      So they did a deck roof for me a couple of years ago was satisfied with the work but called recently due to one of the support beams is bowing out. They came out I was told I would get a quote. Called to follow up and no response. I also that they had a longer warranty their work than what I was told.

      In late fall of 2023, ****'s construction removed and installed a new back porch. I noticed a few things that needed to be repaired and was told it was too late in the season, and since I have a 12-month warranty they could fix it in the spring of 2024.I reached out to Manny *************), @ ****'s Construction in the spring and created a list of items that needed to be addressed. I traveled a bit for work and was back in ******* in May. We had another conversation regarding scheduling and now I do not hear back from him or ****'s Construction after several messages.1) The deck is NOT pitched and installed correctly.2) The stair stringers are not cut correctly. Stair treads not touching he center ******** and are NOT pitched correctly.3) The cement stoop/ step is 2" shorter than the other stair treads 4) The cement stoop edge was NOT rounded. Sharp edges are prevalent.5) Splitting wood. Should replace.

      ****'s Construction Company was initially called to repair a hole in our homes addition which had water pouring in when it rained. In talking to their representative after a sales pitch and consultation, he assured us that replacing our gutters would solve the problem. It didn't and after conversation a repair job turned into a $30,000 project which included a new deck, new stairs and a new porch. No mention was made of the hole in the ceiling which was our main concern. We are not necessarily dissatisfied with the deck, porch and stairs that was not concern. They finally did get around to repair the ceiling, which is attached to the addition, but after the 1st rain it continue to allow water to pour in. But they did repair the ceiling, but the problem is still there in the same place. The representative now contends that we need a new roof and he no longer returns our phone calls or text messages. The 4 items that ****'s Construction is aware of is: 1. lattice coming apart from the deck because stapes were used to secure it and they were insufficient; 2. crack in the wood post and they assured us that they were using top quality wood; 3. the foundational support for the tent posts was not sufficient to support it and 4. repair of the leak in the sunroom (house addition). If a new roof (over the entire house would not include the addition of the sunroom because these are two separate roofs) was needed why didn't they do that before doing any other work. They assured us that we "needed new larger gutters and that would take care of the problem".

      Mikes Construction, ****Has been in business for over 30 years. During these 30 years we have built thousands of projects with happy customers. Our rating with the Better Business Bureau is A+, because we give 100% attention to detail and customer service.
      On July 19, **********************************************, **** signed a contract with Mr. and *********************, at ********************************************************************************. The agreement was for Mikes Construction,**** to do the exterior projects, please see the attached contract with details and specifications which does not mention any roof repairs on the house/building.
      The exterior project was to install new gutters and downspouts, new trim for 2nd floor door and a new awning above this door, garage roof work, new rear stairs and deck,ceiling repair in the rear addition, install new ceiling fan for the rear addition. The contract does not mention any roof repairs on house/building.
      The job was completed 100%and the customer was very happy and paid us in full.
      The project was completed by skilled, experienced, and professional workers using the proper materials and equipment.
      When we did the original work,we also did an additional work, beyond the contract, we installed aluminum trim for the 2 garage doors, we cleaned and installed and installed additional gutters and downspout for the front porch, and we were promised to be paid for it, but did not get paid.
      Few months after completing the contract, we were contacted about the leak coming on the kitchen ceiling area, far away from the gutter work that we performed.
      I stopped by on the jobsite/went on the top of the roof and I checked the condition of the roof please see the attached pictures showing the poor condition of the roof.
      After assessing the condition of the roof, we notified the customer at the end of August 2021 about the poor condition of the roof and the leak coming away from the gutter work (which we performed) and the customer was provided with the price for rubber roof layover for the building in the amount of $14,000.00 as a solution to resolve the leak problem. The customers said that they will notify us if the want to do the roof.
      In the fall of 2021, we asked the customers few times if they are ready to proceed before the bad weather/fall/winter comes. They told us that they still did not make their decision, so we did not sign any contract with them.
      On February 23, 2022, we signed a new contract with the customer for a small repair work to install small kitchen cabinet above the stove and the installation of the micro hood provided by the customer please see the attached contract. I would like to mention that this small repair project was completed, and the customer still owes us $700.00 as a final payment using the reason for it the not fixed leak on the roof, which was never entered to the contract.


      Regarding customer complaint about:

      1.
      Lattice on the deck coming apart.
      We never got any notification from the customer about it, in the office or email (which is provided in the contract) and this is the first time that we are hearing about it.

      2.
      Cracks in the wood post.
      We are using the wulmanized treated lumber for the exterior projects, and the lumber is treated with the chemical substance to prevent from rotting in the exterior conditions. It is typical for the treated lumber to get the cracks please see the attached brochure on this subject.

      3.
      Foundation support
      We never got any notification from the customer about it, in the office or email (which is provided in the contract) and this is the first time that we are hearing about it.

      4.
      Repairs in the sunroom house addition.
      The building needs a new entire roof layover. The proposal for it was provided to the customer last year. The price quoted is not valid anymore.
      This project was never a part of the original contract.

      RESOLUTION:
      Please dismiss this complaint based on the information above and the pictures and the documents attached.We did everything that needed to be done on our side, (and we did more and did not get paid) that was related to our contract. The customer received goods and services that match the contract at the time of purchase.
                  We will not be doing any additional work for free if it is not in the contract because we did not get paid for the additional work that we did with the original contract and we did not get paid final balance the newest contract on small repairs from February 2022.
      We would like to ask for the immediate payment of the $700.00 which a balance of the small repairs contract, to avoid placing the Mechanical Lien on this property.

      I am rejecting this response because: They didn't say that they are coming to repair the ceiling. The ceiling that was repaired in August leaked in December and there were immediately called, they came in February after the snow had melted two that they "could get a better look", they saw the damage and didn't set up a day or time to repair the ceiling.  This was six months after they completed the work that the ceiling once again leaked - not even 12 months! They will not return phone calls. If our calls were returned we wouldn't be reaching out to Better Business Bureau for help! We are at the same place we were before they were contracted for work to repair this issue.  We didn't ask for new gutters we were told that what we needed to resolve this and that wasn't true.  A lot of communication was "verbal" so of course it wouldn't be written in the contract. However, the original reason we contracted was to get this issue resolved and depended on this company to make it right and it still has not been corrected.
