Incomplete and Faulty Work for hurricane damage that is paid for. Work was to be done five weeks ago.

After the project was completed, the contractor allowed the Homeowner to use some of his employees free of charge as a curtesy to paint two additional rooms that were not in the original scope of work. As a result there was a drywall repair area that the homeowner said needed to be fixed. Workers started to fix the area but noted that the stud wall not the drywall was not in line. This was not in the scope of work originally agreed upon. The homeowner proceeded to make workers nervous by constantly mentioning his large gun collection. The workers no longer felt safe to return to the home. The contractor offered the homeowner to get a quote from a qualified company of his choosing even though it is the opinion of LSC that this was outside our scope of work to remedy the situation. We were willing to pay someone to fix the problem since our in house employees did not feel safe to return to the house. The homeowner refused that solution and demanded one of the men that felt intimidated to come and complete the job. Unfortunately at this time we were not able to come to a settlement regarding courtesy work.

I hired this company to do my roof after hurricane Ida and to gut my home because of water damage. I had to get another roofer to come and fix a leak. Not only did the leave a nail sticking up but all the vents were put on backwards and the wind turbines leaning and will need to be fixed. I have to pay $2200 out of pocket to have my roof repaired right, My heater vent was left unattached for all last winter. I had headaches because of the poison going into the attic. My new AC man not only found that but they didn’t spray insulation in the attic when they did the walls almost 8 months later. They broke a leg off of my 1900 armoire the first day and brought down the value 95 0/0. Their work was horrible and would break something else when I called them to come back. Plug in crooked and the electrical plates pull out when I unplug electrical cords. They put up a hall light in my hall bathroom as a vanity light (unbelievable). They tore down my backsplash that wasn’t on the appraisal list to do. I am 71 years old and when I got my check from State Farm I was told that it was their check and I HAD to sign it over to them. The first check was around $68,00 and a second check was $21,000. I have asked for invoices and the balance of my money. I have heard nothing from them. I had to pay for my gutters, two shed doors and have someone come repair what they broke or didn’t replace Now I have to pay $2200 for my roof repairs. I have spent $1000s out of pocket and maxed out two credit cards waiting for these guys to send me my refund. I would like to have proof of where my money was spent. I haven’t heard received any. My insurance guy told me they had gotten some invoices from these guys and the total doesn’t add up . I have an appointment with State Farm to go over what was done in my home. Please, can you help me. I still need to finish my home and I can’t afford to finish it. Thank You Penny Falgout

Living Solutions Construction (LSC) began work on Ms. ***** ********* home approximately 1 week after the storm (Hurricane Ida). We performed temporary repairs and mitigation repairs immediately without the request of any funds. We replaced the roof and performed all mitigation services before receiving any funds. Vast majority of funds that were received by Living Solutions Construction, LLC was for work already performed. The project began to go awry once Ms. ********* nephew and other family members perceived that there was something to be gained by selecting portions of the work to do themselves. LSC complied with the requests and immediately reimbursed the client with those portions of the job that was going to be completed by family members. Even though we were no longer working on the job we tried to assist the homeowner with obtaining her recoverable deprecation from the insurance company. One of the misconceptions was that the client thought we had obtained the recoverable depreciation, but the insurance company never released it. We explained to the client that they were able to request it because over 90% of the work was completed by LSC before her family members took over the job. The mitigation portion of the job was a total of $25,998.01 and we received $21,000.00 from the homeowner. The total amount of the build back claim was $86,814.61 and we received $65,854.54 by the homeowner. LSC reimbursed $5,325.55 towards work to be performed by her family members. As pertaining to roof repairs, we always stand behind our work and we were never made aware of any repairs that were needed. However, we are looking into this matter and will reimburse any portion of funds that LSC warranty is responsible for. The homeowner requested a breakdown of the money that was received and that was provided via email to the client immediately. As for the perceived allegations that LSC would take advantage of someone that is elderly is antithetical of our core values as a company that seeks to help and empower those in need when disaster strikes. We pride ourselves of not only being contractors with a professional standard but also having a knowledge of the insurance industry helping our clients navigate through the cumbersome process of filing insurance claims. On our part LSC is reaching out to the client to help clarify and rectify any and all misconceptions.

Mr. ***** came to us as a referral. Throughout the entire project, Mr. ***** has asked to be paid prior to completing the work or phase, not payment upon completion of a phase. More importantly, Mr. ***** stripped our home down to the studs. We have now been able to confirm that Living Solutions Construction, LLC never pulled any permits for our address (building nor electrical). This is unacceptable!!!!! One of the outstanding concerns we requested, is for Mr. ***** to have an Electrical City inspector come and inspect our home. prior any additional payments. The electrical inspection request was list among other items in an Outstanding Scope of Work List that was typed by Mr. *****'s office of which both parties signed. Our last phone conversation took place on March 2, 2022@ 5:48pm, during that conversation, Mr. ***** wanted another draw. We explained that he had not completed the outstanding work documented in the Scope of Work that we signed. We informed Mr. ***** that we wanted the City to come out and conduct and electrical inspection, Mr. ***** stated, "he does not understand why we need a city electrical inspection when he was going to pay for a home inspection by a company of our choice - it is the same process." We again, stated that we wanted the City electrical inspector; Mr. ***** said fine and hung up. Since that phone conversation on March 2nd, we have texted and phoned Mr. ***** to no avail. More importantly, our home is still not completed. Mr. *****'s action during this very trying time has been very unprofessional and misleading. Thank for the opportunity. Best. ******* ******

Business Response /* (1000, 22, 2022/05/31) */ On the above-mentioned claim, Living Solutions Construction, LLC (herein referred to as LSC) started the project around March 2021. LSC received the first draw in accordance with the original draw layout and that same day the roof was promptly replaced. It iV LSC¶V SRlic\ WR Rnl\ float the mitigation portion of the job and not the build back when dealing with insurance claims. The reason being is that most insurance claims are paid in full by the time most claims reach the build back phase. In essence, all funds should be available to complete the job in a timely manner. The only way LSC will float the build back phase is if a 3rd Party Authorization is put in place with the mortgage and insurance company. Mr. ******* ****** (herein referred to as client) chose not to sign a 3rd party authorization thus making him responsible to float the job as the homeowner. Nevertheless, LSC had to float about $38,000.00 of the build back. When LSC requested to be reimbursed for capital spent on the project, LSC was given various reasons from the client why the funds were not available. Eventually several months later LSC was reimbursed. At this time the project stalled because LSC was reluctant to keep floating the job in which LSC had no insight on the financials of the job. Later LSC decided to inject a small portion of capital as an attempt to close out the project in which case the capital was reimbursed. LSC decided to work with the client to do smaller portions of the work to reduce capital exposure. Yet again another delay occurred when the request for reimbursement was submitted, and the funds were not available. As of the date of this complaint LSC has completed the full scope of work. We are currently Living Solutions Construction, LLC PO Box 1764, *******, LA XXXXX ************ (o) ********************@gmail.com Louisiana Licenses: Residential XXXXXX * Commercial XXXXX * Mold Remediation XXXXXX getting inspections performed as well as a final punch list and believe to have this matter resolved and a certificate of completion in a matter of 30 days. Attached to this is also before and after pictures of the property. Consumer Response /* (3000, 24, 2022/06/02) */ With all do respect, LSC respond is not accurate. We have payments made to LSC, signed agreements between both parties, texts and photos that are date & time stamped to support the unprofessional manner in which LSC has conducted its business by stalling the completion of our home. Our insurance company paid all of the finance requested. One of the problem LSC had with the project is he had NO control over the monies sent by our insurance that was allocated for repairs, and we were not in the business of paying before the work is completed. So LSC decided to stall the project, and now it is going to be two years in August. LSC does not want us to put the truth out regarding its failure to obtain proper City inspection like building permit and electrical inspections prior to closing the walls with sheetrock. It was nerver about a lack of finance. It was always about his lack of control over payment prior to completing the work.
