I have lived at my current residence **** ******** **** **) for 34 months. The residence is located within Waterways Township in Richmond Hill, GA. During this period, we have never had any standing water issues until recently. The standing water issues occur every time it rains, whether light or heavy. The issue began in approximately December of 2022. The lot next to mine was vacant prior to this date. In 2022, JM Allen Homes began construction on a new residence **** ******** **** **** Once construction was completed on the JM Allen home, we consistently have standing water on our property, which adjoins the new construction. I began contacting JM Allen regarding this issue on January 3,2023 and their response remains the same, “The property is up to code and sorry for the inconvenience.” I have contacted them several times since January 3, 2023 and still no resolution. JM Allen has been apathetic towards the issue affecting my property and it was nonexistent prior to their new construction. They should fix the issue they have created instead of acting like it’s not their problem. Thank you for your time and I look forward to hearing from you!Business response

I am the owner of J.M. Allen Construction, Inc (“JMAC”). I am responding to the complaint filed by ******** ****** *** ***** alleges that JMAC’s development of lot adjacent to *** *****’s property caused a drainage issue. JMAC disputes *** *****’s contentions and respectfully requests that he provide facts supporting his allegations. In order to develop the lot adjacent to *** *****’s property, JMAC was required to submit an engineered site plan addressing all grading and drainage. The site plan submitted by JMAC was approved by both the subdivision and Bryan County. JMAC developed the property in strict accordance with the approved site plan and the work performed by JMAC was inspected and approved by both the subdivision and Bryan County.
After JMAC learned of *** *****’s concerns, it contacted Bryan County and requested an additional inspection. Bryan County reinspected the property and confirmed that the work performed by JMAC complied with the approved site plan. While *** ***** has a drainage problem on his property, there is no evidence to support *** *****’s allegation that JMAC caused the drainage problem. Since the drainage problem is on *** *****’s property, JMAC encourages *** ***** to hire a professional engineer to evaluate his site plan and the as-built conditions in an effort to evaluate whether his property was developed in accordance with the site plan. JMAC is sympathetic to *** *****’s concerns and will gladly consider any evidence or reports he obtains from a licensed engineer. Without a report, there is simply nothing JMAC can do to address *** *****’s concerns. JMAC has constructed the site in accordance with the approved plan and it is not permitted to deviate from that plan.
