Attached is a letter that was written to Progressive Landscape via certified mail/return receipt. The delivery was unsuccessful and they have failed to request a redelivery or pick it up from the post office. A copy of the letter outlining the issue is attached as well as documentation showing the facts outlined in the letter. I have also attached copies of the checks issued to Progressive Landscape as well as a quote from ********* Landscape for the cost of having the work re-done properly. I am requesting a refund for the amount to have the work re-done.

      Good afternoon,

We could not find on your website where we could respond to the complaint by *********************. We will respond with the following. We find it completely and utterly ridiculous that we have not received a phone call or email and not even a text about any problem she had with our Landscaping which was done approximately a year ago.  We take pride in correcting any mistakes that was of our own volition. We do not cover abuse or not properly taken care of any Landscaping that we do especially one that is almost a year old. If we would have received an email or phone call stating the issue we would have been glad to come out and correct it. She states that she sent a registered letter of some type, the reason why it was never delivered to us is because that we are no longer at that address. Again I want to reiterate there's not been a phone call, a text, or email or any type of reaching out from her about any problem that she has. We will not be refunding any money of any type. I know that this woman has a problem with suing people or scamming people trying to get more money out of them, case in point she sued her own work place over some frivolous lawsuit. If she cares to make this an issue we will sue for defamation and any liability of hurting a business because she has misrepresented the facts. We take pride in our work and we take pride in the fact that we will always make it right when a customer makes an effort to show us anything that we did that needs repair. I hope you will share this letter with her and let her know we are prepared to take this to the highest level since she wants to be ridiculous and beyond human understanding of why she would go from A to Z when there's been no correspondence between us of any issue that we did a year ago. We take it, that she's trying to scam us for money and we take that threat very seriously and our lawyer has been contacted and informed us to hold and wait and see what other move she tries to make. We are prepared because we take people lying and misrepresenting us very seriously. Have a good day!

      Best,

      Complaint: 22125309

I am rejecting this response because:

First of all, you, as the contractor, said you would be reaching out to us with instructions on how to seal the pavers, which Im not sure why that was our responsibility to do but anyway, you never reached out. I did in fact, email you to inquire about this and let you know that the **** dish soap did not work and asked if you had any other advice. You were also supposed to reach out to us about a quote on adding rock under our lean to, but I also stated in that email that any further work, we would have to do ourselves as I had paid you almost my entire settlement.  That settlement, or frivolous lawsuit, as you claim, was actually a work comp settlement due to an accident at work that resulted in me with a broken knee. That also leads me to your claim that you KNOW I am a scammer and have a problem with suing people? The definition of slander is making false and damaging statements about someone. The pictures I provided show that what I stated is true and correct. Can you deny that the pavers had salt marks on them prior to installation? Can you deny that they were installed unlevel? Can you deny that you built a non-standard firepit with retaining wall rock rather than installing a firepit kit?  The firepit has been used 1 time so there is no abuse as you would like to claim. The pictures submitted were from YOUR Progressive Landscape ******** page (which you have blocked me from). The pictures show your workers next to the uninstalled pavers with salt marks on them.
Your website states you are licensed and insured. I would appreciate it if you could provide me with your license number so that it can be verified. I would also appreciate you submitting proof of my problem with suing people. I know that proof does not exist as I am a former Government employee,a Notary Public and I have a permit to carry therefore there have been numerous extensive background checks done on me. Since you have attempted to slander me with your comments, I can tell you that I have done my own background check on you from public records and have found that you are a convicted felon in the state of ********* with charges of theft, forgery, and fraudulent writings by a Corporate Officer. I think its obvious as to who the scammer is. I do not make statements without proof therefore the proof is attached. Now, who is the honest person in this scenario? Thank you for the ****** on researching who Im doing business with in the future.

This will be our final response to any correspondence about this situation. We find the additional letter that she wrote to you guys very repulsive and untrue. First those are not salt marks, those are dried concrete power that can be removed with a paver cleaner or a power washer and if you go to Menards they will tell you that it's very common and no fault of ours. What we find amazing it's been over a year since we have not had any correspondence with her.. specifically since August 15th 2013 in an email where she claims that she can't wait until we start on the project. There's been no correspondence of any sort about any problems with the patio or the installation of the fire pit which the contract clearly states it would be installed with Lakewood Retaing wall stone. She's trying to paint the picture that she has tried to work with us or contact us and there's been no contact at all in over a year until she wrote this letter to you guys. No contact whatsoever of any problem or any corrections that needed to be made. If there was any problem or any corrections that needed to be made we would have gladly made them at her request but she cannot produce one text message or email where she tried to correspond with us. She was informed on the final day that the patio needed to have a sealant applied 30 to 60 days after the paver locking sand was applied. She told us that she did not have the money to do that and they would do that themselves. We would have gladly done that if she wanted to hire us. And again I want to reiterate those are not salt marksshe's talking about, that is concrete dust that can be removed with a power washer or a paver cleaner. The patio and fire pit was installed to her liking and she was well pleased with everything and never made one complaint until one year later. Something sounds awful fishy and I want to reiterate if there was any problems we would have went out and made the correction. And she's got exactly what she paid for in the fire pit and the patio and the other landscape work that was done. Now we would like to offer to her if there's any chance on our end of settling this  we can go out and re-level any areas where she feels like needs to be reinstalled. We will even offer for free of charge a patio cleaning and a sealant applied which is over a $600 value package for free but we will not be giving her any type of money of any sort. And since she likes to Snoop around ******** and other things maybe she would like to look at our owners ******** page, Holy Felon. A book that he wrote some years ago of which he has said he would send her an autographed copy if she wanted it since she's so concerned about things that happened 20 plus years ago. That is the best we can offer we will come out and level any areas that need to be leveled we will power wash the patio and apply a sealant all free of charge. All she has to do is give us a call or a text or an email in letting us know when we can do that at her convenience. Again we want to reiterate we will not be communicating anymore unless it's about us coming out and fixing any issues and giving her a free patio cleaning and sealant application. We think it's atrocious that she has not tried to contact us in other words go from a to z trying to make out like we have tried to rip her off again we want to reiterate for the fifth time she has made no effort to contact us by phone call by text message or email. We smell something rotten in ******* and we don't like it but we are willing to bend in this situation by offering her these free services. We hope that she will take us up on this offer to remove concrete dust on her pavers and a sealant as well as leveling any paver that may have shifted over the course of a year. We hope she will take us up on this offer and we can put this ridiculous situation to rest.
