      Please be advised that we have received your complaint that was filed with the Better Business Bureau.  Your complaint refers to a debt collector. 1st Franklin Financial collects its own debts and therefore is not a debt collector as defined by the FDCPA.  After reviewing your account, I can confirm that 1st Franklin Financial accurately reported your account to the credit bureaus.  Although, the documentation provided with your compliant does show that TransUnion, Experian, and Equifax are correctly reporting the account as paid, there are some inaccuracies being reported with other fields.  I have submitted a request to update those fields with each of the credit bureau agencies.

      Under penalty of perjury, I swear all information herein are true. I'm only a natural person writing this statement.A charge off is a cancelled debt and is not supposed to be on my consumer report. Its considered income, and income cannot be reported on a consumer report since the debt was charged off. You need to provide the FORM ****-C cancellation of debt which shows that the debt was written off. How can your company keep asking for a debt that was written off? This is also a serious breach of my privacy rights. Your companys continued reporting of this derogatory item will be considered willful non-compliance due to the previous notifications and your continued disregard of the law. I'm working hard on trying to clean up my credit. This is hurting my chances on improving my living situation.

      1. 15 USC 1681(a)(4) Infringed Upon a Consumers right to privacy and Under the ***** I never gave you (a non-affiliated 3 rd party) consent to have my non-public personal information reported. Credit ****************** are 3rd party non affiliate. 

      2. A charge off is a cancelled debt and is not supposed to be on my consumer report. Its considered income, and income cannot be reported on a consumer report since the debt was charged off. You need to provide the FORM ****-C cancellation of debt which shows that the debt was written off. How can your company keep asking for a debt that was written off? 

      3. under 12 U.S. Code ****n - Accounting objectives, standards, and requirements- this is deductible from your companys taxes.

      4. Lastly. as per FTC guidelines reporting this account in my consumer credit report is a form of collection activity.

      Your companys continued reporting of this derogatory item will be considered willful non-compliance due to the previous notifications and your continued disregard of the law. 

      Cease and desist ASAP. Delete this account from my consumer credit file.

      The Regional Operations Director spoke with **************** on 4/18/22 regarding her credit reporting concern.  **************** requested a copy of her Loan Agreement and Sales Contract which were mailed to her on 4/18/22 to the address she requested.

      On March 21, 2022, I took out a loan at this business for $7586.79 to purchase a car, which inclued the tag and taxes). On March 24, 2022, I informed the business that the car was a lemon and I had took the car back to Blessed Auto Sales. I asked ***** to cancel the loan being that I had taken the car back. She stated that she couldn't cancel the loan until she had the money. I contacted Blessed Auto Sales and asked him to return the money to 1st Franklin Financial and he stated that he needed the title before he could return the money. I called 1st Franklin back and told them that he needed the title back and ***** said that they did not have it, only to find out that they actually had it but held on to it to try to keep me in a loan that should have been canceled. They overcharged for the car tax and sent me a check for the overcharge but because they never canceled the loan, I still had to pay interest on the amount that they put on the paperwork. I gave Blessed Auto Sales $1500 out of my pocket and 1st Franklin Financial wrote him a check for $6900 on March 21, 2022. Blessed Auto Sales and I meet with ***** on April 11, 2022 due to her prolonging giving him the title back. I asked Blessed Auto Sales for the $1500 I payed him but ***** told him that my loan payout was $8,088.90 and told him to give her the entire $8400. She gave $311 back but stills owe $1189 because the $1500 was my money and had nothing to with the loan. Even though numbers are wrong on the paperwork and she sent me a check (that I haven't cashed), the loan should have been redone based off of that alone. And with it being canceled, my payoff should have only been $6900. I would like a refund for $1189.

      I am rejecting this response because:
      the numbers on the loan are wrong. The loan should have been canceled/closed due to this factor alone; the taxes for the car was too much and even though I was given the difference, I was still charged interest for the wrong amount. And even if I had kept the car, I wouldve been paying interest on the wrong amount. They knew the car and tag was taken back within 3 days and could have closed the loan but ***** decided to keep the loan opened and have me do an early payoff. To me this was done, to keep from having to do more paperwork and to get money that they should not have received. My loan was originally $6900 plus taxes and tag, it came to and fees which brought it to $7586.

      On March 21st, the local office mailed a package to ****************** that contains documentation needed by 1st Franklin Financial to investigate his claim of fraud.

      I have been making on time payments every month without a missed payment to this shark credit company, but this month they decided to reject my payment. They harassed me over the phone and made threats to repossess my possessions unless I pay additional fees and come in-person to pay. They have refused to take ACH payments and are not even accredited to take credit/debit card payments. It is ridiculous during a time of the pandemic to require people to travel and also appear in person. My bank has also taken action against their charges and blocked them as they are unaccredited.

The investigation also concluded that a repossession was never discussed by the local office.

      This response does not pertain to my issue. I never attempted to pay via check. This business was attempting to force in person contact during a pandemic. Their lack of responsibility and resolve speaks volumes to the type of business they are. They need to accept other methods of payment such as credit/debit card if they are going to restrict ach payment. I would also settle for having my account unrestricted.
