This company stole photos of a truck I was selling and posted them all over the internet like they owned it or had permission. They didnt even ask.Initial Complaint

I purchased a vehicle from the business referred. It arrived in a much poorer condition than it was advertised. I refused delivery and sent the truck back to the sender on his transport and contested the charge with my credit card company. He has lied to the credit card company regarding the situation stating that the vehicle is still in my area when he is actively in possession and trying to resell it delaying the reimbursement of my funds.Business response

We are aware of a credit card dispute by one of our recent customers regarding the purchase of the below vehicle.

*** reached out to ** to purchase the above ******************** the listed pictures and description you can note that on the passenger side there is a dent and surface rust along the passenger side. *** at no persuasion or suggestion by ** elected to not come see the vehicle or pay for a third party inspection service. Instead *** decided to buy the ********** unseen and sign the as is agreement.
However we were made aware of the fact that when the truck showed up, the passenger side mirror was not there and the radio had been removed. We reached out to *** and told *** that we would love to get it to a mechanic to get these two things addressed. *** try to leave his truck in a parking lot but in order to keep the vehicle in a safe place we paid to have the truck taken to a mechanic where not only did we pay for a fresh tune up, but also have paid storage fees to keep the truck safe. *** initiated a dispute with his credit card company, in which master card has withdrawn the full amount he has paid and is reviewing the case. The means our business currently is out the full amount of money paid until the dispute is resolved. *** has not sent ** the title back. *** is the legal owner of this truck. *** signed as AS IS agreement and made the choice to buy site unseen. We as vehicle dealers do see situations like this arise. We try to never leave the customer unhappy, but there is reaching an agreement within reason, and then theres actions like *** has taken where we are forced to await to decision by a third party to resolve the matter. *** can at anytime pick up his truck from the Below address. The mechanic there knows that *** left the truck there and is is storing it safely until a decision is reached. *** has the title, *** signed the paperwork. We are more than happy to replace the missing side mirror and stereo that was taken from this truck. While this is not the situation we wanted to see, this does happen with automotive dealers and thats why on our website we offer solutions such as 3rd party inspections or for customers to come and see the vehicles.

I am rejecting this response because: It is a lie by the merchant. The delivery was canceled at time of inspection because the item purchased was not in the same condition guaranteed at time of sale. His advertisement and endorsement of the vehicle were both fraudulent and I have the pictures and video files of the merchant to prove the purchase and arrival discrepancies. If a salesmen is in fact credible, a third party inspection wouldn't be necessary at time of purchase. This is more proof to the unscrupulous practice of this merchant. Nothing was left abandoned. The delivery was canceled. This was performed in full knowledge and discussion with both the merchant and his delivery person/truck. The merchandise was left in the deliverers possession. At no time has my name been placed on a title, thus I have never assumed ownership of said merchandise.
