      I signed a contract and paid this company to build 2 concrete block retaining walls. The contract stated they would be built to code and have a drain installed at the base of each wall. Within 30 days of paying for the walls, they began to crack. He said he would stand behind his work and guaranteed they would not fail. After 3 patch attempts, he paid his engineer to come assess the walls. Both are built incorrectly and are failing. The drains he installed are at the top of the walls with no exit point for the water exposed therefore trapping all of the moisture behind the walls causing them to crack and fall. They were finished ****th and have now fallen 2 inches. His engineer wrote up what needed to be done and ******* said he would demo the walls and rebuild them correctly. This was in September. He cancelled every time he scheduled to show up and they have continued to crack more and lean more. I need them rebuilt and he won't stand behind his work. He also told me he was a licensed Ga general contractor and he is not. I am looking for him to demo and rebuild the walls or pay someone else to do it. I have in writing from ******* that he always has and will stand behind his work, however, he has made no attempt since ****th to do anything on the walls. I have emails from him stating he would take care of the issue but he hasn't and further damage is liable to happen with the current situation.

      I am rejecting this response because:  Please review all of my notes in Blue to the response made by ******* with TCT Construction.  I have repeatedly agreed for him to line up contractors to come and demo the walls and rebuild them since he is no longer allowed in the park.  I have seen nothing from him attempting to line this up.  He keeps stating that I don't want to wait and don't have any patience.  I have been waiting since May 30th of last year.  If you would like to see all of the emails and texts regarding completing the work I am happy to forward them.  It's certainly not my fault that he can't come in the park however, I have been told that he could regain access and he knows what he has to do in order to be permitted back in.  With everything I have to do to get this work completed, it is going to cost me over $20,000.00.   In the estiamates I sent ******* previously, it didn't include repainting the walls, re-graveling my driveway once it is messed up and the continued cost of my belonging to remain in storage since I have not been able to complete this project.  I will settle for a cash settlement of $15,000.00 if ******* doesn't want to line up contractors to come and do the work.  The fact that both of these walls are failing and were not built correctly is not my fault and even with this settlement I will still be out of pocket $5,000 or more.  I really just want the work done the way the contract stated.

      This matter continues to be unsettled due to ********************** latest response and pressure on my company.  It appears that she is again unwilling to settle for a reasonable cost.  She continues to exaggerate or amplify the state of the wall project. These wall have been up and in place for about a year with only minor spider type cracks.  I have pictures to prove what the wall cracks looked like from last year before I left the resort and the walls are still standing and in place. These walls not going to fall unless they are forced by other means to collapse.  TCT Construction, *** will not be badgered or harassed to disburse funds or pay for her continued attempts to take full vantage of this matter.  I will not be pushed or forced into a complete property makeover, including all new driveway stone, mulching, painting the walls, which was already done at no cost to her, pay for personal storage items that are irrelevant in any capacity towards the project. These extra cost she incurs are a part of her daily living expense while trying to take advantage of this matter regarding TCT Construction. I am concerned that her continued attempts to elevate this matter will only delay a final settlement.  Please know that from personal sources close to me in the resort that she is and has been purchasing / buying new properties as quickly as she can locate them.  Her continued comments that she is painting for others is a picture of a person with no money,  She is purchasing new properties and I don't feel this is right for her to take advantage of me while she has personal buying habits, I am not going to supplement her buying spree or pay for her lifestyle of being a big time property owner in or outside of the resort.  This matter needs to come to an end, with a settlement offer of  $11,500.  I am understanding, but will not be taken advantage, pushed around by a person that has exaggerated this matter or being bullied into cost that are outside the scope of work by complaining to the BBB. I will work up a reimbursement schedule to pay her for her wall makeover, but wont subsidize her spending on other wants on her property, her continued buying power of more properties and another wants she is listing as a direct impact of the original wall work. If we cant agree on this suitable and fair offer, I am willing to mediate in court that facts of this case that will show her current spending habits, her selfish and greedy attitude that only indicates who she really is, not a reasonable person.  Thank you.
