often with a runny nose... the other clients there actually commented about how strange he was behaving. Further, on his last day with us, he picked a (verbal) fight with an elderly veteran gentleman at our training field. Even with all of that, my company worked hard to be thoughtful, considerate and generous in our resolution. But pushed into a corner, we have to respond. Thank you for your time and sorry you are involved in this drama.

      Complaint* ********

I am rejecting this response because I was advised by ***** bank to file this complaint since HSE put a debt collection agency onto the refund made by them after their investigation in this matter. Furthermore the libelous comments made at the end of their response to you are complete falsehoods, unjust and totally untrue!

      Sincerely,

      ***** ******
