      To Whom It May Concern,I am writing to file a formal complaint against ***** ******/Priga LLC, with whom I entered into a contract for the purchase of a home located at ********************************************************************************. This complaint concerns multiple failures and breaches of contract by the builder, specifically related to the non-completion of agreed-upon work, including essential safety repairs, the relocation of water pipes necessary for installing a pool at my property, an uncompleted balcony repair that poses a safety hazard, and additional unfinished work totaling over $27,000.Details of the Complaint:Contract Date: September 1, 2023 Issues Began: From day one of moving into the home.Key Issues:Non-Movement of Water Pipes: Despite repeated assurances, the water pipes critical for pool installation have not been moved, in direct contradiction to verbal and written ***************** Hazards and Repair Issues:Numerous items from the post-inspection repair list remain unaddressed, some of which present serious safety risks, including an uncompleted balcony repair.The total cost of the work left to be completed exceeds $27,000, which significantly impacts the usability and safety of the ************** Losses: Delays and unfulfilled promises have led to significant financial losses, including the potential loss of funding for the pool project.Desired Resolution: I seek the immediate commencement and completion of all outstanding work as per our original agreement, alongside compensation for financial losses incurred due to these delays and breaches.Attached are copies of all relevant documentation supporting my claims, including contracts, communication records, inspection reports, and detailed estimates of the work remaining.I appreciate your attention to this matter and urge a swift response to these serious concerns.       I am writing on behalf of Priga LLC in response to the complaint submitted by **** ***** ******* regarding the property located at ******************************************************************* We take this matter seriously and would like to address the concerns raised in a factual and professional manner.
      **** ******* entered into a Builders Contract with Priga LLC on July 23, 2023, for the purchase of the above-referenced property. The contract includes two important clauses relevant to the claims in her complaint:

      Special Contingency Clause Regarding Pool Installation:
      The contract stipulates that the purchase was contingent upon confirmation from the City of ******* that a 12 x 20 pool could be built in the backyard. The agreement states that if this confirmation was not received by August 25, 2023, **** ******* had the right to terminate the contract and have her ******* money returned in full.  Please use **** ********* agent's emailed offer to our agent as evidence of this intention. We were transparent throughout the process that Priga LLCs responsibility was to prepare and submit the necessary plans to the City of ******** We fulfilled this obligation, and the closing occurred on September 3, 2023. All relevant documentation, including the engineering work, and site plans, are attached for your review.

      Post-Closing Responsibilities Clause:
      The contract also explicitly states that "after closing, Seller shall have no further responsibility for periodic inspections, replacements, maintenance, or repairs except as may be covered by Seller's warranty...".

      **** ******** claims related to defects and aledged unfinished work fall under the terms of the 2-10 Builders Warranty provided with the home, and any legitimate warranty claims must follow the proper submission process.

      Relocation of Water Pipes:
      While we fulfilled our contractual obligation to submit the plans to the City, **** ******** expectation for us to execute the relocation of the drainage pipe is not supported by the contract. We made a generous proposal, in consultation with our attorney, to assist further, but **** ******* declined. At this time, we are unable to extend any additional offers related to this matter.  Please find evidence of our proposal attached.

      Post-Closing Repair List:
      We have no record of a formal inspection report or list being submitted to us. The items in the post inspection list provided by **** ******* were never claimed under the Builder's warranty. The home is covered under a 2-10 Builders Warranty, and any claims must be submitted in writing to Priga LLC, as outlined in the warranty process. To date, we have only received 7 items in May 2024, which we have addressed and communicated to **** ******** Despite addressing issues that exceed the warrantys scope as a courtesy, **** ******* has failed to confirm resolution or submit further concerns through the proper channels. The list of unfinished work presented in her complaint has not been submitted to us for review, and we are unable to validate or address these items without following the established process: 1. the homeowner verify in the warranty boklet provided if the issue is warrantable, 2. submit the claim in writing to us at ******************************************* 3. allow us to review the claims and perform any necessary inspections, 4. we will provide a decision on coverage for each item, 5. if the item is warrantable, we will schedule the appropriate repair/replacement.  Our builder warranty doesn't allow reimbursements for work that the homeowner performed or contracted on their own not previously approved by the builder.  We have also been very clear with **** ******* that the builder warranty only covers workmanship items on the first year.  The only resolution we can offer at this time is for **** ******* to follow the warranty process that we described and properly allow us to respond to them.

      Front Balcony Repair:
      As a gesture of goodwill, we agreed to perform free work on the front balcony of **** ******** home, which involved demolishing and rebuilding sections of the structure. All major work, including the lateral walls, siding installation, and structural repairs, was completed by 2pm on September 12, 2024. The only work that was pending from our side was painting the siding. We had the painter hired and on site that same day. Verbally, we had agreed that they would provide the paint since they had some remaining paint in the garage. However, the homeowner could not find the paint and demanded us to purchase the paint. To avoid any further confrontations, we bought the paint and brought it back. By the time we returned with the paint, it was after hours and the painter had to leave. The painter agreed to return on Monday to complete the work, since it was forecasted rain for the following days. The homeowner, against our recommendations and requests, contacted the glass installation vendor and rescheduled the glass installation to the following week, unnecessarily.  This was supposed to be a generous gift from our part to the homeowner and excepting the paint, everything was completed and ready for the glass railing system to be installed, including performing more demolition and incurring more costs than originally planned. Given the lack of recognition and appreciation and the homeowner's unilateral decision to delay the installation of glass railing, we made the decision to cancel the 0-value agreement and cancelled the painting scheduled (the only remaining activity). We feel that we have always acted in the best of faith and that we have fulfilled our obligations on this point. It would be incredibly unreasonable for the homeowners to request anything additional.

      Conclusion:
      We have made every effort to act in good faith and resolve **** ******** concerns. Priga LLC has fulfilled its contractual obligations and has gone above and beyond to address issues not covered by the warranty. At this point, we believe no further work or financial compensation is warranted. If **** ******* wishes to proceed with additional claims, we invite her to follow the established warranty process.
