Phillips Restoration quoted me a minimum fee of $95 for a repair to a bench, but there was no repair done. There was only corrective maintenance done. Corrective maintenance consists of fixing or replacing components after failure. ************************************************* A repair is when there is a breakdown. It included wear, corrosion and inadequate lubrication. 3/8/21 I sent the company pictures of my table. In the photos the leg was completely broken off of the table. I asked for a price. *********** responded and said the price would be $95 depending on where I was located. 9/30/23 I sent the company an email asking if a repair could be done on a bench that went with the table that had been repaired in 2021. The leg was still on the bench. It was just loose. *********** requested pictures. I sent them and told them in the email the leg was wiggling but the bench could stand up. Any professional should've known from my description of the issue in conjunction with the pictures that there was possibility of maintenance and not a repair. Instead of voicing that, they said the price would be $95-125 to repair. When the technician arrived, he told me the bench didn't need an actual repair because it was only loose with a s**** that needed to be tightened and said it's a common mistake customers make in thinking seats are broken when screws are just loose. He said he would charge me a nominal fee. This declaration by the technician was made in front of the nanny who resides in my home Mon-Fri.This, by definition, is maintenance as no components were worn down, corroded or inadequately lubricated, etc. *********** still charged me $95 and sent an invoice upon request for "repair on bench leg". There was no repair, and I should've been advised to check for a loose s**** since it's a common mistake and should've been charged a nominal amount for the maintenance.Business response

I am surprised someone would go to this length to get out of paying $95 for a service call. Your argument and logic are flawed. You are paying for a service and a level of expertise you do not possess. It's called a "contract for services rendered." On top of that you said you had tightened up the bench legs before because they were wobbly so you knew what the is*** was. In the assembly instructions, if you bothered to read them, it states clearly that you will need to periodically tighten the bolts. As far as the request for sending pictures it is to give us an idea of what the is*** is so we can address it. Why waste our time if we cannot fix the problem?
Let's use some other real life examples. You call an air conditioning company and tell them your furnace isn't working and you need it repaired. Company says, fine, no problem, we can send our technician out and the cost will be $95-$125 and you agree. You have a contract for services. Technician comes out and finds the pilot light is out and re-ignites it. Did the technician "repair" anything based on your definition? No, they did not. Does that mean you don't have to pay the company because they did not "repair" the furnace? No! Should they have said, did you check your pilot light? I don't think so.
Your car won't start in the morning and you don't know why? You call the mechanic and tell them you need your car repaired because it won't start. They tell you to have the car towed to the shop. They open it up and see a loose wire connection on your battery. They tighten it up, turn the key, and the engine starts. Did they repair anything, no. Do you owe them for the service they performed, yes. Should they have told you to look for loose connections on the battery? No it is not their responsibility. Do a ****** search for possible solutions next time.
You represent a client in a court case. Judge declares case dismissed. Someone didn't cross their i's and dot their t's but you didn't actually do anything to win the case. Does that mean I have to pay you for your services despite the fact you didn't do anything to win it? Absolutely because we have a contract for services rendered.
I once had a breaker trip because one of our ovens got too hot. Called the repair company and they sent a technician who pushed the reset button behind a panel in the oven you cannot see. They were there 5 minutes. Did they "repair" anything, no. Did I have to pay the agreed upon fee to have them come out and "repair" it, yes. Did I want to? No. It is the price you pay for ignorance.
Since you are in law school and so confident in your argument then let's put it to the test. I am going to *** you in small claims court. It is going to cost you more money and you will have to take a day off, but you will have your day in court to argue your case in front of a judge. Good experience for you.
When this is all said and done, do not forget you escalated a mundane service call into something much more. It is just a waste of our time and money. See you in court!
