Good morning, To the owner and operator of Pinky’s towing, my car was towed in error and I’m asking for a full refund. My car was towed from the garage at ******** apartments where I pay for parking. The employee at Pinky’s said I was parked in a “non-parking” space to justify the tow, this is not correct. I’ve enclosed pictures showing there is no sign that indicates no parking, I’ve parked here consistently for a year, and all residents park here. As you can see from the picture, there is another car parked here because there’s no indication of not to. I’m filing this complaint on September 23, 2024, Pinky’s has till October 7, 2024, to mail a check for a full refund of $215.00. Failure to do so will result in a lawsuit being filed in small claims court, where court cost and lost wages will be filed. I also intend to recruit other residents that have been towed to encourage them to file lawsuits as well, even offering to add them to mine if it will save them money on the court cost.Business response

As a tow company we enforce parking rules for the properties we service, this consumer is not a "customer." From the photos submitted one can see that there is no double lines indicating that you can park there. The property does not want people parking by the elevator. We will not be refunding the charges to this person.Customer response

I am rejecting this response because:
There is no indication this isn’t a parking spot and the apartment complex did not call for the car to be towed . They advise Pinky’s does periodically circles around the property and look for cars to tow . It’s up to Pinky’s to know parking laws and what is considered a parking space and what signs should be visible to indicate parking is not allowed . If the money isn’t refunded , i will proceed with small claims court .

This claim is fraudulent, and this consumer is a scammer. Attached is a better picture of the same spot that this complainer cropped out the clear lines showing that this is in fact a no parking area. We deny the refund through BBB, and as stated before, this is not our customer, this is a parking violator and we are a parking violation enforcement company, of course they would not be happy with our services. As to the threat of a small claims suit, we will definitely counter sue if such a claim is filed, this complainer will lose, we have clear evidence of the violation, and this was a good tow.Customer response

After them removing my Suv from the presmises I live at they failed to relay the documents needed to pick my SUV up from there lot wasting 2 hours amd milage of my only off day. They tell me they are closed to get my SUV then charge me another fee for them "having too" hold my suv overnight.Business response

This is not a consumer complaint for services rendered, this vehicle was illegally parked at a property we service as a tow company and removed for violation of the property rules and regulations. The consumer was 100% told exactly what documents to bring for the vehicle to be released, which are the registration and driver license of the vehicle owner. This is the same thing we tell every person who has had their vehicle towed and this consumer was told the same. The fees are $25 daily storage and this consumer was made aware of the needed documents for release. This consumer is requesting no further contact which is not a problem unless the vehicle is illegally parked at a business we service.Initial Complaint

Pinky’s Towing LLC towed my car from an apartment complex. I have a 2020 Buick Enclave, my emergency breaks were on and it was towed. I got the vehicle from the tow yard a couple hours after it was towed. My vehicle is now not working. The emergency breaks will not release and unable to drive. I called Pinky’s the day off and the owner came out, looked at the vehicle and ultimately disconnected the battery in hopes to fix. Once he did that the car never came back on. It was then towed and was quoted 11k for repairs. I paid $545 to the dealership for a new battery and an assessment. I’ve had to get a rental spending an additional $298. The vehicles owner manual clearly states that my vehicle should have not been towed with the emergency breaks enabled. I called the going company to come to a resolution and the person I spoke with said there is no way the towing caused the issue and the owner would call. He still hasn’t called. There was absolutely no problems with my vehicle before it was towed. The mechanic that has it now believes that the towing company caused this issue. They are liable and need to fix this issue.Business response

This vehicle was towed on dollies which means all four wheels were off the ground and not rolling, we have photographic proof of this. We take pictures of all towed vehicles for this reason. Our company is not liable for two reasons;
1. As stated above, the driver used dollies to tow the vehicle, which means two wheels are lifted and the other two are placed on tow dollies, none of the wheels are on the ground and are not rolling.
2.When a car is impounded for being illegally parked, the tow company is not responsible for ANY damages, however, we are professionals and take the job seriously. As the complaint mentions the owner went out to see if there was anything he could do, which he was in no way obligated to do. Additionally what would a battery have to do with the tow anyhow, nothing.
This person is seeking revenge and revenue not due to them and this complaint should not be taken seriously. We have been in business for years and impounded thousands of vehicles over time, this is the first complaint registered and it is false. We do not plan to pay any revenue as this complaint is untrue, unfounded and should be disregarded.

I am rejecting this response because: As per Pinky’s response you can see how unprofessional they seem to be. In no way am I seeking revenge, I am seeking for the responsible party to be held accountable. In the vehicles owner manual it states that the vehicle should not be towed when parking breaks are on, even if it is on a dolly. The battery is part of the complaint but that is to show another example of how Pinky’s Towing is negligent when performing services on vehicles. The owner should assure that all employees are trained and provide continuous training on which vehicles are able to be towed and the damage that towing could cause if not done properly. In this case it was not done properly and the tow truck driver has little knowledge of towing my type of vehicle. In addition, I reached out to Pinky’s Towing LLC to discuss this situation and the damage they have caused and was told that the owner would call me. I have yet to receive that phone call.

This vehicle was towed because it was illegally parked, the vehicle had expired tags, which is a violation of the property rules and regulations. We are the tow company that services the contract for this property. The vehicle had to be removed and was removed properly as stated with tow dollies which lift all wheels off the ground. The emergency brake has nothing to do with anything, the vehicle was NOT dragged and the wheels were NOT rolled. While removing illegally parked vehicles there is no other way to do so other than dollies, it's not as if we had the keys or could disengage the emergency brake. This is the way it is always done.
It's unfortunate that you are having vehicle issues, but we did not cause them and will accept NO liability and NO financial responsibility.

I am rejecting this response because:
In my vehicles owners manual it states that my vehicle is not to be towed when emergency brakes are enabled, even if it’s on a dolly. It is unfortunate that Pinky’s Towing LLC does not keep up with continuous training for all vehicle types, due to their negligence my vehicle is damaged. This should be used as a learning opportunity and nothing else. I’m basing my findings off of the owners manual, not by word of mouth. Thanks !
