Dear Customer Relations Representative:
Please accept this as a response to ***** ******* complaint assigned the captioned ID number.
On June *******, I was retained by Mr ***** to represent him in a legal malpractice case against the attorney who represented him in his purchase of the property commonly described as *********************************************. Mr ***** explained to me that he told the attorney that the subject property was unimproved and that his intention was to build on the land. Mr ***** also told me that he learned after the closing that the land was worthless to him since he could not build on the land. After I examined the documents pertaining to this sale as well as communications between Mr ***** and the attorney and noted that the attorney was indeed informed of Mr ******* intention to build on the subject property and that the title policy commitment listed an exception that the property was restricted from building purposes. Consequently, I informed Mr ***** that he had a valid case against the attorney.
After attempting to contact the real estate agent to confirm the property was worthless and examining additional documents and confirming with Mr ***** that the property was worthless, suit was filed on July ****** alleging that the lawyer was guilty of professional malpractice for failing to recognize that the title commitment has an exception stating the property was restricted for building purposes.
On September 12, 2024, the defendant attorney offered in settlement to pay Mr ***** for the entire purchase and closing costs of the property plus the real estate taxes Mr ***** paid from dat
Very truly yours,
***** *. Smolin
