Purchased 2019 Case 580SN backhoe on 11/5/21 for $85,170.00. I was told that there would be a full inspection performed and free of defects and leaks. I also purchased the extended warranty. I paid for their arranged shipping and had shipped out of State to the farm in ********. I live in Arizona. When I arrived in ******** the machine would not start and had visible hydraulic leaks The machine was filthy dirty, was not serviced per manufactures recommendations. The hours were more than they had indicated at the purchase time and appeared that it had been rented after purchased and in their possession. I contacted Titan machinery immediately and made arrangements to have the machine picked up and delivered to there sister Titan machinery location in GI. ********. The ************ store did an inspection and found the machine in need of many repairs and over due maintenance services that were passed or neglected to disclose in the inspection report from the ********** ****. ********** falsely advertised the condition of the machine with pictures that were more than 2 years old of the machine when it was new. They falsified the inspection report or did not inspect the unit as the report was not accurate and needed more than $10,000 of repairs or maintenance needed according to another Titan Machinery inspection report. The manager is aware of these unethical and fraudulent inspection report. The pictures provided during the purchase process where also negligent and willingly false. The whole facility from the Manager , Sales and Service was dishonest in marketing and disclosing the true condition of this machine.I am seeking that Titan Machinery complete the additional repairs needed complete the repairs and service recommended in the amount of $6500.00. I paid for some repairs to stop oil leaks and to fix failed items in the inspection report. Some repairs are still needed. I would not accept the offer to take the machine back. Titan Machinery sold a used backhoe as is to ************ in November of 2021; providing pictures via text of hours and condition before purchase. In the middle of December ************ had some complaints about the unit and the cleanliness. The unit had operating hours put on it after it had left the dealership and in ************ control. Titan machinery then paid to take it to the closest Titan dealership, to repair and clean the agreed upon items at no charge. ************ was not satisfied that Titan would not repair all issues on the unit; Titan Machinery only repaired the agreed upon items. Titan Machinery offered numerous times that they would refund the full price back to ************.
************ declined Titans offer of a refund.
