BREACH IN CONTRACT- REFUND OWED I'm writing to request a refund for a late project that lasted 548 days past due of the original agreement. The original agreement required that the construction begin by March 25,2020, and be finished by September 25, 2020. On page 5, point 3, under Completion of Work, it states, "The contractor may be required to pay the owner the sum of $25.00 as liquidated damages for each calendar day of delay, and the contractor will be liable for the amount thereof."However, the contractor's right to proceed will not be terminated because of delays in the completion of the work caused by unforeseen circumstances beyond the contractor's control and without the contractor's carelessness.$13,700.00: The days that Busher Franklin/Franklin Construction are past due on the project are 548 days.$ ******** Because the contract refused to pay for initial grading and I didn't want the job delayed, I covered $******** initial grading expense reimbursement. This was agreed upon in the initial agreement: Busher Franklin Construction would take care of it. He broke the agreement and did not pay.$994.26the initial budget called for new blocks. He refused to remove any reused or repurposed blocks that we had not agreed to prior to construction. The total number of blocks is 432 (16" x 8"). He broke the deal after it was signed.$ ******: The owner payed the electrical subcontractor expenses of $****** in order to avoid delays on the work. The contractor refused to pay him after he bid, and the contractor accepted the specification that he would be putting in the house before the construction began. He broke the deal after it was signed.We will settle for $34,219.26 to fulfill the breach of contract, and no further legal action will be conducted. This is being merciful and evaluating the job you've done and tolerating it for as long as I have. Again, I am working to handle this outside of court, but if we cannot reach an agreement.
