This company practices illegal robocalling on a daily basis. I have spoken to one of the owners at length through mostly email after being completely ignored. At the time of this complaint I was told by ******* the owner to communicate with their attorney. She is stating that her company had consent to call me which they never did. She also sent a picture of a very old business profile that has been closed for many years from yp.com. The company is not taking responsibility for there illegal activities. They do not follow the federal guidelines outlined, they also do not posses the current licensing to solicit in the **************. This company is continuing to break the law on a daily basis. I will be reporting them to both the ********* today.

      Business response

I take consumer concerns very serious and investigated as soon as ************************** issue was brought to my attention. I took his call and found his email in my junk/spam box while we were on the recorded call, so he knows I was not intentionally ignoring him.  I asked him to let me research with the intent of determining when the call was made, who made the call, and where his contact information came from.  I called him back within the hour after determining that the call was made by an Independent Agent who was calling businesses in his area.  ********************** admitted that he owned the business listed, Impact Glass.  He explained that his business is no longer in business, but the number now goes to his cell phone, which is listed on the Do Not Call List.  In conversation, ********************** shared that he sues solicitors as his full time job and that he has success in settling out of court because companies don't want the expense of going to court.  He told me that he would build a case against USA Benefits Group for over $40,000 in violations, but he would settle with me out of court for an undisclosed amount.

Businesses are exempt from the *** registry.  ************************** business phone number, Impact Glass, was listed online as a business. I asked him to provide me information backing up his clam that there was an infraction in the **** guidelines, to which he sent several excerpts about cell phones and home businesses but was unable to provide any information showing that it was against **** guidelines to solicit a business.  After multiple exchanges, I was confident that there was no violation and advised him that further inquiries should be addressed to our attorney.

I have attached the following: Pictures of Impact Glass business listing showing the phone number in question *************), the picture of the initial email that he sent showing it was in my junk folder, and the email string showing the expeditious response to his inquiries.

I am happy to provide call recordings, if desired.  Please let me know if you need anything else.

      Thank you,

      ******* Banville
