AFTER MAKING A DONATION IN 2019 BUT NEVER OPTING-IN TO ANY EMAILS, THIS ORGANIZATION SUDDENLY STARTED EMAILING ME -- ASKING ME TO DONATE. THIS IS A VIOLATION OF CAN-SPAM. THE WOMAN WHO RESPONDED IS THE ***** CHAIR, BUT DIDN'T EVEN ANSWER MY SIMPLE QUESTIONS. I EMAILED THE PRESIDENT AND OTHER EMPLOYEES, BUT NONE OF THEM RESPONDED EITHER.Business response

CAN-SPAM Act exempts transactional or relationship messages. In other words, if someone makes a donation and gives you their email address, you are free to email them, even without expressly stating that you will email themTCustomer response

I am rejecting this response because: there's no "transaction nor relationship" when the purported transaction was 4 years ago and there's been no relationship since that time.

I have attached the email in question. It clearly is an informational email sent to inform our current and past donors and clearly has the required opt-out/unsubscribe link.
************** (not Dr.), has continued to harass our staff with these unfounded claims at our place of business and at their private residences. We are a law firm and are well within our rights to send that email (and as a reminder, the only email he, as a donor, has ever received).Customer response

I am rejecting this response because:(1) CAN-SPAM Act exempts transactional or relationship messages.
* when I point out there's no "transaction nor relationship" when the purported transaction was 4 years ago and there's been no relationship since that time, you now provide a different response that "It clearly is an informational email sent to inform our current and past donors and clearly has the required opt-out/unsubscribe link"...but it also mentions/seeks donations. My original query was to understand why your 'firm' would suddenly, after 4 years [as you state this was the first email] start emailing a past donor and seeking a new donation when that donor never opted-in and/or you've had no previous contact
* ************** (not Dr.): because I do have an earned doctorate (Ph.D. in ************************ 2007) your statement appears libelous.* "harass our staff with these unfounded claims at our place of business and at their private residences:" Either provide proof that I purportedly contacted your staff at their private residence, or issue a written retraction; else, your statement appears libelous.
