August of 2023 Allied Contracting Group (ACG) was hired and paid approximately $40,000 from our insurance company to repair flooring and install new cabinets due to damages from a water leak. After a few weeks of shoddy craftsmanship and damages to the brand new cabinets being installed I decided to stop future payment from our insurance company and contact the owner, **** ******** to come and assess damages incurred by his laborers. Owner agreed to come to the house but decided to cancel, within the same day, when he found out I stopped payment from insurance company. **** was extremely unprofessional with his text messaging and emails to me threatening to file a lien against our home immediately and without coming to look at damages. We offered to pay the remaining balance if he would agree to come to the house and assess defects and damages incurred by his laborers. He refused and kept up the bullying and threats through emails. We have tried to file a claim with his insurance agency and the agent refuses to accept the claim because the owner doesn’t want to open a claim. The work is defective and unfinished. I have pictures to show the damage.Business response

My name is **** ******** and I am with Allied Contracting Group in Madisonville, Ky.
I have a complaint that was filed by ***** ***** on 2/7/2024 which has been closed and marked as non-responsive by our company.
I mailed out a letter both to the BBB and to the Commonwealth of ****ucky on February 29th in response to this matter.
Included in my letter was the explanation of the events that took place with *** ******
Please let me know if you have received this letter. I did not get a notification of this complaint until the week of Feb 29, otherwise I would’ve responded sooner.
Can we reopen this and work together to get it resolved?

I am rejecting this response because:it is not a truthful response. Allied Contracting Group is making a claim that there are only slight imperfections in their work. I have included pictures of the cabinetry and crown molding that dispute that claim. There are significant damages to the cabinets and molding. A “punch list” is the wrong verbiage. The owner made an appointment to come look at the damages incurred by his laborers until he found out I stopped payment until he could asses. We have documented proof that he is in breach of contract. His laborers damaged our property and he wants us to give him more money. He filed a lien against our home and has sent threatening emails and text messages. Allied is not interested in making this right. They do not care about their customers or their satisfaction with a $40,000 renovation. We had the damage’s inspected by a licensed cabinetry company. The amount to fix what Allied destroyed is $29,000. We can talk about starting there.

Good morning, I did not deny imperfections. I simply elaborated that work ceased due to a breach of contract from your end. Payment was not collected for November, after you personally assured me that you were going to request to withdrawal the funds from your account, you didn't return and then you requested a stop payment from the insurance. The insurance money was not the only money you owed to us. As I stated for a total of four months there were invoices left open, after we tried to be as compliant as possible for you to pay your bills. As we have explained numerous times, this job would have been completed and any concerns you had were already being addressed, but work ceased as a breach of contract for non-payment, that goes for crews as well as the project managers in the office. As for the crown molding, I don't recall that even being included in the scope that was provided to you, so I'm not sure how that is relevant.

I am rejecting this response because:I’m not sure why you’re stating the crown molding wasn’t within your scope. You literally installed it. You have the pictures. As stated in previous documentation we as the homeowner, according to your own contract, have the right to inspect the work BEFORE each payment installment. That is what we did. I asked you to come out to inspect the damages. You refused unless we paid more money. That is in direct conflict of your own contract. You are in breach of your contract. We had to have a reputable inspection done by a reputable cabinet company. Estimate to repair is $29,0000.
