This company is flying drones in an unsafe manner over our private property without notice to us or consent from us as property owners. They are accepting payment from neighbors or community persons to invade our privacy, take photos and video of us in our property. They are causing a distraction and safety hazard to our contractors crew working in the property. This intrusive drone activity has taken place on or about October 14, 2021 and today, December 8, 2021.

      Business response

      12/16/2021

In response to to complaint by *****************

************ has made frivolous phone calls and emails complaining about drone flights that were legal and in accordance with FAA regulations.
      1. There is no FAA requirement to get permission to fly over property for any type of aircraft, to include drones.
      2. We were legally hired by *************** of Save Kaiwa Ridge.
      3. No flights over persons occurred
      4. No distractions or safety issues occurred as ************ was unaware of the flights until she received a cease and desist letter for work on the property.
      5. Additional information of activities on site were collected by other individuals for the totality of information provided to the ********** of **** and ***************** for the state of Hawaii.
Drone Services Hawaii has availed it?s services to various organizations around the state to protect the aina.

Attached is the information regarding the current violations of ************?s project from the director of *****************

We did not do any work for ***************************.

It seems a temporary injunction was issued against ************?s project and she is lashing out at anyone involved in exposing possible violations that damage the land and water of Hawaii.

      *****************, Enchanted Lake Residents Association
      *******************, Attorney at Law
Attached please find photos from 3 areas that are likely not following storm water maintenance regulations and, because of that, the runoff from these sites has dumped many tons of sediment into *****************, Enchanted Lake (Kaelepulu Pond), and ****** Bay, and also onto ****** Beach over the last few days.  I have included photos that show the water samples we took during the 3-day storm starting on September 5, and the impact this runoff had on the wetland, lake and beach.  We will be making estimates of the total tons of sediment eroded from these sites based upon the measurements we have taken.
The three areas that appear to be not in compliance are:
MDHE, LLC development (***************** project), with a grubbing and grading permit, on conservation land, ************************************************************************************** Multiple home lots in Olomana Heights, **********************************************************************************
Single family home being built by XY Construction, ************************** Hawaii

If you are going to get community support for a stormwater maintenance fee, it is imperative that you demonstrate that you are serious about enforcing the improved construction runoff and BMP regulations by fining and monitoring compliance of construction sites. Construction sites are a primary source of pollutants to stormwater in our watershed.

All these projects will continue to be violators of the Federal Clean Water Act and State and City construction site sediment control regulation throughout the rainy season if you do not force them to comply. The wetlands, lake and nearshore waters will continue to bear the negative impact of these violations with every storm.

Please inform me when your inspectors have visited these sites, and the outcome of these inspections.
