      Prior to the date of the occurrence that the transaction transpired, I was taking my vehicle to Javi's Auto Repair for minor repairs and a standard tune up where Mr. U. mentioned that he would pay for the parts, as I did discuss with him I had very little money due to covid. Mr. U. Assured he would help me out and he would repair the vehicle like if he were repairing it for family. He mentioned that a dent that the vehicle had, a 2005 Toyota Rav-4, could potentially cause the piece that holds the motor in place to break and I would need to change my vehicle. He mentioned that he was repairing a vehicle for his own personal use and it was a 2005 Nissan Xterra and he was offering to sell it to me for $5,500, due to my circumstances, as well he was mentioning he would value my vehicle at $3,200 that would be credit applied towards the total $5,500. On August 19th, 2021, I came to an agreement with the owner of the business Mr. U. that I would trade my vehicle in and give him $500 cash and the remaining amount I would be giving it to him in lump sum payments throughout the months. We completed the transaction and then he asked me if he could use the vehicle for two weeks as he didn't have a way to move around. I agreed. On September 9th, 2021, I went to the auto repair shop and picked up the vehicle, the 2005 Nissan Xterra, and gave him $1000 more. Immediately I noticed it had a strange sound to it and I called him and informed him and he told me to take the vehicle to the shop. I was busy with doctor's appointments that I wasn't able to but one night my daughter was driving the vehicle and it suddenly stopped working and it would not turn on, Javier informed me he would send a tow truck to pick the vehicle up the next morning. He told me the motor is what made it break down & that we would need a new one and that he would try to see how he would repair it. We have not received any communication, except one call askin for $800 for a new motor, which we paid.

I would like to clarify that when ***** brought the vehicle to our shop, upon inspection it was discovered that the motor mounts were worn down, (It wasn't a dent as she stated on the complaint) A dent it doesn't alter the function of the engine, a dent is a scratch or a hollow on the surface of the exterior of the car. This is not the advice she was given at all, we would never advise our customers to change the motor mount because the car has a dent. No matter the quality of engine mounts, they begin to wear down after usage and eventually require replacement. Not replacing an engine mount that is past its prime can inflict damage to the engine, cause discomfort for operators and potentially be a safety risk if the engine isn't secured. Additionally, the suspension and the chassis were rusty, the customer was aware of it because she was shown the damage of the car when the technician lifted and inspected the car. One of the motor mounts was replaced free of labor charge as a courtesy, then she was given an estimate of the two other motor mounts that need to be replaced but she couldn't afford it, I am not sure why she was under the impression that all of the repairs were free of charge, which we won't do. On the other hand, the vehicle that we sold to her was one of my personal vehicles that I had been repairing and maintaining as my third vehicle, the vehicle was in good working condition when she picked it up, and she did a test drive to check that the vehicle was working properly she also was advised that the vehicle was a sale as is. I valued her 2005 Toyota RV 4 at $ 2500. At that time a vehicle that had that much repair to be done, wasn't worth more than $1500 taking in consideration that it is 18 years old, and it was kept in very poor condition, maintenance wasn't done regularly, transmission filter and oil wasn't replaced at 100,000.00 miles as it should be. The car was dirty inside, it was rusty underneath, and the paint needed to be redone as well. When I sold the vehicle to Mrs. *****, she was informed on many occasions that it was AS IS and not warranty was given on the vehicle. When Mrs. ***** informed me that the vehicle was making a noise. I specifically advised not to drive it like that until she could bring it to the shop, she never followed our advised and kept driving it like that, she was also advised of the hazard of driving a vehicle in that condition. Then the car broke down as I advised her it may. I let her know to bring the car so I can inspect the vehicle to see what was the issue. She refused to bring the vehicle, making many excuses and stated that she didn't have money to pay for a tow truck, So again as a courtesy I paid for the towing service. Upon inspection the car had a blown motor. The engine needed to be replaced, ***** was given an estimate of a new engine worth about $ 2500 just for the parts, plus labor time and taxes, she refused to purchase a new engine because she again didn't have the money. So, I offered to try to repair the engine in case that it was possible. She was given an estimate of $ 800 for a used engine plus labor $ and taxes. She paid $ 800 for the part only, Around May 2022, I let her know that the engine was already repaired and that she can pick up the car and she need to pay the rest of the money she owes me on the car because she never made the payments we agreed on. Mrs. ***** started to demand the car without even finishing making the payments for the vehicle, or the labor to replace the engine. Additionally, she sent another lady to harass me over the phone, demanding the vehicle and money. Because she refused to comply with payments, I obviously had to hire a company to impound the vehicle. I do not work for the towing company so I cannot comment on the procedures they implement. Consumer Response /* (3000, 19, 2022/07/22) */ (The consumer indicated he/she DID NOT accept the response from the business.) I have a witness that is willing to testify that Mr. Javier gave FOUR months of Warranty for the 2005 Nissan Xterra, as this person was with me during the transaction. I also have another witness that was present when The car broke down Mr. Javier stated that he would send his friend who owns a tow truck to pick up the vehicle and to abandon the vehicle in the establishment it broke down at and he would send his friend to pick it up early in the morning and he would fix the vehicle. I never expressed I did not have any money to be able to get a tow truck and take it to his shop. In fact, Mr. Javier informed me that he would take care of it. Furthermore, in regards to the motor mounts, Mr. Javier explained to me that he would be able to get the motor supports and I paid Mr. Javier for the products and the labor, after the repair is when Mr. Javier explained that if there was any dents or hard brakes to the vehicle, the motor would come off and he further explained that it was because this vehicle was one of the ones that got flooded up north and it had problems. There was no damages to the chassis as Mr. Javier stated. Also we have all the records of phone calls made to Mr. Javier and there was NO phone call made in May of 2022 from Mr. Javier in regards to the vehicle, courtesy of the records of incoming and outgoing calls made to my personal cell phone number that I was able to obtain through my cell phone company. Lastly, we have not had anyone call Mr. Javier whatsoever, as this is a transactional issue between me and Mr. Javier and we would like for Mr. Javier to show us proof of the calls that were made to him from said person. We would like justice in this situation as numerous things on the business response are false speculation and a defamation of character, which is being taken care of legally. We would like the money that corresponds to us that we have given to buy the vehicle and fix the vehicle and the money he received from selling the 2005 RAV4.
