On June 7th 2023, ***** told us that ***** and **** were hers and I could have whichever she did not pick. After confirming this again on June the 9th, via email, we sent in our deposit. On June the 23rd, she said she was keeping ****, and ***** was available. On July the 3rd she offered to bring us the dog at the end of July to the ********** dog show, at which time she tried to pressure me into letting her show him. I expressed that we were not interest in showing him. On July the 5th I began reaching out when she stop replying. She now stated that she might keep ***** instead of ****. On the 11th she finally called me back and asked if she could crop his ears and show him, after declining, she ignored my repeated calls and messages. On the 23rd of July, late evening, she sent me a long rambling message about how the owner of ***** changed her mind and now wanted *****. She was keeping ****, so I no longer had a pick, or a dog. She tried to convince me to take a bunch of other dogs that she was showing. ***** was unsympathetic, and said we could have our money back. Now she refuses to send us our money, and is trying to sell me another dog. I have documentation of every conversation. I see that I am not the only one who has experienced this. I will seek restitution in court. She has tried to twist her side of the story, but these are the facts.

      Business response

      08/19/2023

First of all, I am not a business. I am a Dog Breeder that works a full-time job. I breed show quality dogs that are fully health tested and undergo an extensive amount of socialization and training and conditioning. I am not your typical backyard breeder who lets people choose puppies the instant they are born based on Markings. I had mini boy puppies available when this person approached me, but he was only interested in two, at that time those two were being reserved by myself for consideration, I show prospects because before anybody else I will choose for myself first to further my program, and to better the breed. At some point in the process I have decided which of those two specific puppies, I plan to keep and told ******************* at one of the puppies he was interested in should be available, at that time he did not commit to sad puppy. He said that he wanted to come meet both puppies to see if they would even be suitable for him, mind you the other puppy was not available and was not going to be available . So at no point did he commit to said ***** nor did he say yes we will take him. He was on my spreadsheet as still available. As they got bigger, it became apparent that he may be more suitable as a show prospect which this person was of no interest in showing or competing and someone did show interest and commit to the puppy. I had advised him several times the puppies were still being a valuated, and then when the puppy was no longer available, I did offer this person several other male dogs even some of my show quality puppies as he was in close driving proximity to me with the hope that there couldve been a partnership or guardianship where I could have shown the dog for him at no cost to him in his area, and he was immediately combative, he claimed they missed several days of work, because they were crying and distraught over a puppy. they literally never told me they for sure wanted.  They had paid a deposit only, he signed a deposit acknowledgment.  I told him at that time if he was unhappy, he could have his deposit back, which he did sign the agreement that states that deposits are never refundable, but only transferable. He asked me several days later, what the options were for my upcoming litter, and I told him I did not plan on keeping a boy that would have put him first in line to choose, and then more days went by until he messaged me out of the blue and said this isnt going to work I want my money back. At no point did I ever say he would not get his deposit back I just didnt send it the instant he messaged me. At the end of the day my breeding program is for me first and Im going to put puppies where I feel. They are most suitable and appropriate and Im not going to be bullied by someone into giving them a dog because its the markings they want. Unfortunately, I think he would be better suited for a backyard breeder that just sells Puppies on Markings with no other considerations for the Breed, the standard or the placement. Someone who does not wish to compete with their dogs. His refund has been processed and proof of such as attached here.
