      We contracted with Noble Home Improvement (Contractor) for the construction of a 14 octagon deck and gazebo for a hot tub. Contractor built the deck to size, but then placed a 13 gazebo. The gazebo leaves an 18 unusable ledge around the deck, sacrificing over 50 square feet of deck space, and makes for insufficient clearance between the hot tub and proposed railing, so one cannot walk around the hot tub. The gazebo posts have been screwed into the deck board only without proper support, and many of the posts are not level. The deck was built with a support structure for a 14 gazebo, indicating that the gazebo placed is clearly an error made by Contractor, and should be remedied at Contractor cost.We provided $17,000 at the beginning of the project for raw materials. Approximately $7,500 has been spent on materials and electrical to date. We expressed displeasure with the inadequately-sized gazebo and requested that Contractor replace it with a gazebo of proper size using available funds. Contractor declined to do so and advised us to seek legal action.We then offered to pay Contractor for the deck construction and electrical, while Contractor removes the gazebo at his cost, and terminate the contract. We offered a project value for the deck of $12,000, which includes deck materials, electrical, labor and overhead, and an additional 10%. Under this proposal, Contractor would refund $5,000 to us. Contractor has declined this offer and instead is requesting an additional $900 over what we have already paid, for the deck build alone. To defend this, contractor has inflated labor costs for the deck only to be 50% over the original contracted labor cost of deck and gazebo. We requested proof of the stated labor costs, but Contractor will not provide it.Contractor has mis-managed this project and has been evasive and dishonest as we have attempted to come to a fair resolution. He has said further discussion is a moot point.

      Mr. and ***************** have expressed dissatisfaction with the gazebo portion of a deck and gazebo contracted for.  On the original contract, a picture of the exact gazebo is displayed.  All work on the deck and electrical is finished and with no questions.   The only work left is to finish plumbing and securing the gazebo posts and add the railing. This is a manufactured gazebo that well-made and strong enough to withstand wind and weather. We have installed these before and are confident in the structure.

      Once the deck was finished and prior to building the gazebo, I walked **************** around deck and showed him where 13 gazebo would sit; at that time, there was no objection.  Our crew of four men had no problem walking between hot tub and gazebo during construction. Even when the Putmans  laid out railing, there was still had no problem entering area, walking between the hot tub and gazebo and there was enough room to remove the covering and place it at the back of the gazebo.   The area of concern is that they want 6 more inches on each side between hot tub and gazebo. 

      I have found that the Putmans have taken several liberties with their statements and attempts to tell me what the labor, materials and overhead costs are.  With a deterioration in discussions, we recommended mediation through the Better Business Bureau.

      Noble Home Improvement has years of superior service through the Better Business Bureau and the **** company as documented by customer testimonials as well as being a preferred contractors with Indianas largest realtor, ********************** This is a rare situation that cannot be remedied with Customer and we have acted in good faith in detailing the disputed credits. 

      Attached is a simplified Project Summary Costs for materials and labor. We have offered to refund the cost of the gazebo, labor for the gazebo and railing cost in the amount of $ 5,598.00. That refund, along with their deposit of $ *********, leaves a balance due of $ ****** for the entire project cost of                                        $ 23,500.00.  We will properly remove the gazebo to ensure that no parts are damages as well as remove all railing materials in their original unopened boxes to also ensure that they are not damaged.

      We are in agreement to credit the cost of gazebo materials and labor as well as the railing cost. The completed deck and electrical portion of the project are not in question.  The Putmans have been supplied with all project material receipts that are reflected in the complete Summary of Costs cover page.    For this response, I have included the receipts for the gazebo and railing to substantiate the specific costs in question.

      We ask for a review of these costs and find that the credits for the gazebo and railing satisfy the objective of the complaint.
