      The transaction date is August 31, 2022. The repairs were complete; however, the dispute is over the property damage to our back deck that happened from the workers Clearcoat Roofing sent. They put a tarp down and threw the shingles on the tarp and then drug the tarp off which left a huge deep scratch across the deck. They admitted the damage and ******************* from Clearcoat Roofing came out to see the damage and said that they would fix it. They tried some kind of filling along the scratch and then used their shoe to smear it, then in November **** sent out one of the workers to replace the decking. They pulled up the some of the boards and replaced them with a darker gray. They left the deck boards loose, with gaps, a foot size hole in one area, the railing totally off or loose and he never returned until May. **** said he hired contractors to do the job and so he was not responsible, then he said he would only replace the top of the deck. The problem is the color of composite boards we used are no longer available. The entire deck has to be replaced to match. I don't want the deck two different colors. The deck was a light gray which matched our house and front porch. Now they have to use a dark gray. The top of the deck is 16 foot composite boards and then you have the finishing boards which are the trim, steps, and skirting that should match. **** has had a couple guys out that have replaced the top but then the edging boards are even a darker gray than the dark gray. I ended up having to pay the guy working $250 for his labor hours and he said he would be back after exchanging the wrong darker boards with the correct boards. It has been almost a week and our deck has not been touched. I want it all the same color even the edging, steps and skirting. I would think that when property damage occurs there is a breach of the contract. We received an invoice for the remaining $1000. I would rather take the $1000 and get our deck fixed ourselves.

      In response to this complaint, I would like to state that I personally have been ****** attentive to this situation since day one. And the homeowner has been very transparent in showing that I have been repeatedly responding to their requests, repeatedly replacing more and more of the deck that originally had 12 damaged boards on it. This went from me agreeing to replace 12 boards to them demanding the entire deck to be dismantled, and rebuilt over 12 scratched boards. We have come to multiple agreements that I replace 45 boards, to replacing just the top, and then they didnt want to pay the remaining balance once we did do that so we filed a lien in the property and had our collections attorneys file civil lawsuits against them to collect the money owed for previously completed trades that the homeowner even stated in this complaint that we successfully completed and did a great job. We recognize that there was damage done to the property and have taken action to fix it. This is going on almost a year of attempting to facilitate this customers requests and trying to meet their expectations for their deck. We finally said we are not going to replace the entire deck after he hired our contractor under the table and refused to pay him saying **** agreed to pay you, so call him so he stiffed a kid out of his money that he worked hard for and now is complaining publicly that I am not doing enough to resolve this situation when I have sent crew after crew after crew out there to please them and its never enough. This went from 12 scratched boards to 45 board that we agreed upon, to the entire top of the deck that I again agreed upon, to now the entire deck. Which is where I said no. At what point do you stand up for yourself seeing that you are being taken advantage of when the homeowner consistently demands more and more after meeting an agreement with me. We are still waiting on their trim boards to come in since these are all special ordered materials that hes requesting. So yes, the deck is not quite completed at this time since we have no trim boards to install. All parties have stayed in contact with the homeowner on the situation and today we get this attempt to slander our names publicly on a public forum. And I still intend to have our contractors install the trim boards once they are in and can be installed. I hope this puts some clarity to the situation and potential clients will read into this seeing that as the owner of the company I have attempted to do everything in my power to please my clients, but when do you have to say enough is enough. We want paid for the work we completed, and so does the kid you hired under the table and refused to pay as well. The top of the deck will be completed as I agreed to since it was the homeowners request, and now apparently its the entire deck that needs done. We will not be replacing the entire deck, we will complete the top of the deck as requested. And we will pursue our small claims case to collect our remaining balance that is rightfully owed to us for work completed. I hate this part of what I do for a living because I try so hard to help people, and this is the reward I get for months of attempting to help them. If you have any questions about this situation please feel free to personally contact me and we will disclose the details of the entire situation of what happened here. We have nothing to hide and we are not ashamed of how we have tried to resolve this issue at any point.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

      I do not agree that it was only 12 boards.  It was from the door all the way to the water hose box as seen in the pictures.  If you look closely at one of the pictures showing the hose box you can see the smear marks from them trying to use filler and the light gray boards they replaced.  Plus, it has mostly been me reaching out to **** for an update and this has been going on since the end of September.  I have tried to be patient but now it is almost the end of June and still the deck is not complete.  Plus, **** never told me that the correct color edging boards had to be ordered.  The edging boards they put on it are not the same dark gray.  The deck was all one color so asking for it to be fixed all one color is not unreasonable.   The men were here completing the work on Wednesday, June 14th and then left stating they were going to get the correct color boards.  I reached out to them on Monday and they were waiting for **** to get the boards.  The top edging needs to be complete and the railing needs to be put back together.   We have not been able to use our deck since November when they came out and dismantled it.  We have 4 grandchildren that are with us all the time and easily could get injured from falling off the side.  I agree that it is an unusual situation because the boards are discontinued and if that was not the case then this would have easily been resolved.  I am tired of this back and forth.  We want the deck fixed.  If **** is willing to complete the top deck and the steps all the same color by the end of June then I will change the skirting out myself.  I will pay him the last $1000 of the invoice the day that is all complete.  If this is not agreeable then we can move forward with our attorneys and court.

      We have all intentions to finish the top of the deck in the same color as we agreed upon when I was out there last. That is why the gentleman who were there last said to you that they will be back with the correct colored boards. We want to fill your request and get this done how we agreed upon. If the color was readily available, then this would have been done already, but I was not so lucky to have that opportunity to walk into the Lowes and just grab the boards that we needed. As we both said, it was less than $200 worth of materials left to get the rest of the deck completed, and I have zero issues getting that done! The guys still are going to put them in, and the deck will be the same color on the top just as you requested and have continued to request. If I could just go get them and put them in myself, I would be doing that today! Sadly as we know the original color was discontinued, and the one we are currently using isnt the easiest to get our hands on either. The end boards that have the rounded edges are more of a rarity than the 16ft slatted ones that I can just show up and walk out with. 

      In conclusion, I am going to complete the top of the deck all in the same color just as I have said all along. I am sorry that its taken a few days to get them in, but that doesnt warrant getting online and having the Better Business Bureau facilitate this conversation. Ive been trying to make you happy for almost a year, and I am almost there. We are so close to having it completed, and we never once have indicated that we were not going to get to this point. I am a man of my word and I have continued to show this by staying in contact and promising exactly what you have asked. I wish it happened sooner, but not everything in life is in my control. 

      none the less, the top of the deck will be completed in the same color m, and it will be done in a timely manner. We should have these materials in soon. I will update you as soon as I have them in, and Ill have them delivered to the property. The crew will be there within a couple days of them coming in. I am sorry this has been such a drawn out process, but again, I cant control everything in life, all I can do is push as hard as I can to accomplish the best result possible.

      I checked on the boards at Lowes and they were in stock three weeks ago so I got online today and the correct boards are still in stock and can be picked up.  I drove to the Castleton Lowes and they were in stock.  I took pictures and attached them here.  I am not saying you did not order them but I am concerned what boards were ordered since the last time someone picked up the wrong boards.  These boards at Castleton could be picked up today and the deck could be complete by the end of the week.  FYI it looked liked online the boards are even on sale.

      I texted you while at the store verifying color and quantity and you have officially said you have had the repairs completed by someone else and you want this dropped and do not want to pursue any legal recourse. So lets leave this alone since the deck is fixed and youre attempting to walk away cleanly as am I. I feel we have both made it clear this is over the top - and now the only communication youll have with me is on a monitored BBB app. Fair enough so they can moderate the conversation and see my extreme over the top efforts to appeases a client that is frustrated - and reasonably so. This has taken a long time and I get it. So lets be done with this and end it. Its over with.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

      Since **** was still waiting on the boards he ordered to come in at Lowes, I looked online and found that all the surrounding Lowes had the edging boards in stock that he ordered. (Look at the pictures I previously posted in my last response). On July 2nd, I went to the *********************** and picked up the edging boards needed to complete the top of the deck.  It took both Sunday and Monday labor, but we were able to entertain again for the Fourth of July. We did not have to worry about the kids falling or jumping off the side since the railing was off or loose since the fall season.  (Look at previous pictures).  I did have to replace some damaged parts of the railing because they were left on the ground for so long.  And if you see the attached picture, a 16 ft top board was installed with a gap and hole even though they cut it incorrectly. 
      **** texted me a few days after the fourth of July stating he was in Lowes to get the boards unless I already had it fixed.   I told him it was.  I was willing to just let it be.  It ended up costing me way more than I expected to fix a deck that was just a few years old.  By ****'s last response it was over but that was not the case at all.
      The picture I attached shows you that we had a beautiful deck.  I loved the color and my grandchildren were on it all the time.  I don't care if his employees scratched one board or all the boards, they should make the deck just as nice as it was before they scratched it.  He thinks that we were over the top but who in their right mind would replace the center of a deck with a darker color and think that is okay.  I have been a contractor myself for almost 20 years and never would I have done this to a customer.  I carry liability insurance that covers unfortunate mishaps.  When a contractor works for me,I make sure I have a copy of their current liability insurance.   I have never had an issue in all these years. 
      Just the other day, there was a company that was working near our drive and got ********************* all over my truck.  They came to the door and told me what they did and were willing to have my entire truck repainted if necessary.  They could have easily said sorry we scratched it but we are only going to paint one side.  And by the way, they don't make your color anymore, so half your truck is going to be one shade and the other half the original shade.
      After thinking this was all finally behind us by ****'s last response, I got in the mail a notice that **** took a mechanics lien out on our property for the $1000.  I had to reopen this complaint since the lien was filed after we had settled the dispute. 
      This is so unbelievable! I am not saying dont use ****, but if you do you might want to think about getting a valid current liability insurance in your hands from anyone that **** sends on your property.

      I am sorry you had a bad experience forced ****** was involved with scorcing materials, we did our best attempt to finsh the deck in a timely manor, we apologize for the damage done by the sub-contractor.  While we appreciate you being happy woth our work up to that point, we apologize the deck did not get completed in a timely manor, in the future we will scource better subcontractors. we appreciate your business.  The lien has been removed from the property as of last week 07/28/2023.

      I know this complaint closed again, but please open it so I can respond.  Again, I wanted to give time for the release of lien to process and to receive the notice in the mail.  It has been 2 weeks and I have not received anything.  It the response, **** said the lien had been removed as of 7/28/23.  Today, 8/16/23, according to the court house there has never been a release of the lien.  I was hoping he was being honest this time but that just never is the case. Please open so I can respond that he again did not do what he said he did.

      Sad to say that I had to reopen this complaint again.  As of today, Monday, August 21st, there has been no mechanics lien release recorded per the courthouse.  If the lien was released on July 28th as the owner, *******************, of Clearcoat Roofing stated in the last response on BBB, then I would like a copy attached to this complaint of the release form.  As of the end of next month this has been a year long issue.  The stress and time it has taken away from my family and even my own work is irreplaceable.  I have contacted the attorney general's office and they are waiting for me to send in the completed complaint form and all my documentation, including this entire complaint with BBB, the contract, invoices, all the text messages and pictures of the deck before, during, and after.  I have never had to file a complaint with the attorney general's office; nor have I ever had any kind of issue like this with a business and had to file a complaint with the BBB.  What happens at this point is in ****'s hands and hopefully, it is just a hold ** in the recorders office.

      I apologize, I have not signed a document per my attorney ***************** Office in ************. I am going there today to sign the document that he needs to release it.  The date will be back dated on the paper about a month. You will see todays date on the signature line.  My apologies for not getting this signed, i was not aware i had to sign this additional paper to release the lien. It will be officially released this week.  

      I am not sure what the attorney general ***** has to do with anything, this is not a fraud issue?  But that should get cleared up when they read more into this.  We are a legitimate business that operates legitimately in the ****************. 

      The lien will be released in a couple days. again, my apologies that this wasnt signed earlier and he will have it filed asap for you.
