I engaged in a contract with CER Design, Christopher ********************** to complete renovation for my kitchen and basement. He used *********************** as the subcontractor. He took monies from us and did not complete the job. After speaking with him he agreed to repay the Overpayment Amount of $27,902 on October 6, 2021. Payments to begin in November. Phone call was recorded. He has not paid one payment on this. Please see below for specifics on initial request. After reading this, ***** agreed to repay us money for overpayment and not completing the job. He continues to do work for others and has not met his obligation to us.Contract is in the amount of $111,890. Basement - $49,650. Basement HVAC - $8000 Kitchen - $41,940 Flooring - $8500 Paint - $3800 Mr ********************** is in breach of contract as he did not deliver according to the signed contract. Mr ********************** is proposing that you fulfill his financial obligation for the subcontractor. Your contract is with Mr **********************. There is no written or verbal contract with the subcontractor.The subcontractor has refused to finish your job and left a considerable amount of trash in your backyard (according to the pictures you sent).Mr ********************** has asked you to pay for a dumpster for the trash that is deemed his responsibility. The subcontractor has refused to remove the trash until he is paid by Mr **********************. You paid the subcontractor for Mr **********************'s past financial obligation in the amount of $6000 so the subcontractor would continue work in your home. You paid Mr. ********************** for material overages in the amount of $3828 and then purchased the same materials that you paid for overages in essence paying for this twice.You purchased materials in which the contract states that Mr. ********************** is responsible for in the amount of $11,967.71.Mr. ********************** owes you $27,902.
