Escrow Deposit was Wired to Celebration Title Group On July 2 2022 , as Required by the Builder Agent , on The Land That The Builder had located *********************************************** , Went under Contract land contract on July 2 2022, For $324,900 and Then Received a Loan Estimate in amount of $ 374,733 .on a FHA Construction Loan That was not approved for that amount , when I questioned This, I was Told by the Loan Originator That These Were Additional Fees And She could not change , under the circumstance I ask That this Contract be Cancelled it exceeded the amount of the signed contract. Which was Agreed upon By self And Builder , I sent a Copy of the Cancellation Agreement to Celebration Title Group ,I was in Contact with Samantha A******* , I was Told by Samantha A******* She could longer assist Me regarding this Matter, The Lender **** Mortgage and The Builder Ultra Modern Homes Breached this Contact , after Sending Celebration Title Company all Required Documents of The Cancelation of this Contract Between Builder and Land Seller and Myself ,They Have Not returned my Earnest Money as Agreed, My Bank has Sent a Letter That Clearly States The Account this Money was Wired into . No Response From This Company , They Will Not Return My Calls or respond to my Emails ,Business response

Business Response /* (1000, 5, 2022/08/31) */ -Escrow Dispute has been recorded in our file. -We have two cancelations in file( a blank one and another signed by buyer only) -No fully executed cancelation in file and have been trying to obtain. -There is a 50/50 disbursement cancelation signed by seller however we don't have a copy. Seller is not agreeing to 100% escrow disbursement to buyer, buyer wishes to have 100% of their escrow returned to them. -Buyer's agent has been unresponsive for the most part. -Sammie has been on top of this matter and doing her due diligence but our timing as a neutral party in the matter is running out and we will have to defer the monies to the courts and the clients seek out mediation in order to remedy the disagreement on return of funds. -Buyer's agent is the one that don't respond to emails or answer calls. As a title company we can not make a decision on who to return funds to as a neutral 3rd party and simply have to either wait for the agents and clients to agree or if there is no agreement, we have to direct to the courts and have clients hire mediator and attorney. We have been trying to avoid such for the buyer as this does eat into a large portion of the monies being held. We would like to see them come to an agreement so it does not come to this but we cannot be the facilitators of the agreements it must come through their respective realtors and/or if they hire an attorney. I wish we could help more but at this point we too are stuck. Consumer Response /* (3000, 7, 2022/09/05) */ (The consumer indicated he/she DID NOT accept the response from the business.) This Title Company was Selected by the Builder, Ultra Modern Development ,The Loan Originator Was also The Preferred Lender of This Ultra Modern Builder Group ,I sent a Signed Cancellation Document to Celebration Title Group..That was E- Signed that document was sent to me by the Agent Genesis F********, Since Then I have Not Had A call or response from this agent , Or The Celebration Title Company , They Will Not Respond to my call or emails ,to explain Why this Escrow money is not Being released to me. The Three Are Not Corresponding With Me .. On 15th of June I finalized a property transaction with Celebration Title Company for 5 acres of land on twilight trail in kissimmee. This was a cash deal. Stephanie C**** C****** was the real estate agent that ****** put me in contact with. The monies were transferred as per title's instructions 2,000 was transferred for down payment and 97,895.20 was to close. Few days later I was told not to build anything on the 5 acres since there was a problem as per Shannon S***** and Stephanie C**** C******. I've spoken to Stephanie about this problem and she instructed me to contact title for more info. I sent Shannon an email on the 8th of July and she replied that the matter was being investigated by the Feds. On Tuesday 3rd of August I sent an email thru your portal and haven't heard anything. I would like to know if I own these 5 acres if not I want the monies I transferred to Celebration Title. Any help you can provide would be greatly appreciated. Business Response /* (1000, 9, 2022/08/29) */ Unfortunately this issue has to be resolved with a title insurance claim. There has been made allegations as to the validity of the transfer and the owners of the property being fraudulently represented. We have further instructed the client to file an insurance claim with ************** our underwriter. There is nothing additional we can do at this time until the title insurance claim is entered by the buyer directly to **************. Consumer Response /* (2000, 11, 2022/08/30) */ (The consumer indicated he/she ACCEPTED the response from the business.) I have done the insurance claim with Celebration Title Company's insurer. I emailed all the information that they requested. I realize that I'm not the only one who was scammed or a victim but the least that Celebration Title could have done is once and awhile let the client know that they haven't forgotten about them. Strange thoughts go thru a person's head when large amounts of money are involved and its not their fault. It's in the hands of ************** Title Insurance Company and I will update as to the progress of this matter to the BBB.
