On June 30, 2022 i was recruited by a Kyani representative named ********************************* to join Kyani. I paid him a 1187$ membership fee via e-transfer. As per Kyanis policies and procedures I submitted a distributer cancellation form and cancelled my membership within the allotted 10 days for a full refund of my $1187 fee. After sending numerous emails, Kyani confirmed that my membership was cancelled and a refund was processed on August 1, 2022. ************************, as my Kyani sponsor, was subsequently refunded my Fee. However, neither he nor Kyani have sent me my refund of 1187$. I have attempted to contact Kyani and ************************ on numerous occasions over the past 7 months. Please advise what next steps can be taken to facilitate a resolution. I have attached the supporting communications with Kyani.Business response

Summary
********************************* met with ********************************* to enroll as a Kyani distributor on June 30, 2022. During this enrollment process, ********************************* signed a credit card authorization form which allowed for ********************************* to use his own card to make the enrollment purchase for *********************************. Because of the signed credit card authorization form that ********************************* signed, any agreement made between ********************************* and ********************************* regarding payment distribution or reimbursement would have been out of Kyanis ability to control, as any payment agreement would have been made between the two of them.
********************************* contacted our *********************** on July 28, 2022 to cancel his account with us and request a full refund. As per law, a full refund of $1,187.92 was issued to the same card used to make the purchase, which was a card used by **********************************Background
To enroll as a Kyani distributor, prospective distributors must enroll online and purchase a one-time, $36.00 CAD Kyani Welcome Kit. Alternatively, new distributors can purchase bundled products at discounted pricing in a variety of different business packs, which include the Kyani business license. Our records show that ***************************** enrolled to be a Kyani distributor on June 30, 2022 and made a single purchase of a Nitro Nutrition Pro Pack, for a total of $1,187.92 CAD including sales tax and shipping. The Nitro Nutrition Pro Pack includes a bundle of discounted Kyani products, including:

This policy allows distributors to receive a 100% refund of the value of any marketable inventory in their possession, less a 10% restocking fee, for up to two months after the date of purchased. Kyanis return policy also allows distributors to cancel their entire order without penalty (except shipping costs) for ten days after the purchase is placed.
As a courtesy, we have contacted ********************** regarding the allegations of this complaint, and have asked him to provide ********************************* with a direct refund. Additionally, we will be investigating this matter further to determine whether any disciplinary action is warranted against ***********************

I am rejecting this response because: Although I appreciate Kyani's effort to contact the sponsor, I have not received any communication from the sponsor, nor a reimbursement of the monetary amount that he was refunded by Kyani on my behalf. Since the sponsor continues to be unresponsive I would like to know my next options for recourse in order to rectify this matter and receive my refund.Sincerely,

We have contacted ********************** regarding the allegations of this complaint and have asked him to provide ********************************* with a direct refund. Following the rejection of our previous response we spoke with ********************** and was able to receive confirmation from ****** that he has initiated a direct transfer to ********************** for the full amount of $1,187.92.We have reached out to ******* to continue and work on confirming the final transfer of the full amount an refund. Additionally, we will be continuing an investigation into this matter further to determine whether any disciplinary action is warranted against ***********************

I was approached by a stranger on social media, ********************************* who lured me into joining a company called Kyani on June 15, 2022 after his enticing, too good to be true presentation at a local ********** ************************ took my credit card and charged $1,187.91 for me to join Kyani as a business partner. I did not sign or receive any documents and was not given a receipt. Just hours later, I began to realize that this type of business involves aggressive recruiting and selling tactics which I don't have the personality for and don't interest me. The same day on June 15, I advised ************************ that I did not want to pursue this and politely requested a refund, but he asked me to meet him the next day to fix the situation. When I did meet him on June 16, 2022, he insulted me for wanting to quit and told me the only way out would be for me to find someone to replace me or sell all of the products in the starter kit that cost $1,187.91. I have not received this starter kit yet and obviously don't want it. Is there any way you can please help me get out of Kyani and get a refund? I'm 18 years old and these were my hard earned savings. I don't know where to turn since my only contact is ************************ who obviously doesn't want to help me. Thank you.Business response

Summary
We are happy to report that ******************** is eligible to return any unused product still in a marketable condition for a 100% refund, less a 10% inspection and restocking fee. ******************** enrolled with Kyni as a distributor and is entitled to the benefit of our exceptional two month return policy for all distributor purchases. Products subject to the repurchase guarantee must be marketable, which means any unused product which has not expired, and is still in the original packaging.
Background
Kyni strives to provide quality nutritional supplements to its customers, which it sells both directly to consumers and also through a network of independent distributors,who earn commissions on sales they have referred to Kyni. Kyni offers its distributors video training,product information, sales materials, and other resources to assist in building their Kyni business. All of these resources are available to ********************, 24/7 by logging into his Kyni account.
To enroll as a Kyni distributor, prospective distributors must enroll online and purchase a one-time, $36.00 CAD Kyni business license. As a Kyni distributor, ******************** (Distributor ID ********, entered into a contractual relationship with Kyni. The contract,known as the Distributor Agreement consists of two parts: 1) the Policies & Procedures; and 2) the Terms and Conditions. When ******************** enrolled, he affirmatively indicated that he had read and agreed to the terms of these documents. These documents were available for him to download during registration and anytime thereafter through her Kyni account.
Relevant to *******************, Section 7 of the Policies & Procedures outlines the Return Policy, which is also detailed on the invoice he received with his order. At Kyni, we are proud of our industry-leading buy-back policy, which allows distributors to get a 100% refund of the value of any marketable inventory in their possession, less a 10%restocking fee, for up to two months after they purchased it. Kynis return policy even allows distributors to cancel their entire order without penalty (except shipping costs) for ten days after the purchase is placed.
As a one-time courtesy, we will issue a full refund to the credit card used to make the purchase. In addition, we will contact ************************ regarding the allegations of this complaint to determine whether any disciplinary action is warranted.

I have reviewed the response made by the business in reference to complaint ID ********, and I thank you.I am happy that Kyani will fully refund me however, something in their response is not entirely clear. Will I be refunded only if I return the bundle of products? The problem is that I cannot return the products because I never received them. As you can see from the attachments, the products were shipped to ***********, G6L4K4 CA on June 22, 2022. I have no idea where *********** is nor why ************************ had the box sent there. I suppose he would have handed me the box of products in person at some point? Before I accept Kyani's response, I just want to be sure that I don't have to ask ************************ for the box in order to return it and then wait for the refund. So far, my credit card has not been refunded.
Please let me know if you can help me get clarification on this.Thank you,
