Contractor *************************** of Next Level Surfaces was hired to do an overlay on my patio, repairing a damaged corner, and obtain an estimate to fix my foundation issue. He did not mention the patio might need to be removed to fix the foundation. He stated he could repair the patio, at $1500, mentioning no concerns or other options. Ethically, he should not have done the work knowing the patio might need to be removed. In addition, he messed up the foundation work, and it now needs tore out & redone (separate issue). Regarding the patio work, he did not prep the patio properly (only powerwashed), poorly fixed damaged area, and merely put a slip coat on the patio, with no sealant. After completing, it was obvious the concrete was not mixed correctly, extremely thin, & would not hold up. I immediately brought it to his attention. He stated he would be back out to fix it come Spring. Come Spring I contacted the contractor multiple times asking to rectify the situation, with no response. My last attempt was in an email June 23rd, which he responded he would be out that week. Come the end of week, he did not show. After conversing he stated he offered multiple times to come fix the patio, which I have no record of. When I asked one last time for him to rectify the situation, due to what sounded like miscommunication, he responded with telling me not to contact him and that was a temporary patio fix. I have had 3 other contractors state the patio was incorrectly done. An overlay was not done, which requires multiple coats. He just put a slip (water/concrete) mix on the patio, which is not an overlay. In addition, the workmanship is extremely poor. Now I have to have my patio tore out to fix the foundation, which the contractor knew, and it cannot be fixed. I would like a reimbursement for the patio. Attached below are photos of the patio prior, immediately after, and less than 6 months later.

Work was completed in 2022 repairing a chip caused by a siding contractor.  Since it was unclear which one of the chips it was, we coated the whole patio for the same rate as patching a specific chip (half day rate for crew).  The surface was diamond ground and scraped, pressure washed, and coating applied per manufacturer specifications (single coat product).  Adjacent walls were taped and covered with plastic.  ************** was not disturbed during the process.  This was a coating of an unattached patio.  Attempts were made to resolve consumer complaints.  We do not warranty other people's concrete work when coating existing concrete.  Due to business safety policy, there is nothing further we can do to assist.

I am rejecting this response because:

No attempts were made to address the issue. Contractor stated he would be out in spring to redo. Contractor could not be reached from that point on. An overlay was to be done to the entire patio, see receipt. No overlay was done. An overlay requires a certain depth. Photo shows no depth and poorly mixed, which resulted in cracking. No other work had been done to the patio prior, nor were there any other chips on patio prior. Nor did contractor ask for clarification when doing said overlay. Contractor did not do the work he was paid for.

Correspondence continued with consumer through July of 2023.  Attempts were made to resolve consumer complaints.  Due to business safety policy, there is nothing further we can do to assist.
