      On 12/3/22, the owner ********************* of Dyer Auto Finance approved me for a 2018 ******************************************************** and he asked for $2500.00 cash down payment in which I paid, then I signed the paperwork. Then he said he needed to add a kill switch on the car which wasn't originally discussed and he finished the deal. After leaving with the car **** started texting me additional request for the car. Then a few days later he started texting and calling me aggressively demanding I call him back even though I'm at work and in meetings. He also requested another $500.00 down payment and said we could do that every other Friday via ***** to his bank account and that the finance company is going to call me to confirm the sell of the car and that he needed me to say I put down $4500.00 instead of $2500.00. I disagreed to lie as that was dishonest and bank fraud. I read the retail installment contract and saw he wrote I put $4500.00 down payment which isn't true. I told him I would not lie to the finance company which is fraud. He got angry and began yelling and arguing with me, then continued to text me bullying me to comply and threatened to take the car back. I contacted the finance company, **************** at ************ and told **** about the fraud and **** informed **** that the car deal was off. 12/16/22 @ 12:11 p.m. I received this text: Good afternoon Ms ****** My name is *** from dyer auto finance. **** is off today and the finance company called here and said that the deal is being returned. So if you can call us at ************. I called and *** told me **** wanted me to return the car. I contacted the ******* Police to meet there to keep the peace and ensure he refunded me my full $2500.00, which he argued, was very combative and refused to do. Instead he only refunded me $1900.00 cash and he kept $600.00 for himself. Due to his fraud matter, running my credit as a hard inquiry and decreased credit score, poor customer service and a huge inconvenience of having to return the car, plus having to rent cars for work, I am demanding my $600.00 back.

      Everything was explained to the customer at the day of sale and was agreed upon 

      thats why we delivered the vehicle to the customer ,it was also explained to her that the financing company needed to do some verifications to finalize the financing process , we did give her some time to cooperate and when we contacted her about it she said that she did everything and that she has no time for this and she hung up the phone on us a few times in the middle of the conversation she requested that she wanted to return the vehicle after she had it for a week and wanted a full refund ,we told her that we would have to make sure of the condition of the vehicle and the miles she put on it 

      Customer came in with the vehicle and had called the police which is perfectly fine because we are not a hostile business

      All we wanted to settle the situation either way ,our policy is we charge per mile if a customer decides to return the vehicle 

      Her down payment was $2500 we refunded her $1900 and charged her $600 for the

      miles and restocking fee which she also agreed to that and police was present for that as well 

      we also have a signed document from us and the customer that it was settled 

      we dont take anyones money just to take we only charged her for the

      miles that she drove the vehicle if she cooperated everything would of been fine

      I am rejecting this response because:

      The owner, **** is a liar, cunning, manipulative, unethical and according to the Bill of Sale, he committed financial fraud and wanted me to partake! He committed fraud as the Bill of Sale clearly indicates I paid a $2500.00 cash down payment and he wrote $4500.00 instead. Then a day later after I purchased the car, he started calling and texting me aggressively, demanding I take his calls no matter what I'm doing, when I'm working etc. to tell the finance company when they call that I paid a $4500.00 down payment instead of $2500.00. I looked at the paperwork and saw where he wrote $4500.00 was the down payment, which was not true at all. I tried explaining that was financial fraud and I have no interest in lying as what he was doing is a crime, and I want nothing to do with this. He grew angry and started yelling at me. He kept calling me arguing and getting loud, demanding and upsetting me, telling me to take the call when they call no matter what I'm doing and to take his calls whenever he call and text me.

      On the evening of Wed., 12/14/22, **** called then started texting me @ 4:34 p.m. while I was driving on the highway to my jobs Christmas Party. I told home I could not speak at that time; that I was running later to my jobs Christmas party; that it was very dark and pouring rain on the highway and that is was not safe. He was rude, combative and arguing at me the whole time on the phone. His text said: Hello good evening the bank just needs to conduct the customer interview with you if can give them a call The number is ************ I texted: I tried call already. Please understand I've done my part. I'm very busy. He called and grew aggressive and refused to listen to anything I was saying. I kept saying I was driving and could not talk as it was not safe. He kept talking loudly over me refusing to hear anything I was saying.  I stated that I needed to hang up, that a Police was behind me, then the police shined his light into my vehicle and pulled me over to the shoulder. I had to hang up as the Police was approaching my window and right after the Police left I sat on the shoulder of that dark and dangerous highway in the pouring rain and called him back, and I told him that the Police just pulled me over because I was on my phone talking to him. I told him via text message and verbally over the phone why I had to hang up and this was the only time I ever hung up the phone on him so he lied as this is a pattern behavior. This was the only time I ever hung the phone on him. I even took a pic of the dark highway and pouring rain from the shoulder and texted it to him right away as proof because he is very hostile as he kept texting me rudely and combative calling me unprofessional saying "That was unprofessional to hand up Thank you. I texted: "I'm on a highway It's not unprofessional then I texted him a pic of the dark rainy highway as proof because I'm not that person who hangs up the phone on people, he is! I'm a good person with high empathy. I treat people with respect and the way I would want to be treated. pulled over on the shoulder of a highway and while on the call I told him that it was not safe as eighteen wheelers were passing me driving over 100 miles per hour, rain was splashing onto my car from trucks, and my car was shaking and rocking from the truckers high driving speed; that I could have been knocked off the road in a crash. He refused to listen, talking over me loudly and combative, arguing in an abusive tone. I started to go the Police Station to report him and get assistance to ****** me back to return the car as I wanted nothing further to do with him!

      This was a horrible car buying experience resulting in the Owner, **** committing financial fraud and he was trying to make me commit financial fraud with him by lying to the finance company as he told me what to say. The finance company called me to conduct the customer interview and they asked me to confirm my down payment of $4500.00. I explained everything about ****'s fraud; that I only paid a $2500.00 cash down payment, not $4500.00; that the Owner, **** wrote $4500.00 down payment on the Bill of Sale and told me to tell you I paid $4500.00 down payment instead of $2500.00. The finance company thanked me for my honesty and then apologized for ****'s fraud, then asked me to return the vehicle back to Dyer Auto Finance as the deal was off due to financial bank fraud. The finance company (****************) told me I was entitled to receive back my full down payment of $2500.00 as this was fraud, an inconvenience as a customer and **** cannot profit from this fraudulent sale. Due to his constant combative behavior, I did not feel safe to meet alone which is why I contacted the assistance of the ******* Police. **** was very combative in front of the ************* showing zero respect to Law Enforcement as he threatened me, acted out, refused to refund me my full $2500.00 while saying he loves going to Court as I stated I would take him to court to recoup my $600.00 he kept which was illegal. He stated in front of the Police he loves going to court. I plan to file a lawsuit in Small Claims Court and complaints with various consumer and legal organizations so no other customer is made to commit financial fraud every again. His dealer license should be revoked and his business should be shut down for good!

      perfect example is her response to ** with insults ,we do not disrespect any of our customers in any way  we do not force customers to purchase vehicles from us she had came to us to see if we can assist her in purchasing a vehicle  ,we explain everything to all of our customers the day of sale ,she agreed to everything and signed paperwork . *********** are ready
