Company is seeking a $3,000 cancelation fee. The fee also includes installation materials that were never received or itemized. No installation date was ever scheduled with the company. There was only discussion of tentative dates but no date was ever scheduled. Section 8 of the contract states I may cancel at least 10 days prior to instal. It further states Conexsol will send me a written notice of installation commencement which was never done. I have asked for that document multiple times and they have failed to provide it. I am seeking release of contract with no cancelation fee as stated in section 8 of the contract. No written notice of installation commencement was ever produced BY Conexsol as required by the contract. Therefore I am canceling at least 10 days prior to installation since an instal day was never scheduled, and am able to cancel without costs as stated in the contract.
