I got audited in 2020. I contacted them at the time. Hurricane Laura came through and delayed things. I went to jail for a domestic violence that was false when released in November of 2021 I contacted them. They insisted I bring that year’s taxes. In February 2022 I was in a motorcycle accident that landed me in a wheelchair until June. When I contacted them again she insisted once more to bring it in with this year w2. I will not intrust them to do my taxes anymore. But I payed them to cover me if audited and I brought paperwork last week without this year W2 now she refusing to answer or return my calls.Business response

My hu***nd & I first hired ****** ***** at Emily's Tax Service in 2020 for the tax year of 2019. She claimed that prior taxes were not properly filed therefore the goal was to clean things up with both our personal and business tax filing & accounting needs. Considering we were new business owners & she was highly recommended we had confidence that she would be the person for the job. We continued our business relationship with this company through the fiscal year of 2020. We noticed a decline in services, no response to phone calls and e-mails, and most importantly mistakes on our taxes. I did a pop up & requested a copy of my file (in 2020) but I did not receive it. Every time I reached out to this company, or ******, if someone even answered the phone or replied to a text, I got an excuse about Covid & delays. I requested they file that one of my businesses was closed in the first quarter of 2021, ****** claimed it was done but would never provided proof. I finally reached out to the State myself to only find out that she never filed it as closed, so I did so myself on the later part of 2021/ early 2022. She was tasked with filing my other businesses sales taxes since the start of the business September 2019 which to date, July 2022 she has done nothing, my sales taxes are delinquent per the state of Louisiana. We have since terminated this company due to lack of performance & lies. I have requested multiple times a copy of both my hu***nd & I personal & business file from this place of business with the last request being in the form of a formal email with a seven business day timeframe dated June 21, 2022 & have received nothing to date. I'm reaching out to the BBB because this company has proven to be extremely negligent with time sensitive materials & documentation & has dropped the ball on the most important part of not only our business but our lives & they can not be trusted. We're requesting the help of you to retrieve our entire file from Emily's.Business response

To whom it may concern,
I ****** ***** of Emily’s Tax Service am formally writing this email in response to a complaint made by ******** ******* During the time in question Mrs. ****** had come into Emily’s tax service seeking advice and help on their tax accounts for both business and personal. Before we could start business she came in with a stack of state of Louisiana bills for failure to file, failure to file in a timely manner, as well as bills for parish taxes, because her previous tax accountant failed to file state taxes when her Federal taxes were filed. As soon as we were hired Mrs. ****** reached out via calls and texts asking for assistance on opening a new business but in the process of doing so tragedy struck Lake Charles and we all had to evacuate, while I was evacuated with no home to return to I still managed to get this business up and running for her and she was emailed a copy of her EIN # and a text message stating check her email for the EIN #, while I was still displaced I also filed *** **** application for Mrs. ****** because she had no access to internet due to the storm. Soon after the paperwork was filed for the new company she was informed that due to the hurricane we were moving to strictly paperless because we had damage to our business location as well. During this our company was contacted by a third party company seeking personal information on Mr. ****** such as ***, income information and so on, which we did not give out because we do believe in and follow strict rules of confidentiality and it was later discovered that it was a business partner seeking a business line of credit with Mr. ******** information without his knowledge. While working for the ******** I assisted with getting store front location, and also helped with her branding her business to help her get contracts with **** and other named brand companies, I also advised her to get an attorney or paralegal to dive into a contract with herself, her hu***nd and the third party because things just didn’t seem to be right the more her and I conversed. Once she and her hu***nd discussed this matter and things came out about the business partner I was contacted about dissolving the business due to differences between the 2 parties, so while filing her 2021 taxes per our software the business was closed out. Throughout this process of being the ******** accountant I have answered to countless late night phone calls and late night emails from Mrs. ****** while she has been out working her night job at the chemical plant which disturbed my hu***nd and children while they were sleeping preparing themselves for work the following day. Also round this time I have had numerous deaths within my family and throughout the office staffs family due to Covid-19 and had to take some time off for myself so that I could mentally regroup, but while out I still tried to maintain communications with clients by text or email and Mrs. ****** would happen to be one of those clients I thought to have been one that I stayed in communication with and thought that all was well. In June of 2022 I did in fact received an email from Mrs. ****** stating that our services would no longer be needed and that we should surrender all documents pertaining to her hu***nd and herself. Due to the laws and regulations that we have to follow all our documents in the office has to remain with the company for 7 years, but all of the documents we have Mrs. ****** has been provided with them via email every year. Now with all of this being stated I also would like you all to know that the state of Louisiana issue that is something she has to take up with her spouse because he was the one who originally setup that account I only tried to help her login and pay it but her hu***nd did not have here listed as a member so we had to try and recreate login info and add her as a member so that we could go online collectively as a group to pay them but she stated that her hu***nd would just take care of that and we stated to her that these numbers would be due to state and parish by the 20th of every month so I backed off and allowed her hu***nd to take care of it as she stated he would, so moving forward in the type of business that she runs she is required by law to report her numbers to both state and parish on a monthly bases and we are no longer liable for that due to the termination of business per Mrs. ******Customer response

Complaint: ********
I am rejecting this response because: ****** ***** is providing false information nor did she provide any documentation other than 2019 and 2020 tax returns. Because of Covid protocol ****** did indeed request all earning statements, W2’s, etc. to be dropped off to her office for 2020 filings. For 2019, we scheduled an appointment and upon arrival she requested our personal file be left at the front desk for her to complete our taxes as she was a bit delayed and running behind schedule. Therefore, I had her staff make copies of what we had at the time and emailed the rest. My hu***nd nor I has never approved any NEW or additional service requests for 2021, including tax filings for 2021.
My hu***nd and I had no previous accountant, ****** was our very first accountant hired for both our newly registered business and personal accounting needs. Our business was again new when we hired her with both of our names on our business as well as our attorney, in which she recommended we remove his name but we refused. She was hired to manage all documents and file 2019 & 2020 taxes and provide proof of such, however, she only provided verbal verification for everything outside of the taxes. We received statements via snail mail from the state, requesting information she was claiming to had previously provided but failed to do so to date. These statements proved she was not handling our business and when brought to her attention she said she was on it but never provided documentation nor instruction when questioned, everything was VERBAL or stated in an email that she was working on it. I have documentation of all communication with ****** which can support my statement and provide all communication to and from her via email, call, & text. Because her office rarely answer the office phone during business hours, my preference of communication was via email (for a paper trail & date/time stamp) and a few text messages per ******’s request. All emails, texts, etc. will provide the fact of ******s refusal to provide evidence of what she has or has not done with and/or without both my hu***nd’s and I approval, providing NO DOCUMENTATION!
This is by all means is not a battle nor an accusation of what took place in her personal life as this is a business matter and her personal life has no relevance to this situation. My purpose of reaching out to the Better Business Bureau is solely to collect a COPY of the previous stated file, nothing further is relevant to this request.
This problem originated long before a hurricane and now two years after the hurricane as she has provided NOTHING, ****** is all out of excuses. She once more have refused to provide our documents in writing & it’s possible she may be hiding information given the fact that all tax documents have proven to be improperly filed after receipt and further investigation.
It is unlawful per both Federal and State guidelines to release CONFIDENTIAL information in which she has done in her response in regard to our request using your platform and to also refuse to provide or withhold any information that have taken place with any personal financial account/ file after multiple requests both verbally and in writing. My hu***nd nor I have no knowledge about what has taken place with our account while using her services. Again, my request is to receive a COPY of our COMPLETE file for our personal records within the allotted time or we will be forced to take further action without hesitation.
Sincerely,
******* ******Business response

We here at Emily's Tax Service have no problem with issuing the client a copy of her or Mr. ******'s information but as displayed throughout the office there will be a fee of $125 per year, because once we make our copies we return all documentation including w-2's. We also email out a copy of their tax return once the clients come in and e-signed. Now if the client did not e-sign we are legally not allowed to send out any copies. As for the copies we have in our office as stated in the previous response we have to keep all of our documentation on file for 7 years.
