I'm a resident of a rental property. Our property management company, Clara Herrera Realty (also 2Cassa ********************* has applied late fees to our account from both July and August that should not have been charged to our account. My roommate and I were first informed of these fees in mid July, and after reviewing our account ledger we assessed that the fees they applied were incorrect. Their claim is there was a $10.50 fee we hadn't paid for some form of liability insurance charged to tenants who do not have renter's insurance; however we are both covered under a policy that started June 30. We have both tried numerous times to contact and dispute the charges with the Property Manager but have only received an answer once, where they restated that a late fee was charged because of an unpaid fee, and didn't acknowledge any of our concerns or questions regarding the legitimacy of the original fee, or acknowledge that we had been trying to contact them for over a week with no response. The problem is still ongoing with no response from the management company, while late fees are still being added. I have screenshots of our account ledger that corroborate that our account was current when the late fees were originally charged to our account, as well as a log of all attempts to communicate with Clara Herrera Realty/2Cassa. I also have a copy of our insurance contract. We ask that you assist us in getting our property manager to remove the fees from our account since they should not have been charged in the first place, and get them to explain why they have failed to communicate with us over the three weeks that we have tried to resolve this issue with them. We ended our lease at the renewal period. Once we moved out we highlighted that water damage in the unit was still not repaired and that we would not be liable for charges. We were sent a letter requesting payment of $2,053.78 without explaining the charges. This request was sent to a debt collector at the same time, thus not giving us a chance to dispute charges. A letter was sent to dispute this and was ignored. She has ceased all contact with us and the property management company by changing her number and not notifying anybody. We have sent a final demand letter with supporting evidence that we are not liable for any charges and is still being ignored by CH Realty. Clara Herrera has breached the 30 days where she is supposed to give a detailed explanation of charges to our security deposit and has failed to do so. We request that our security deposit be returned and any additional charges are dropped.Initial Complaint

Clara is currently refusing to return my security deposit of $1,300. She was very hard to reach during the rental period, maintenance requests were not resolved timely, and were tended to by a family friend that did not speak English. She is now refusing to return my deposit claiming that she will charge me for an extra month of rent since she did not receive my keys. A lock box was placed on the door without my knowledge and without her providing the combination to open it. I have been attempting to contact her multiple times and sometimes will resort to filing a fake maintenance request so that she will get back to me. I was unable to leave the key in the lock box since I did not have the combination and I have not been able to reach her. There is absolutely no reason why my deposit should be withheld from me especially considering her lack of communication.
