We have 2 lots, and we hired the company to remove the trees, clear the lots, and do the grading. He graded the first lot but didnt finish cleaning up the debris as promised.On the second lot, we paid a 50% down payment on 10/05/2022 and he said he would start the job in 2 weeks. After several lies and excuses, after 2 months he started the job.When he started removing the trees in the second lot, one of the trees fell on the neighbors property, almost hitting his deck. The Neighbors called the county. Because he was inside the buffer area on the first lot with a big machine and the tree fell on the second lot inside the buffer as well, the inspector put a stop work order on both lots and gave us a very high fine.Also, he left the street full of mud. The neighbors again called the county and made several complaints about it. The inspector called and asked us to clean it up and we had to pay a fine per day until the street was properly cleaned. We called the company owner and after hearing a lot of excuses we ended up spending the whole day washing the street.We paid in full for the first job (which he hasnt finished) and a 50% down payment for the second job. Now the company owner is saying he will not finish the job in any of the lots and will not refund the payment we made. Now we need to pay the fines, and we need to hire another company to do it.Business response

Owner / builder did not pull a permit and had me start the job. I met with them prior and told them exactly what my plans were. I completed 60-70% of the job before the county shut us down due to not having a permit. I also was told by the owner to remove the tree in the backyard of lot 1 because they couldn't get their final inspection done without it being removed. Attached is a photo of the text that was sent to me about it. The dirt in the road was from their dump truck driver that they hired. We stayed down on the lot moving the dirt that he was dumping. We had nothing to do with any dirt being on the road by our machines. Bottom line is the fines were a result of the owners actions and not ours. The scope of work also changed numerous times so we pulled off the job since we had no clarity. We did receive a 50% deposit for the job. However, we completed more than 50% of the job and we also moved dirt for a day for free with the skid steer and didn't charge anything. That was NOT in our scope of work originally. No refund will be issued by us by any means.Initial Complaint

We, Native Construction, LLC contracted ************************* with Patriot Grading & Excavating, LLC to do the grading for a new construction home belonging to ***************************** at Lot #3 Incline Drive in ******, ** on 6/24/22 and paid a deposit of $8,562.50 on 6/30/22. ****** had been doing grading work for the neighbors at the house next door and made a complete mess of their property and they had to hire another grader to come and fix the mess he had made and it ended up costing them $40,000 more to repair the damage. We fired ****** before he began any work on the property at ******************** and requested our deposit back on 7/15/22. He said he would mail a check right away. We, as well as the homeowners, have contacted him multiple times to no avail. We have not received any payment/refund and no work has been performed. The business name is not even in Brodies name. It is in his wifes name, ******. There are several different business addresses listed for Patriot Grading. None of which the business actually is. We have no way to get the money that is owed to us.
