On 10/27/2022 I paid attack ****** for a deposit for my daughter to play volleyball for the club. Her mother paid an additional ****** the club had no contract or mentions on the web sight about refunds. On 11/13/22 I sent an email to attack asking for a refund because I felt my daughters academic schedule was too tedious for club volleyball. I was told I could only receive ***$ of the total ***$ we paid. **$ was for raffle tickets that are useless to me now that she's out of the club. I was told uniforms were already ordered so I couldn't have that portion. I asked if I could have the uniforms since I paid for them with proof of cost and when they were ordered and was told no and hung up on. The club has zero policy posted on its sight and no contract was signed. I feel I should receive my full refund.Business response

Business Response /* (1000, 5, 2022/12/07) */ Attack Volleyball discusses any requested information about our policies in the parent meeting that is offered during the player's tryout. The complainant either elected to not attend the Parent Meeting or did not raise any questions about the refund policy in that meeting. Per the **** Region USAV website, the fall commitment deadline is on 11/1/22 at 11:59 pm and that once a player has committed to a club, they should not tryout or accept offers for a different club. On 10/16/22, the complainant's daughter was offered a spot in an age group via email. In that offer, the parent was instructed to register through Attack's specific Sports Engine link to be able to accept the offer. On 10/26/22 at 12:13 PM, the player's Sports Engine profile was updated to reflect the acceptance into Attack. Please note, this was an active acceptance by the player's parent. On 10/27/22, the player's parents completed an in-person registration which included completing a medical release form listing Attack Volleyball as the participating club, making an active determination on any uniforms that were needed for the season, and making a deposit payment of $******; a receipt was provided, and it was noted that the remaining balance of $*** would be owed at a later date in the season. It is further assumed that parents would use due diligence prior to putting down a deposit. On 11/13/22, the complainant requested a refund noting that academics were more important than volleyball. This request was submitted after the 11/1/22 **** Volleyball Region deadline. On 11/15/22, the complainant spoke to the Club Director who noted that he would be willing to refund $****** of the $****** deposit that was made. The $****** that was withheld accounted for the $*** remaining balance on the player's account that was outstanding from the 2021-2022 USAV season along with $****** in uniform cost. At the 10/27/22 registration, the player's parent indicated that she would need two new jersey shirts, spandex, and a practice tee shirt. On 11/15/22, Attack Volleyball wrote a check for $****** to the complainant and mailed it to the complainant's home address that we had on file from the paperwork that was submitted with the player's registration. However, the complainant had neglected to inform Attack Volleyball that he had moved to a new address. On 11/28/22, the complainant was informed via email that he would receive the uniforms that were ordered once they were delivered. On 11/29/22, it was brought to our attention that the complainant's daughter had received an offer to play for another local USA Volleyball club. Further, a photo posted to social media on Friday, 12/2/22, confirms that the player did in fact accept that secondary offer and started practices with the other local club on Friday, 12/2/22. It appears that the complainant's rationale that academics were more important than volleyball was not the complete narrative behind the request for a refund. Upon receipt of the notice from BBB, Attack Volleyball was able to verify the complainant's address and re-mailed the previously issued $*** check to that address. A full refund is not appropriate as there was still an outstanding balance from the prior season, and the requested uniforms have already been ordered. Further, the initial complaint notes a deposit of $***; however, only $*** was received on this player's account.
