Our 2016 Ford Mustang was towed by Lake County Tow ("LCT") from my wife's mother apartment complex for being parked in an unauthorized spot at 3:25 p.m. on 12/21/2022, which we paid $299.85 in cash to retrieve at 1:59 p.m. on 12/22/2022 after less than 24 hours of being stored in the tow company impound lot. I am not disputing it getting towed, I am disputing the $65.00 that we were charged as an Administrative Fee. I initially spoke with the owner of LCT on 1/10/2023 to question this charge, who indicated that all of the fees they are allowed to charge are dictated by Lake County, FL code. I researched the Lake County code and called the LCT again on 1/11/2023, who then indicated he was not removing the charges and to talk to a lawyer if I wanted to pursue it further. According to Lake County, FL Sec. 15-7 (d) Maximum rates for towing services and storage, "an administrative fee in the amount of $65.00 may be charged after the first forty-eight (48) hours of storage as long as the company has actually complied with the requirements of F.S. § 713.78...." Our vehicle clearly was not in their possession for 24 hours. All other charges that we paid appear legitimate according to Lake County code. LCT has likely unlawfully charged this administrative fee to other customers. I have also reached out to Sargent DeSantis at the Lake County Sherriff who suggested that I file a BBB complaint. I am seeking a refund of $65.00 from Lake County Tow. **** ******Initial Complaint

Lake County Tow arrived at my house as scheduled on 8/1/2022 10:30am to tow my Excursion 2+hrs to a repair shop for 840$. My excursion has very wide wheels, wheels that cost me over 5k. This is also NOT the first time lake county tow has towed this exact ex, so I knew they could do it. I began to load my excursion on to the tow truck while the driver directed me, after getting the front wheels lined up and on the ramp WITHOUT touching the bed rails, the driver told me to hop out, he said "I got it from here" Once he got in the truck I began filming him drive onto the truck where not even a minute into the video he runs the front driver wheel into the bed rail WHILE LOOKING AT THE WHEEL and while I was trying to direct him. I kept calm, told him to reverse because he was rubbing the wheel, he got out and I HAD TO DRIVE MY TRUCK ONTO HIS RAMP. Irritated I had to do his job, I waited at the top of the ramp in my truck on the brake while he chained everything up to secure it. I paid the FULL 840$ and he took it to the shop it was supposed to be delivered to. The shop he delivered it to then called me to tell me he arrived but had reversed the Excursion off his truck and rubbed both passenger wheels all the way down the rails. I have photos showing that I loaded the truck myself, of the wheel damage and the video of the driver, after calling for days about a resolution I was informed my driver was the COMPANY OWNER. The OWNER damaged my truck still charged me full price for the tow, never took responsibility or apologized and FINALLY contacted me back on 8/4 to yell over me, curse and only take responsibility for the wheel he was filmed actively damaging. This was a ridiculous experience, I'm a 27yr old working mom, I used lake county tow 3 times in the same month, over 1400$ given to them, I sent the invoice for my wheel repair (760$) and he refused. Disrespectfully at that. I simply wanted them repaired so we could continue business.Initial Complaint

This was a towing incident. Our truck was left parked in front of the usual business we paid to store it at. Apparently it wasn't parked in its assigned parking spot so the uhaul employee had it towed and I recieved the lien in the mail about it. I never even received a phone call from uhaul prior. So I called the towing company and was informed that I need $1600 and a valid power of attorney within 1 week in order to obtain the vehicle from their possession. If I did not then it would go for auction. So the pressure was on me in order to get the power of attorney from Adam in time. I contacted Adam and the only option was to hand write on paper the form he was able to find with little resources while he was in a prison at the time. He mailed it to me and I recieved it just the day before auction. So I arrived with it and was confident in getting it because the owner i spoke with on the phone has a very judgemental attitude towards the owner of the vehicle. Apparently he had done his homework in order to locate the owner. Learning that he had just went to prison on drug related charges. He stated that, "seems to me he deserves to go to prison considering the drug charges he has." He wasn't very helpful at all when I called to ask about what was needed exactly to release the vehicle to me. Anyway jumping to conclusion..when I presented the power of attorney to an employee they made a copy and put it on the bosses desk and told me to come the following morning at 7:30am. They had just closed and would not do anything to help that day. The next morning I arrived with an officer as well but did no good. They claimed my power of attorney was not proper or even valid. I am Attaching all forms and evidence I have.Business response

Business Response /* (1000, 8, 2021/12/16) */ Had Mr. ***** produced the proper paper work with the proper payment there is no reason you would not have been able to pick up your vehicle. As Mr. stated there was even an officer present. If it was correct the officer would had made sure the vehicle was released. Consumer Response /* (3000, 10, 2021/12/25) */ (The consumer indicated he/she DID NOT accept the response from the business.) Police are only there to keep the peace. When I called about the truck and spoke to the lady at front desk a man interrupted rudely and seemed angry that I was coming to get it. Saying it took me too long. Obviously I was waiting on the power of attorney to be mailed to me. From a prison where there were no forms or printers. He knew that day that my paper was legit and proper but screwing me out of a truck made him more money. I had all of the $1600 in cash with me to pay as well. Complaint Response Date bumped because: Holiday Business Response /* (4000, 12, 2022/01/05) */ Lake County Tow followed FL statue and followed all the proper state guidelines. If the vehicle wasn't illegal parked none of this would of happened. If you feel your owed something take me to sm claims court. Ill make sure to bring ALL the proper paper work. Have a good day Consumer Response /* (2000, 14, 2022/01/09) */ (The consumer indicated he/she ACCEPTED the response from the business.)
